- EXCLUSIONS FROM APPLICABILITY
Except as herein provided, neither the provisions of section 4.4 or 4.6 of article 4 nor the provisions of article 6 of this ordinance shall be applicable to a special development approved in accordance with the subdivision regulations of the Town of Trent Woods, North Carolina; provided, however, that in no event shall a special development be approved after September 1, 2006, within any district which shall effect an increase in the number of units permitted within the special development above the number of units which would be permitted in such area by the minimum lot area requirements of such dimensional requirements were the area not developed as a special development. When calculating the minimum lot area requirements for the purpose of this article, waterways, floodways, wetlands, marshes, or submerged lands (whether natural or manmade) shall not be used in such calculation. All special developments existing in the town as of September 1, 2006, are deemed in conformance with the density requirements of the town's zoning ordinance regardless of the special development's density as of said date.
