1.0301.- Zoning districts.

The following zoning districts are hereby established and the city is divided into the following districts.

(A)

R-1 rural residential.

(B)

R-2 subdivision residential.

(C)

R-3 residential.

(D)

R-4 apartment.

(E)

R-5 residential.

(F)

B-OS business office service.

(G)

B-C central business.

(H)

B-H 1 business highway 1.

(I)

B-H 2 business highway 2.

(J)

M manufacturing.

(K)

P parking.

(L)

PD planned development.

1.0302. - Zoning map.

(A)

Zoning map incorporated. The zoning map delineating the zoning districts set out in [section] 1.0301 is hereby declared to be a part of this section. Except where reference is shown on the map to a street line or other line designated by dimensions, the district boundary lines follow lot lines or the centerlines of streets, alleys and railroads as they existed at the time of the adoption of this section.

(B)

Lot divided by zone line. Where a district boundary line, as established in this section, or as shown on the zoning map, divides a lot shown or recorded as being in single ownership at the time of enactment of this section, the district regulations and uses shall be observed on the respective side of the district line to which they apply.

1.0303. - Zoning text interpreted.

Where uncertainty exists with respect to uses permitted in any district, or any condition set forth in this [zoning] ordinance, the following rules shall apply.

(A)

No use of land shall be permitted in any use district except those uses specifically permitted in a zoning district.

(B)

Uses or structures not specifically permitted in a zoning district shall be prohibited in such district.

(C)

Unless otherwise provided for in this [zoning] ordinance, where uses of yard areas are indicated as being permitted, the use of any yard area for any use other than that permitted shall be prohibited.

1.0304. - Zoning of annexed areas.

Any area annexed or transferred to the city shall, immediately upon such annexation or transfer, automatically be zoned the same as the adjacent zoning district. Upon recommendation of the zoning official or referral by the city commission as provided in section 1.1406, the planning board shall recommend appropriate zoning for such area within three months after the matter is recommended by the zoning official or referred by the city commission.

1.0305. - Zoning of vacated lands.

Whenever any street, alley or other public way within the city shall be vacated, such street, alley or other public way or portion thereof shall automatically be classified in the same zone district as the property to which it attaches.

1.0306. - District requirements.

All buildings and uses in any district shall be subject to all of the applicable provisions of article[s] I through XIV of this [zoning] ordinance.
