ARTICLE II

- OIL AND GAS

Sec. 154.100. - Scope.

It shall be unlawful to construct, drill, erect, operate, explore, produce or install an oil and gas well and/or pipeline within 1,500 feet of a protected area listed in Section 154.12 of this subchapter.

Sec. 154.101. - Definitions.

For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. All technical or oil and gas industry words or phrases used herein and not specifically defined shall have that meaning customarily attributable thereto by prudent operators in the oil and gas industry.

Abandonment. As defined by the Texas Railroad Commission, and includes the plugging of the well and the restoration of any well site as required by this subchapter.

Drilling. Digging or boring a new oil and gas well for the purpose of exploring for, developing or producing gas or for the purpose of injecting gas, water, or any other fluid or substance into the earth.

Exploration. Geologic or geophysical activities, including seismic surveys, related to the search for gas or other subsurface hydrocarbons.

Oil and gas well. Any single hole or bore to any horizon, formation or strata, for the purpose of producing gas, liquid hydrocarbon, brine water or sulphur water or for use as an injection well for secondary recovery, disposal or production of gas, or other hydrocarbons from the earth. For each separate new hole a gas well permit is required.

Public building. All buildings used or designed to and intended to be used for the purpose of assembly of persons for such purposes as deliberation, education, entertainment, amusement or health care. "Public buildings" include, but shall not be limited to theaters, assembly halls, auditoriums, armories, mortuary, religious institutions, dance halls, exhibition halls, museums, gymnasiums, bowling lanes, libraries, schools, skating rinks, courtrooms, restaurants and hospitals.

Religious institution. A building in which people regularly assemble for religious worship and activities intended primarily for purposes connected with such worship or for propagating a particular form of religious belief.

Sec. 154.102. - Protected areas.

All distance shall be measured from the property line of the proposed well in a straight line, without regard to intervening structures or objects, to the closest exterior point of any structure or boundary line listed below:

AG "Agricultural District" zoning;

B-3 "Central Business District" zoning;

Day care facility;

(E)

Existing oil and gas wells or pipelines;

Hospital;

(G)

Municipal sanitary sewer main;

(H)

Municipal water main;

Public building;

(J)

Public park;

(K)

R-1 "Single Family Residential District" zoning;
