Intent, purpose, and applicability. The intent and purpose of these affordable overlay zones is to create a realistic opportunity for the construction of low- and moderate-income housing in the Borough of Stanhope on land that may become available for development, thereby addressing the Borough's fair share housing obligation under the New Jersey Fair Housing Act and constitutional obligations to provide affordable housing. The overlay zones may be utilized to develop under these standards upon the provision of adequate sewer and water service to support the proposed densities in the zones. These zoning applies to the following properties:

Permitted uses. Multi-unit dwelling and townhouses are permitted in specific sections of the AHO Zones subject to a mandatory 20% set-aside for affordable housing, regardless of tenure. The uses herein are permitted in addition to those uses already permitted by the underlying zone district. Multifamily residential use may be proposed over permitted uses in the underlying zone in a mixed-use building in the AHO-3 and 4 areas or as a stand-alone multifamily residential building in the AHO-1 through AHO-3 area. Nonresidential uses may be proposed in addition to the proposed residential uses on the property.
