CHAPTER 156

ANNEXATIONS AND ANNEXATION AGREEMENTS

§ 156.01.- Annexation.

(a)

In order to provide for territorial growth of the city that is in accord with recognized planning principles, all proposed annexations to the city shall undergo review in accordance with the annexation review process set forth in section 156.02.

(b)

Land that is annexed to the City of Springfield pursuant to Division 1 of the Illinois Municipal Code (65 ILCS 5/7-1-1 et seq., as amended) is subject to the ordinances, control, and jurisdiction of the City of Springfield.

(c)

For structures where a permit has been validly issued prior to coming under the jurisdiction of the City of Springfield pursuant to this section and Division 1 of the Illinois Municipal Code, the building, plumbing, electrical, mechanical, elevator, fire and safety codes of the authority that issued the permit shall be applied to those structures through issuance of a certificate of occupancy.

(d)

For structures where a permit has not yet been validly issued, the ordinances, control and jurisdiction of the City of Springfield shall apply.

§ 156.02. - Annexation review process.

Before any vote is taken by the city council on a proposed annexation, the annexation review process set forth below shall be completed: provided, however, the validity of an annexation ordinance passed by the city council shall not be affected by a failure to follow or any deviations from the provisions thereof.

§ 156.03. - Land under annexation agreement.

(a)

Land that is the subject of an annexation agreement with the City of Springfield adopted pursuant to Division 15.1 of the Illinois Municipal Code (65 ILCS 5/11-15.1 et seq., as amended) is subject to the ordinances, control, and jurisdiction of the City of Springfield in all respects the same as land that lies within the corporate limits of the City of Springfield.

(b)

For structures where a permit has been validly issued prior to coming under the jurisdiction of the City of Springfield pursuant to this section and Division 15.1 of the Illinois Municipal Code, the building, plumbing, electrical, mechanical, elevator, fire and safety codes of the authority that issued the permit shall be applied to those structures through issuance of a certificate of occupancy.

(c)

For structures where a permit has not yet been validly issued, the ordinances, control and jurisdiction of the City of Springfield shall apply.

(d)

For purposes of this section, the term "jurisdiction" refers only to code jurisdiction, and not to the following types of jurisdiction: road, fire protection, public library, highway, township, election authority, post office, and the like. Land subject to an annexation agreement with the City of Springfield that is not yet annexed to the City of Springfield continues under the jurisdiction of the road, fire protection, public library, highway, township, election authority, post office, and the like of the area of which the Land is physically located until the Land is actually annexed to the City of Springfield in accordance with the Illinois Municipal Code (65 ILCS 5/1-1-2, et seq., as amended).
