ESTABLISHMENT OF

ZONING DISTRICTS

§ 154.035 TYPES OF ZONING DISTRICTS.

   For the purpose of this chapter, the borough is hereby divided into the following districts:
   (A)   R-1 Suburban Residential District;
   (B)   R-2 Urban Residential District;
   (C)   R-2A Urban Residential District;
   (D)   R-3 Mixed Use;
   (E)   C-1 Commercial District;
   (F)   I-G Institutional-Government District;
   (G)   I-1 Industrial District;
   (H)   I-1A Industrial-Residential Overlay District;
   (I)   PO Parking Overlay District;
   (J)   RBO Riparian Buffer Overlay District; and
   (K)   WSO Weis Street Overlay District.

§ 154.036 OFFICIAL ZONING MAP.

   (A)   The boundaries of the zoning districts shall be as shown on the official zoning map of the borough, which shall be located in the Borough Hall. The official zoning map and all notations, references and data shown thereon are hereby incorporated by reference into this chapter.
   (B)   The official zoning map shall be so labeled and identified by the signature of the President of the Borough Council, attested by the Secretary of said Council, and bear the seal of the borough under the following words:
“This is to certify that this is the official zoning map of the Borough of Topton adopted July 13, 2015” to include the date of adoption.
   (C)   If an amendment is made to the official zoning map, an entry indicating the change made and the date of any change shall be made on the map and the entry shall include the signatures of the President and Secretary of the Borough Council.

§ 154.037 DISTRICT BOUNDARIES - RULES FOR INTERPRETATION.

   Where uncertainty exists as to the boundaries of districts as shown on the official zoning map, the following rules shall apply.
   (A)   Where district boundaries are indicated as approximately coinciding with the centerlines of streets, highways or alleys, such centerlines shall be construed to be such boundaries.
   (B)   Where district boundaries are indicated as approximately coinciding with plotted lot lines, such lot lines shall be construed to be such boundaries.
   (C)   Where district boundaries are indicated as being approximately parallel to the center or right-of- way lines of streets or highways, such district boundaries shall be construed as being parallel to the center or right-of-way lines and at such distances from the center or right-of-way lines as is indicated on the official zoning map. Distances not specifically indicated on the official zoning map shall be determined by the scale of map.
   (D)   Where district boundaries are indicated as being approximately perpendicular to the right-of-way lines of streets or highways, such district boundaries shall be construed as being perpendicular to the right-of-way lines.
   (E)   Boundaries indicated as approximately following borough limits shall be construed as following such limits.
   (F)   Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks.
   (G)   Boundaries indicated as parallel to or extensions of features indicated in divisions (A) through (F) above shall be so construed.
   (H)   Where physical or cultural features existing on the ground are at variance with those shown on the official zoning map, or in other circumstances not covered by divisions (A) through (G) above, the Zoning Hearing Board shall interpret the district boundaries.
   (I)   Where a district boundary line divides a lot which was in single ownership at the effective date of this chapter, at the election of the property owner the regulations of either zoning district may be extended a distance of not more than 30 feet beyond the district boundary line into the remaining portion of the lot.

§ 154.038 APPLICATION OF DISTRICT REGULATIONS.

   (A)   Except as hereafter provided in this chapter, no building, structure or land shall be used or occupied and no building, structure or part thereof shall be erected, constructed, reconstructed or structurally altered except in conformity with all the regulations specified within this chapter for the district in which the building, structure or land is located.
   (B)   No building, structure or land shall be used or occupied and no building, structure, or part thereof shall be erected, constructed, reconstructed or structurally altered without the issuance of a building permit and/or certificate of use and occupancy by the Zoning Officer.
   (C)   No part of a yard, other open space or off-street parking or loading space required in connection with one structure, building or use of the land shall be included as part of a yard, open space, or off-street parking or loading space similarly required for any other structure, building, or use of the land except as permitted or required by this chapter or other borough ordinance or regulations.
   (D)   No yard or lot existing at the time of passage of this chapter shall be reduced in dimension or area below the minimum requirements set forth in this chapter. Yards or lots created after the effective date of this chapter shall meet at least the minimum requirements established by this chapter.
   (E)   All territory which may hereafter be annexed to the borough shall be considered to be an R-1 District until otherwise classified.
