TITLE, PURPOSE
INTERPRETATION AND APPLICATION
§ 154.001 TITLE.
A chapter regulating and restricting the height of buildings and other structures, the percentage of lot that may be occupied, the size of yards and other open spaces, the density of population and the location and use of buildings, structures and land for trade, industry, residence or other purposes creating districts and boundaries thereof; defining certain terms used herein; and providing for the administration, enforcement and amendment of this chapter in accordance with the provision of the State Municipalities Planning Code, being 53 P.S. §§ 10101 et seq., as amended.

§ 154.002 SHORT TITLE.
This chapter shall be known and may be cited as “The Borough of Topton Zoning Ordinance of 2015”.

§ 154.003 PURPOSE.
The purpose of this chapter is the promotion of the public health, safety, morals and general welfare of the residents and inhabitants of the borough by giving effect to the community development objectives of the borough, which are:
(A) Encourage the most appropriate use of land;
(B) Prevent the overcrowding of land;
(C) Conserve the value of land and buildings;
(D) Lessen the congestion of traffic on the roads and highways;
(E) Avoid undue congestion of the population;
(F) Provide for adequate light and air;
(G) Protect natural resources;
(H) Secure safety from fire, panic, flood and other dangers;
(I) Facilitate the adequate provision of transportation, water, sewerage, school and other public facilities;
(J) Encourage the harmonious and orderly development of land; and
(K) Give effect to the objectives, policies and purposes set forth in the joint comprehensive plan.

§ 154.004 INTERPRETATION.
In their interpretation and application, the provisions of this chapter shall be held to the minimum requirements adopted for the promotion of the public health, safety, morals and/or the general welfare of the residents and inhabitants of the borough.

§ 154.005 APPLICATION OF REGULATIONS.
Except as hereinafter provided, no building, structure, land or parts thereof shall be used or occupied, erected, constructed, assembled, moved, enlarged or structurally altered unless in conformity with the provisions of this chapter.

§ 154.006 LIMITED MUNICIPAL EXEMPTION.
The dimensional requirements of this chapter shall not apply to property, uses or structures owned by the borough and intended for a public recreation or public health and safety purpose.
