CHAPTER 17

52 - GENERAL REQUIREMENTS FOR ALL DISTRICTS

17.52.010 - Compliance with provisions.

17.52.020 - Street improvements.

Every principal building shall be built upon a lot with frontage upon a public street improved to meet borough standards or for which such improvements have been ensured by the posting of a performance guaranty pursuant to the subdivision regulations of the borough. In the case of lots not comprising portions of a plan of lots approved pursuant to the subdivision regulations of the borough, the minimum borough standard of street improvement shall be a thirty-foot roadway paved with a durable and permanent surface on a properly prepared subgrade, the construction of which shall be reviewed, inspected and approved by the appropriate borough authorities. These street improvements shall be made from the nearest public street to the farthermost property line of the subject lot.

17.52.030 - Irregular lots.

In the case of an irregular lot in which the side lot lines are not parallel, the average width of the lot may be substituted for the required minimum lot frontage, but the street lot frontage shall not be less than eighty (80) percent of the minimum required width prescribed by chapter 17.48.

17.52.040 - Overlapping yards prohibited.

No yard or other open space provided about any buildings for the purpose of complying with the provisions of this chapter shall be considered as providing a yard or open space for any other building, and no yard or other space on another lot shall be considered as providing a yard or open space for a building on any other lot.

17.52.050 - Sight triangles.

At the intersection or interception of (2) two or more streets, no hedge, fence or wall higher than three (3) feet above curb level or any obstruction to vision other than a post or tree not exceeding one (1) square foot in cross-section shall be permitted within the triangular area formed by the intersecting street lines and a straight line joining points located on said street line thirty (30) feet distant from their point of intersection. In the case of a tree located within said sight triangle, a clear and unobstructed view shall be maintained in perpetuity from average grade level to a height of six (6) feet.

17.52.060 - Measurement of front yard.

When a lot has frontage on a street right-of-way and has been designated for widening by the borough, Camden County or the State of New Jersey, the required front yard area shall be measured from the proposed right-of-way line, which shall in all cases be a minimum of twenty-five (25) feet from the road centerline.

17.52.070 - Conditions for use of noncomplying parcel of land.

Any parcel of land with an area or width less than that prescribed for a lot in the zone in which such lot is located may be used as a lot for any purpose permitted in the zone other than multiple dwellings, provided that the owner owns no adjoining land and all other regulations prescribed for the zone in this chapter are complied with.

17.52.080 - Outdoor storage.

The outdoor storage of goods, articles, appliances and vehicles shall be prohibited in commercial and industrial districts unless the items being stored are to be sold on the premises, located to the rear of the front setback line and screened in a manner which prevents their being viewed from any residential property.

17.52.090 - Prohibited uses in any zone.

The structures and uses listed below are specifically prohibited in any zone:

A.

Any use which emits excessive or objectionable amounts of dust, fumes, noise, odor, smoke, vibrations or waste products.

B.

Junkyards.

C.

The permanent use of any portable building or structure, stationary vehicle or stand, trailer or tent of any description for the purpose of storage, displaying, selling food, merchandise or commodities of any kind.

D.

The use of a barn, building or structure of a temporary nature, garage, trailer, outbuilding, motor vehicle, shack or tent on any lot or parcel of land for living purposes in any district on either a temporary or permanent basis.

17.52.100 - Roof-mounted equipment.

Mechanical equipment located on the roof should be shielded from view.

17.52.200 - Telecommunication towers.

Telecommunication towers should not be permitted closer than five hundred (500) feet to any residential structure.

17.52.300 - Noise control.

Permitted noise levels should be in accordance with the following criteria and those rules established by the New Jersey Department of Environmental Protection, as they may be adopted and amended:

17.52.400 - Contiguous lots.

When two (2) or more contiguous lots are under the same ownership and one (1) or more of those lots are undersized in area or dimension, the land holdings will be considered as one (1) lot.

17.52.500 - Change of use, zoning approval for occupancy.

A.

Except as may be exempted by law under the provision of N.J.S.A. 40:55D-37a or waived by the joint laud use board (JLUB), site plan approval by resolution of the joint land use board shall be required as a condition for the issuance of a zoning permit, building permit, certificate of conformity or certificate of occupancy for any development as the word development is defined under N.J.S.A. 40:55S-4, and particularly including any use, change of ownership or use, or extension of a non-conforming use for which a zoning permit is required.

B.

Site plan approval is not required to permit a change of use that involves an existing structure; does not require any new construction, with the exception of minor interior renovations; does not require any site improvements effecting bulk regulations or revision to adopted design standards; and does not require use variance approval under the provisions of N.J.S.A. 40:55D-70d, provided there is an existing site plan on file or record with the borough and this site plan is acceptable to the zoning officer. The zoning officer will show the site plan to the new owner(s) and have the owner(s) complete and sign the "Acceptance of Site Plan" form showing they have seen, agree with, and accept the site plan. This document will be filed with the site plan in Borough Hall. A copy of the zoning officer's report will be sent to the secretary of the joint land use board for informational purpose only. A site plan is not required for single-family or two-dwelling unit buildings.
