- LEGAL STATUS PROVISIONS

Sec. 106-291. - Conflict with other regulations.

(a)

Whenever the regulations of this chapter require a greater width or size of yards, courts, or other open spaces, or require a lower height of buildings or smaller number of stories, or require a greater percentage of the lot to be left unoccupied, or impose other more restrictive standards than are required in or under any other statutes, the regulations and requirements of this chapter shall govern.

(b)

Whenever the provisions of any other statutes require more restrictive standards than are required by this chapter, the provisions of such statute shall govern.

Sec. 106-292. - Severability.

The sections, paragraphs, sentences, clauses and phrases of this chapter are severable, and if any phrase, clause, sentence, paragraph or section of this chapter shall be declared unconstitutional, invalid or otherwise unenforceable by the valid judgment or decree of any court of competent jurisdiction, that unconstitutionality, invalidity or unenforceability shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this chapter, since they would have been enacted without the incorporation in this chapter of the unconstitutional, invalid or unenforceable phrase, clause, sentence, paragraph or section.
