USE REQUIREMENTS

FOR RESIDENTIAL DISTRICT R-1, R-2, R-3

§ 158.085 INTENT.

   To establish residential districts and to protect property in the districts from the depreciating effects of incompatible land uses. Residential uses are intended to be the primary use within each district.

§ 158.086 R-1 RESIDENTIAL DISTRICT (SINGLE-FAMILY).

   (A)   Purpose. To establish a low-density, single-family district and to protect property in the district from the depreciating effect of incompatible land uses.
   (B)   Permitted uses.
      (1)   Single-family dwellings.
      (2)   Accessory buildings and uses of structures customarily incidental to any permitted uses, provided no accessory structures shall be located in any required front or side yards and no structure shall be less than five (5) feet from any property line or principal building.
      (3)   Signs subject to the provisions of§ 158.160 et seq.
      (4)   Home occupations subject to the provisions of Chapter 116, Home Occupations.
   (C)   Churches. Churches, private schools and recreational facilities located in mobile homes shall be considered as mobile homes, and not as churches, schools or recreational facilities.
   (D)   Permitted special exceptions. Only after public notice and public hearing, subject to appropriate conditions and safeguards, the Board of Appeals may permit a special exception.
      (1)   Nursing or convalescent homes;
      (2)   Hospital and medical treatment facilities;
      (3)   Government buildings and uses except those relating to purpose of penology and correction;
      (4)   Nursery schools and kindergartens subject to the provision of § 158.139;
      (5)   Mobile/manufactured homes that are compatible with the immediate surrounding architecture or structures, to be skirted with commercial skirting materials or masonry perimeters within 90 days from date of zoning permit;
      (6)   Pub1ic and semi-public recreational facilities and uses not operated for profit, which may include parks, playgrounds, country clubs, community centers, neighborhood buildings;
      (7)   Churches, including Sunday school or educational buildings and other places of worship; and
      (8)   Schools.

§ 158.087 R-2 RESIDENTIAL DISTRICT (DUPLEX).

   (A)   Purpose. To establish a medium density, duplex residential district, exclusive of commercial and industrial uses, which will protect property in the district from depreciating effects of incompatible land uses.
   (B)   Permitted uses.
      (1)   Single-family and 2-family dwellings on individual lots, and in group housing projects subject to § 158.135;
      (2)   Accessory buildings and uses of structures customarily incidental to any permitted uses, provided no accessory structure shall be located in any required front yard or side yards and the structure shall be less than five (5) feet from any property line or principal building;
      (3)   Churches and other places of worship, including Sunday schools and other educational buildings;
      (4)   Schools;
      (5)   Public and semi-public recreational facilities and uses not operated for profit, which may include parks, playgrounds, country clubs, community centers, neighborhood building;
      (6)   Home occupations subject to the provisions of Chapter 116, Home Occupations.
      (7)   Signs subject to the provisions of § 158.160 et seq.;
      (8)   Nursery or kindergarten schools provided all state requirements are met and subject to the provisions of § 158.139; and
   (C)   Churches. Churches, private schools, and recreational facilities located in mobile homes shall be considered as mobile homes, and not as churches, schools or recreational facilities.
   (D)   Permitted special exceptions.
      (1)   Public utilities, transformer stations, water tanks, and towers, electrical transmission lines and towers, telephone exchanges with no vehicle or equipment storage;
      (2)   Nursing or convalescent homes;
      (3)   Private, non-profit clubs and lodges;
      (4)   Libraries;
      (5)   Hospital or medical treatment facilities;
      (6)   Governmental buildings and uses, except those used for corrections and penology; and
      (7)   Mobile/manufactured homes to be skirted with commercial skirting material or masonry perimeters within 90 days from the date of the zoning permit issued.

§ 158.088 R-3 RESIDENTIAL DISTRICT (MULTI-FAMILY).

   (A)   Purpose. To establish a medium to high-density residential district, exclusive of commercial and industrial uses, which will protect property in the district from the depreciating effects of incompatible land uses.
   (B)   Permitted uses.
      (1)   Single-family, 2-family and multi-family dwellings on single lots, or in group housing projects, subject to the provisions of § 158.137;
      (2)   Accessory buildings and uses of structures customarily incidental to any permitted use, provided that no accessory building is located in any required front or side yards and no structure shall be less than five (5) feet from any property line or principal building;
      (3)   Schools;
      (4)   Churches and other places of worship, including Sunday schools and educational buildings;
      (5)   Public and semi-public grounds for games and sports, parks, country clubs, recreational and community centers or neighborhood buildings and activities not operated for profit;
      (6)   Rooming and boarding houses;
      (7)   Home occupations subject to the provisions of Chapter 116, Home Occupations.
      (8)   Signs subject to the provisions of § 158.160 et seq.
      (9)   Public utilities, transformer stations, water- tanks and towers, electrical transmission lines and towers, telephone exchanges with no vehicles or equipment stored on the premises;
      (10)   Nursing and convalescent homes;
      (11)   Private, non-profit clubs and lodges;
      (12)   Libraries;
      (13)   Hospital or medical treatment facilities;
      (14)   Governmental buildings and uses, except those used for corrections or penology;
      (15)   Nursery schools and kindergartens provided all state requirements are met and subject to the provisions of § 158.139.
   (C)   Permitted special exceptions. Mobile home parks subject to the provisions of Chapter 152, South Congaree Mobile Home Park Chapter.
