Housing Commission
§ 116-35.1 Establishment.
There is hereby established a Housing Commission for the Village of Southampton, which shall be advisory to the Village Board, the Planning Board, the Zoning Board of Appeals and the Architectural Board of Review. The Commission shall also be advisory to the Building Inspector and Building Department.
§ 116-35.2 Membership.
A.
The Housing Commission shall consist of five members, one of whom shall be appointed Chairperson and another, Deputy Chairperson, who shall act in the absence or inability of the Chairperson, and a Secretary.

Members of the Commission shall be appointed for a term of three years. The first appointment of members thereto shall be for terms so that, of the initial appointment, two members shall be appointed for three years, two members shall be appointed for two years, and one member shall be appointed for one year. Upon the expiration of the initial appointments of the terms of the initial appointees, the subsequent appointments shall be for three years each. Members shall be required to be residents of the Village. No person who is a member of the Village Board of Trustees shall be eligible for membership on the Housing Commission. Any member of the Commission may be removed by the Mayor for cause and after public hearing.

Meetings shall be held at the call of the Chairperson and at such other times as the Commission may determine. Meetings of the Commission shall be open to the public to the extent provided in Article 7 of the Public Officers Law. The Commission shall keep minutes of its proceedings, showing the vote of each member upon each question or, if a member is absent or fails to vote, indicating such fact, and shall keep records of its actions.
§ 116-35.3 Appointments.
Appointment of members to the Commission shall be made by the Mayor, with the approval of a majority of the Village Board of Trustees.
§ 116-35.4 Vacancies.
If a vacancy shall occur otherwise than by expiration of a member's term, it shall be filled by an interim appointment for the remainder of the former member's unexpired term.
§ 116-35.5 Rules of procedure.
The Commission shall adopt rules of procedure as may be necessary to the proper exercise of its responsibilities with respect to the foregoing purposes of its establishment.
§ 116-35.6 Decisions made.
Each decision of the Commission shall be by resolution. It shall be approved by a majority of the Commission.
§ 116-35.7 Requests of Commission.
Notwithstanding the foregoing, in the case of applications for a renewal of a special exception use relating to accessory apartments, where the recommendation of the Commission shall be requested or required, such requests shall be reviewed by a committee of one member of the Commission, designated by the Chairman, to determine whether or not consideration by the full Commission shall be appropriate. Except for extraordinary circumstances, the report and recommendation of the Commission shall be given by such committee of one member. In making a recommendation for referral of such a case to the full Commission, such committee of one member shall set forth in such recommendation the reason either for or against referral of the request to the full Commission in addition to the recommendation by such member. The report and recommendation of the Commission shall set forth its findings and conclusions.
§ 116-35.8 Failure to issue recommendation.
In the event that the committee or the full Commission shall fail to issue a recommendation with regard to an application within 30 days after the same shall have been referred to the Commission, the recommendation of the Commission shall be deemed to have been a recommendation in favor of the subject application. Such thirty-day period may be extended for good cause by a majority of the Commission with the consent of the applicant.
§ 116-35.9 Extension of special exception use.
No extension of a special exception use relating to an accessory apartment shall be granted by the Zoning Board of Appeals unless the same shall have first been referred to the Housing Commission.
