CHAPTER II

ZONING DISTRICTS

Sec. 201.- General provisions.

The location and boundaries of the districts established in this Ordinance are shown upon the Official Zoning Map of Sterling which is incorporated into this Ordinance. The Zoning Map and all subsequent amendments shall be as much a part of this Ordinance as if fully set forth and described herein.

Sec. 202. - Zoning district boundaries.

The district boundary lines on the Zoning Map are intended to follow lot lines or center lines of streets, alleys, railroads or other natural barriers.

Sec. 203. - Rules of interpretation.

Regarding the boundaries of any use district shown on the Zoning Map, the following rules shall apply:

A.

Boundaries indicated as approximately following the center lines of streets, highways or alleys, shall be construed to follow such center lines;

B.

Boundaries indicated as approximately following platted lot lines shall be construed to follow such lines;

C.

Boundaries indicated as following railroad lines shall be construed to follow the midpoint of the railroad right-of-way;

D.

Boundaries indicated as following the municipal limits shall be construed as following municipal limits;

E.

Distances not specifically indicated on the Official Zoning Map shall be determined by the scale of the map;

F.

Where existing physical features conflict with features shown on the Official Zoning Map, or in circumstances not covered in subsections A—E above, the Board of Adjustment shall interpret the boundaries;

G.

No zoning district boundary shall be established that will divide one lot into two (2) or more zoning districts. Where a lot is divided by a zoning district boundary line at the time of enactment of this Ordinance, the zoning may be changed to whatever zoning classification is more appropriate to the property in question.

Sec. 204. - Changes to the zoning map.

Changes in the boundaries of the zones shall be made by ordinance and shall be reflected on the Official Zoning Map.

Sec. 205. - Zoning districts established.

In order to carry out the intent, purpose, and provisions of this Ordinance, the City of Sterling is hereby divided into the following zoning districts:

Low Density Residential R-1
Medium Density Residential R-2
High Density Residential R-3
Mobile Home MH
Medical Services MS
Neighborhood Business NB
Community Business CB
Central Business District CBD
Light Industrial LI
Heavy Industrial HI
Open Space OS

Sec. 206. - Purpose of districts.

Each of the districts enumerated herein is designed and intended to fulfill the following purposes:

R-1 Low Density Residential: Areas which are used for single-family dwelling unit residential development.

R-2 Medium Density Residential: Areas used for single-family detached units and two-family dwellings (duplexes).

R-3 High Density Residential: Areas which are used for multiple unit development ranging in type from triplexes to apartments.

MH Mobile Home: Areas which are intended to provide an alternative conventional housing by permitting mobile home development on privately owned lots in subdivisions designed for such development and mobile home development in a park designed for such development under single ownership or control. Additional regulations governing mobile home development are located in Chapter VII of this Ordinance.

NB Neighborhood Business. Areas which provide for administrative and professional services and limited personal services, and related uses oriented towards and compatible with residential neighborhoods.

MS Medical Services: Areas which provide for an appropriate grouping of medical service facilities which could include a hospital as a nucleus, related offices, drugstores, restaurants, etc.

CB Community Business: Areas permitting a wider range of retail, business, and commercial opportunities serving a number of neighborhoods, the community, and/or visitors.

CBD Central Business District: The area of the central business district which is intended to provide for the development of a concentrated, pedestrian-oriented commercial center.

LI Light Industrial: Areas which are intended to accommodate industries involved with research, development, and manufacturing, assembly or packaging or previously manufactured goods, precision parts, instruments, and/or tools. All operations within this district, including storage, must be enclosed. Additional regulations governing LI development are located in Chapter VII of this Ordinance.

HI Heavy Industrial: Areas which are intended to accommodate most industrial enterprises and attendant facilities, including outside storage. Additional regulations governing HI development are located in Chapter VII of this Ordinance.

OS Open Space: Areas which are intended to preserve the natural, scenic or historic features of the landscape.
