USE REQUIREMENTS

FOR COMMERCIAL DISTRICT C-1, C-2

§ 158.100 GENERAL COMMERCIAL (C-1).

   (A)   Purpose.
      (1)   This district is intended to be a general commercial zone, exclusive of industrial uses, in which a wide variety of commercial facilities can be located serving a large market area.
      (2)   Residential uses are also permitted in this zone as principal uses.
   (B)   Permitted uses.
      (1)   Accessory buildings and uses of structures customarily incidental to any permitted use, provided the structures shall not be located in any required front or side yards and no structure shall be less than ten (10) feet from any property lines or principal building;
      (2)   Animal hospitals and veterinary clinics;
      (3)   Automobile servicing including gasoline and repair, excluding wrecker service and towing services;
      (4)   Banks and other financial institutions;
      (5)   Day nurseries and kindergartens, subject to the provisions of § 158.139 (public and private);
      (6)   Dwelling units in connection with permitted or permissible uses or structures located on the same premises therewith;
      (7)   Eating and drinking establishments including drive-in facilities;
      (8)   Farm equipment sales and services establishments;
      (9)   Funeral homes;
      (10)   Group commercial development subject to the provisions of § 158.135;
      (11)   Hotels and motels;
      (12)   Light manufacturing uses such as a bakery, dairy products, processing, soft drink bottling, dry cleaning plant and electronic production;
      (13)   Offices, such as business, professional, governmental or civic organizations;
      (14)   Printing establishments;
      (15)   Public buildings and land uses of a governmental or administrative nature;
      (16)   Public utility substations;
      (17)   Recreational facilities, such as clubs, lodges, museums, and related cultural establishments, and commercial recreational facilities and uses subject to provisions in § 158.143;
      (18)   Rest homes, convalescent homes, nursing homes, orphanages, sanitariums, and hospitals; provided that no facility shall have a lot of less than two (2) acres, and no building in connection with the facility shall be closer than 25 feet from any property line.
      (19)   Retail establishments;
      (20)   School facilities, such as public or private schools located in permanent structures;
      (21)   Service establishments, such as personal, business, professional and repair;
      (22)   Signs, subject to the provisions of § 158.160 et seq.;
      (23)   TV and radio studios;
      (24)   Dwelling units other than manufactured or mobile homes; and
      (25)   Any other commercial use not specifically listed above which would be in the harmony with the purpose of this district.

§ 158.101 NEIGHBORHOOD COMMERCIAL (C-2).

   (A)   Purpose.
      (1)   This district is intended for those commercial uses which are beneficial to residential districts.
      (2)   It is a buffer between neighborhoods and more intense commercial development.
   (B)   Permitted uses.
      (1)   Accessory buildings and uses of structures customarily incidental to any permitted use, provided the structures shall not be located in any required front or side yards and no structure shall be less than ten (10) feet from any property lines or principal building;
      (2)   Animal hospitals and veterinary clinics;
      (3)   Churches, or other places of worship, including educational facilities;
      (4)   Day nurseries and kindergartens subject to the provisions of § 158.139;
      (5)   Dwelling units associated with permitted uses and located on the same lot therewith;
      (6)   Government buildings and uses, except those concerned with correction or penology;
      (7)   Medical treatment facilities such as dentist's and doctor’s offices;
      (8)   Libraries;
      (9)   Nursing and convalescent homes; and
      (10)   Public and semi-public recreation and community centers and uses not operated for profit.
   (C)   Special exceptions.
      (1)   Private, non-profit clubs and lodges;
      (2)   Public utilities, transformer stations, water tanks, electrical transmission lines and towers, and telephone exchanges, provided that no vehicles or equipment are stored on the premises;
      (3)   Schools; and
      (4)   Single-family or two (2)-family dwellings on individual lots or housing developments.
