CHAPTER 7

NONCONFORMING USES

10-7-1: WHEN ALLOWABLE:

Any lawful use of buildings or land at the time of the original passage hereof, that does not conform to the regulations prescribed herein, shall be deemed a nonconforming use and such use may be continued, but if such nonconforming use is discontinued for a period of one year or more, except for residential structures or accessory farm structures, any future use of said building or land must be in conformity with the provisions of this Title. A nonconforming use, if changed to a conforming use may not thereafter be changed back to any nonconforming use. (Zoning Ord.)

10-7-2: REPAIRS AND STRUCTURAL ALTERATIONS:

Repairs and structural alterations may be made to a nonconforming building; provided, that the floor space of such building is not increased. (Zoning Ord.)

10-7-3: DESTRUCTION OF OR DAMAGE TO NONCONFORMING BUILDINGS:

A nonconforming building or structure which is damaged or partially destroyed by fire, flood, wind, earthquake or other calamity or act of God, or the public enemy, to the extent of not more than one and one-half (11/2) times its assessed value at the time, may be destroyed and the occupancy or use of such building, structure or part thereof, which existed at the time of such partial destruction, may be continued or resumed; provided, that such restoration is started within a period of one year and is diligently prosecuted to completion. In the event such damage or destruction exceeds one and one-half (11/2) times the assessed value of such nonconforming building or structure, no repairs or reconstruction shall be made except in the case of residences or accessory farm buildings, unless every portion of such building or structure is made to conform to all regulations for new buildings in the zone in which it is located.
