§ 18.09.3

RS-3 Multi-Family Residences.

The following regulations shall apply in the RS-3 District:
(1) 
Permitted Uses.
(a) 
Single family dwellings.
(b) 
Duplex/two family dwellings.
(c) 
Multi-family units.
(2) 
Permitted Accessory Uses.
(a) 
No more than one detached garage or accessory building in compliance with the provisions of Section 18.04(3)(e), further limited as follows:
1. 
The maximum size of a detached garage or accessory building associated with a single family dwelling shall be limited to 480 square feet.
2. 
Detached garages and accessory buildings on duplex lots shall be limited to 240 square feet per side.
3. 
Lots with multi-family units shall be limited to allow accessory buildings containing one 12-foot-by-24-foot parking stall per residential unit. Layout of those stalls shall be approved as part of site plan approval.
4. 
Gazebos of less than 200 square feet shall be exempt from these requirements.
(b) 
Private swimming pools and decks.
(3) 
Conditional Uses. The following uses may be considered for conditional use (see Section 18.04(3)(d)):
(a) 
Signs.
(b) 
Artificial lakes and ponds 2,000 square feet or larger in size.
(c) 
Zero lot line duplexes if approved by the Planning and Zoning Commission and Board pre-construction.
(4) 
Lot Requirements.
(a) 
Single Family Dwelling Lot.
1. 
Area: 9,000 square feet.
2. 
Width: 60 feet minimum.
(b) 
Duplex Lot.
1. 
Area: 10,000 square feet minimum.
2. 
Width: 70 feet minimum.
(c) 
Multi-family lots.
1. 
Area: 18,000 square feet.
2. 
Width: 40 feet minimum.
(5) 
Height Regulations.
(a) 
Residential dwellings: 40 feet maximum.
(b) 
Accessory structure: 25 feet maximum.
(6) 
Buildable Area.
(a) 
All single family and duplex lots (including planned developments and conservation by design subdivision) shall have a minimum buildable area of 2,500 square feet per residential unit.
(b) 
Multi-family lots shall have a minimum buildable area of 1,750 square feet per residential unit.
(7) 
Building Setbacks. All building setbacks shall be measured from the foundation wall, except that any overhang greater than two feet shall require additional setback equal to the amount greater than two feet. Building setbacks shall be those listed on a certified survey map and/or plat duly approved by the Board for the Village on or after September 16, 2002, or the setbacks listed below:

(8) 
Building Size. Minimum size of a residential dwelling unit shall be 800 square feet above grade.
(9) 
Building Facades. All multi-family buildings shall require at least 50% of the exterior wall surface consist of brick, masonry, natural stone or other similar material approved as part of the site plan approval.
(10) 
Other Requirements.
(a) 
All corner lot duplexes shall access one unit to each street unless otherwise specified.
(b) 
All duplex lots must be identified on the preliminary and final plat on the specific lot prior to any approvals.
(c) 
Multi-family lots require site plan review by the Planning and Zoning Commission with recommendation to the Village Board for final approval.
