CHAPTER 4

ZONES AND BOUNDARIES

10-4-1: ZONES ESTABLISHED:

   A.   Classification: For the purpose of this title, the City is divided into classes of zones as follows:
      Residential Zone R-1
      Residential Zone R-3
      Commercial Zone C-1
      Commercial Zone C-2
      Communication Zones C-2-C
      Boulevard Mixed Use Zone BMU

   B.   Height Limiting Zones: In addition to the zones hereinabove established, all the land within the incorporated boundaries of the City and within fifty thousand feet (50,000') of the established airport reference point at Hill Air Force Base, is hereby divided into height limiting zones, the boundaries of which and the height applicable thereto to be as provided herein and/or as shown on a map or maps entitled "zoning map of Sunset City", which maps are a part hereof as provided in subsection 10-4-2A of this chapter. 10-4-2: DISTRICT AND ZONE BOUNDARIES:

   A.   Applicability To Zoning Map: The boundaries and height restrictions applicable thereto of each of the districts of the City which are hereby zones, and the zones therein, are hereby established as shown on the map or maps entitled "zoning map of Sunset City", or as hereafter amended, which map or maps, and all boundaries, notations and other data shown thereon are made by this reference as much a part of this title as if fully described and detailed herein. The said map or maps shall be filed in the custody of the City Recorder and may be examined by the public subject to any reasonable regulations established by the City Recorder.    B.   Uncertainty; Applicable Rules: Where uncertainty exists as to the boundary of any district or zone therein, the following rules shall apply:
      1.   Wherever the boundary is indicated as being approximately upon the centerline of a street, alley or block, or along a property line, unless otherwise definitely indicated on the map, the centerline of such street, alley or block, or such property line, shall be construed to be the boundary.
      2.   Wherever such boundary line is indicated as being approximately at the line of any river, irrigation canal, or other waterway or railroad right-of-way, or any section line, then in such case the center of such stream, canal or waterway, or of such railroad right-of-way, or the boundary line of such public land or such section line shall be deemed to be the boundary.
      3.   Where such boundary lines cannot be determined by the above rules, their location may be found by the use of the scale appearing upon the map. (Zoning Ord.)
      4.   Where the application of the above rules does not clarify the boundary location, the Appeal Authority shall interpret the map. (Ord. 2015-08, 11-4-2015)
