16.48 REGULATIONS

Within a planned unit development (P.U.D.), no land or buildings shall be used except for one or more of the following uses:

  1. The uses listed as permitted or conditional uses in the district(s) in which the development is proposed;
  2. Educational, religious, cultural, recreational, or commercial facilities that are designed and intended to serve the residents of the planned unit development. The burden of proof shall rest upon the applicant to show that these non-residential uses, when located in a residence district, are designed and intended for the primary use of the residents in the P.U.D., provided further that no such commercial uses shall be constructed until 75% of the total dwelling units contained in the entire project are completed. Completed shall mean qualifying for a certificate of occupancy.
  3. Use(s) normally more appropriate in other zoning districts shall not occupy more than 15% of the land area within the district(s) in which the development is proposed.
