CHAPTER 17

10 - DISTRICT REGULATIONS

17.10.010 - A, Agricultural District.

(a)

Purpose. The purpose of the A, Agricultural District is to provide areas for farms and closely-related agricultural uses. It is further intended to provide for residential uses on relatively large tracts of land which may accommodate farm-related accessory uses such as the breeding, raising and keeping of one (1) or more varieties of animals.

(b)

Permitted Uses. The A district is designed to allow considerable latitude in the range of agricultural uses allowed provided that the uses are legal and that certain agricultural activities maintain a reasonable setback from adjacent residentially-zoned property. Buildings or structures may be erected, altered or used, and land may be used for one (1) or more of the following:

A.

Agricultural Production—Crops (all uses within SIC Code 01).

B.

Agricultural Production—Livestock and Animal Specialties including only the following:

(1)

Beef Cattle (all uses within SIC Code 0211, except feedlots).

(2)

Hogs (all uses within SIC Code 0213, except feedlots).

(3)

Sheep and Goats (all uses within SIC Code 0214).

(4)

General Livestock (all uses within SIC Code 0219).

(5)

Dairy Farms (all uses within SIC Code 0241).

(6)

Poultry and Eggs (all uses within SIC Code 025).

(7)

Animal Specialties (all uses within SIC Code 027).

Agricultural Services (all uses within SIC Code 07).

Major Sports and Recreation Areas and Facilities.

Correctional Institutions.

F.

Airports and Airstrips.

G.

Major Public and Private Utilities, including water treatment plants, wastewater treatment plants, power generating facilities, transmission towers and similar uses.

H.

The following special uses may be permitted in specific situations in accordance with the procedures outlined in Section 17.06.130(3) and Chapter 17 of this Title, as appropriate:

(1)

Adult-Use Cannabis Craft Grower Organization.

(2)

Adult-Use Cannabis Cultivation Organization.

(3)

Adult-Use Cannabis Dispensing Organization.

(4)

Adult-Use Cannabis Infuser Organization.

(5)

Adult-Use Cannabis Processing Organization.

(6)

Adult-Use Cannabis Transporting Organization.

(e)

Regulation of Agricultural Activities.

A.

Livestock. No accessory building used or intended to be used to shelter livestock shall be erected closer than one hundred (100) feet to any residentially-zoned property. Fences shall be erected or other means shall be taken to prevent livestock from approaching any spot closer than one hundred (100) feet from any residentially-zoned property.

B.

Farm Equipment and Commodities. Agricultural equipment or commodities (including, but not limited to baled crops, fertilizer, pesticides and herbicides) shall not be stored outdoors closer than one hundred fifty (150) feet from any residentially-zoned property. Except, however, that such material may be stored in a building located not less than one hundred (100) feet from any residentially-zoned property.

(f)

Dimensional Regulations.

A.

Minimum Lot Size: One (1) acre.

B.

Minimum Lot Width: One hundred fifty (150) feet.

C.

Minimum Lot Depth: One hundred fifty-two (152) feet.

D.

Minimum Front Yard: Fifty (50) feet.

E.

Minimum Side Yard: Fifty (50) feet.

F.

Minimum Rear Yard: Fifty (50) feet.

G.

Maximum Building Height: Thirty-five (35) feet.

17.10.020 - RS, Single-Family Residential District.

(a)

Purpose. The purpose of the RS, Single-Family Residential District is to provide areas for low-density single-family residential uses of a suburban character. It is further intended to provide for other uses which are customarily found with and are not detrimental to single-family residences.

(b)

Permitted Uses. In the RS district, the following uses shall be permitted:

Foster Care Homes.

Institutional Uses.

Places of Worship.

Community Service Uses.

17.10.030 - RT, Two-Family Residential District.

(a)

Purpose. The purpose of the RT, Two-Family Residential District is to provide areas for single-family and two-family residential uses of an urban character. It is further intended to provide for other uses which are customarily found with and are not detrimental to single-family and two-family residences.

(b)

Permitted Uses. In the RT district, the following uses shall be permitted:

Single-Family Dwellings.

(2)

Duplexes.

(3)

Foster Care Homes.

(4)

Manufactured Homes.

B.

Institutional Uses.

Places of Worship.

(e)

Dimensional Regulations.

A.

Minimum Lot Size: Ten thousand (10,000) square feet for single-family residences; and twelve thousand (12,000) square feet for two-family residences.

B.

17.10.040 - RM, Multiple-Family Residential District.

(a)

Purpose. The purpose of the RM, Multiple-Family Residential District is to provide areas for multiple-family residential uses of moderate density. It is further intended to provide for other uses which are customarily found with and are not detrimental to multiple-family residences.

(b)

Permitted Uses. In the RM district, the following uses shall be permitted:

A.

Residential Uses.

Single-Family Dwellings.

(2)

Duplexes.

(3)

Multiple-Family Dwellings.

(4)

Foster Care Homes.

(5)

Manufactured Homes.

B.

Institutional Uses.

(1)

Places of Worship.

Assisted Living Center.

Community Service Uses.

(1)

Police Stations.

(2)

Fire Stations.

(3)

Cultural and Civic Facilities.

(e)

Site Plan Required. Site Plan approval by the Planning Commission shall be required for all proposed developments within the RM, Multiple-Family Residential District, except for single-family dwellings, as provided for in Section 17.16.020.

(f)

Dimensional Regulations.

A.

Minimum Lot Size: Ten thousand (10,000) square feet for single-family residences; twelve thousand (12,000) square feet for two-family residences; fourteen thousand (14,000) square feet for tri-plexes; sixteen thousand (16,000) square feet for four-plexes; and buildings for more than four (4) dwellings shall not exceed the maximum density per gross acre listed in this Section.

B.

Minimum Lot Width: Eighty (80) feet for single-family residences; one hundred (100) feet for two-family residences; and one hundred (100) feet for multiple-family residences.

C.

Minimum Front Yard: Twenty-five (25) feet.

D.

Minimum Side Yard: Six (6) feet.

E.

Minimum Rear Yard: Twenty-five (25) feet.

F.

Maximum Building Height: Thirty-five (35) feet.

G.

Maximum Density: Twenty (20) dwelling units per gross acre.

17.10.050 - RMH, Mobile Home Residential District.

(a)

Purpose. The purpose of the RMH, Mobile Home Residential District is to provide areas for mobile home residential development in appropriate areas of the City. It is further intended to provide for other uses which are customarily found with and are not detrimental to mobile homes.

(b)

Permitted Uses. In the RMH district, the following uses shall be permitted:

(2)

Foster Care Homes.

(3)

Manufactured Homes.

B.

Institutional Uses.

(1)

Places of Worship.

C.

Community Service Uses.

(1)

Police Stations.

(c)

Special Uses. The following uses may be allowed within the RMH district subject to the criteria established in Chapter 17.20.

Additional Regulations.

A.

All mobile homes moved into the City after the effective date of this title shall be constructed in compliance with specifications set forth by the National Fire Protection Association under the Association's Code of Specifications for Mobile Homes and Travel Trailers and all applicable State and Federal Regulations.

B.

No mobile home constructed prior to June 30, 1976, nor any mobile home not constructed in compliance with the Federal "National Manufactured Housing Construction and Safety Standards Act of 1974," nor any mobile home which is deemed by the Building Official to be a hazard to the public health or safety shall be moved into, erected or installed in the City.

C.

Each mobile home shall be anchored in a manner to meet or exceed the standards prescribed by the Federal Department of Housing and Urban Development.

D.

The minimum first floor elevation shall be at least eighteen (18) inches above the crown of the nearest street or road.

E.

The frame, axles, wheels, crawl space storage area and utility connection of all mobile homes shall be concealed from view through the use of durable all-weather materials manufactured specifically for the purpose of covering the undercarriage area. Such skirting shall be fastened in accordance with manufacturers instructions and shall provide for adequate ventilation.

F.

All mobile home spaces shall abut upon an all-weather surface driveway of not less than thirty-two (32) feet in width, in a minimum right-of-way of fifty (50) feet, which shall have unobstructed access to a city street.

G.

Mobile homes may only be placed in designated and approved mobile home subdivisions. Mobile homes may not be placed in any zoning district other than this RMH district.

(e)

Site Plan Required. Site Plan approval by the Planning Commission shall be required for all proposed developments within the RMH, Mobile Home Residential District as provided for in Section 17.16.020.

(f)

Dimensional Regulations.

A.

Minimum Lot or Space Size: Five thousand (5,000) square feet.

B.

Minimum Lot or Space Width: Fifty (50) feet.

C.

Minimum Front Yard: Twenty-five (25) feet.

D.

Minimum Side Yard: Twenty (20) feet.

E.

Minimum Rear Yard: Twenty (20) feet.

F.

Minimum Set Back from Park Property Line: Twenty-five (25) feet.

G.

Maximum Lot or Space Coverage: Forty (40) percent.

H.

Maximum Building Height: Thirty-five (35) feet.

17.10.060 - MED, Medical District.

(a)

Purpose. The purpose of the MED, Medical District is to provide areas of medical and health-related services at accessible locations in the City. It is further intended to provide for other uses which are customarily found with and are not detrimental to these types of services.

(b)

Permitted Uses. The MED district is designed to accommodate a broad range of health-related services, including institutional, office and related uses in appropriate areas of the City. Buildings or structure may be erected, altered or used for one (1) or more of the following:

A.

Institutional Uses.

(1)

Places of Worship.

(2)

Child Care Centers (all uses within SIC Code 835).

B.

Community Service Uses.

(1)

Police Protection (all uses within SIC Code 9221).

(2)

Fire Protection (all uses within SIC Code 9224).

(3)

Emergency Medical Service Stations.

(4)

Cultural and Civic Facilities.

(5)

Educational Facilities (all uses within SIC Code 82).

(6)

Governmental Administration Buildings (all uses within SIC Code 91).

(e)

Site Plan Required. Site Plan approval by the Planning Commission shall be required for all proposed developments within the MED, Medical District as provided for in Section 17.16.020.

Dimensional Regulations.

A.

Minimum Lot Size: Twenty thousand (20,000) square feet.

B.

Minimum Lot Width: One hundred (100) feet.

C.

Minimum Front Yard: Thirty (30) feet.

D.

Minimum Side Yard: Twenty (20) feet.

E.

Minimum Rear Yard: Thirty (30) feet.

F.

Maximum Lot Coverage: Seventy (70) percent.

G.

Maximum Building Height: Sixty (60) feet or five (5) stories.

17.10.070 - CD, Downtown Commercial District

(a)

Purpose. The purpose of the CD, Downtown Commercial District is to provide a wide range of commercial activities at an accessible location in the City. The CD district may also include some activities which might otherwise be located in a light industrial area, but have remained in the downtown area over time. In addition to the services that are permitted uses, other service and retail uses which would not normally be appropriate in the CD district may be allowed as special uses with conditions specified by the City Council to safeguard the public health, safety, morals and welfare.

(b)

Permitted Uses. The CD district is designed to allow a wide range of retail and service uses provided that the uses are legal and no outdoor storage is conducted except as otherwise provided herein. Any building used primarily for storage or incidental assembly of products sold on the premises. Buildings or structures may be erected, altered or used for one (1) or more of the following:

A.

Multiple-Family Dwellings located only on the second floor or above.

B.

Transportation and Communication Uses including only the following:

(1)

U.S. Postal Service (all uses within SIC Code 43).

C.

Building Materials, Hardware and Garden Supply including only the following:

(1)

17.10.080 - CG, General Commercial District.

(a)

Purpose. The purpose of the CG, General Commercial District is to provide areas for the development of general retail sales and selected service activities at accessible locations in the City. The CG district is not intended to allow industrial uses. In addition to the selected services that are permitted uses, other service and retail uses which would not normally be appropriate in the CG district may be allowed as special uses with conditions specified by the City Council to safeguard the public health, safety, morals and welfare.

(b)

17.10.100 - IG, General Industrial District.

(a)

Purpose. The purposed of the IG, General Industrial District is to provide areas for general industrial uses. The IG district is further intended to ensure high quality future development through the use of site plan approval procedures which provide for specific consideration of access, parking, drainage, landscaping and design factors. In addition to the permitted uses, other uses which would not normally be appropriate in the IG district may be allowed as special uses with conditions specified by the City Council to safeguard the public health, safety, morals and welfare.

(b)

Permitted Uses. The IG district is designed to allow considerable latitude in the range of general industrial uses allowed. Buildings or structures may be erected altered or used for one (1) or more of the following:

A.

Any use permitted in the IL, Light Industrial District.

B.

Manufacturing Uses including only the following:

(1)

Food and Kindred Products (all uses within SIC Code 20).

(2)

Tobacco Products (all uses within SIC Code 21).

(3)

Lumber and Wood Products (all uses within SIC Code 24).

(4)

Structural Clay Products (all uses within SIC Code 325).

(5)

Cut Stone and Stone Products (all uses within SIC Code 328).

(6)

Abrasive, Asbestos, and Miscellaneous Nonmetallic Mineral Products (all uses within SIC Code 329).

(7)

Transportation Equipment (all uses within SIC Code 37).

C.

Transportation and Communication Uses including only the following:

(1)

Railroad Transportation (all uses within SIC Code 40).

(2)

Transportation by Air (all uses within SIC Code 45).

D.

Electric, Gas and Sanitary Services (all uses within SIC Code 49).

E.

Wholesale Trade—Durable Goods (all uses within SIC Code 50).

F.

Wholesale Trade—Nondurable Goods (all uses within SIC Code 51).

(c)

Accessory Uses and Structures. Uses and structures customarily accessory to a permitted use may be allowed. Except for limited quarters for night watchmen, no structure shall be used for residential purposes.

(d)

Special Uses. The following uses may be allowed within the IG district subject to the criteria established in Chapter 17.20.

A.

Communication Towers based on the criteria in Section 17.20.040 and 17.20.050.

B.

Utilities including only the following:

(1)

Water Supply Storage (all uses within SIC Code 4941).

(2)

Sewage Treatment Plants (all uses within SIC Code 4952), as an accessory use only.

C.

Manufacturing Uses including only the following:

(1)

Chemicals and Allied Products (all uses within SIC Code 28).

(2)

Petroleum Refining and Related Industries (all uses within SIC Code 29).

(3)

Cement, Hydraulic (all uses within SIC Code 324).

(4)

Concrete, Gypsum and Plaster Products (all uses within SIC Code 327).

(5)

Primary Metal Industries (all uses within SIC Code 33).

(6)

Ordinance and Accessories (all uses within SIC Code 348).

D.

The following special uses may be permitted in specific situations in accordance with the procedures outlined in Section 17.06.130(3) and Chapter 17 of this Title, as appropriate:

1.

Adult-Use Cannabis Craft Grower Organization.

2.

Adult-Use Cannabis Cultivation Organization.

3.

Adult-Use Cannabis Dispensing Organization.

4.

Adult-Use Cannabis Infuser Organization.

5.

Adult-Use Cannabis Processing Organization.

6.

Adult-Use Cannabis Transporting Organization.

(e)

Site Plan Required. Site Plan approval by the Planning Commission shall be required for all proposed developments within the IG, General Industrial district as provided for in Section 17.16.020.

(f)

Dimensional Regulations.

A.

Minimum Size Lot: One (1) acre.

B.

Minimum Lot Width: One hundred (100) feet.

C.

Minimum Front Yard: Fifty (50) feet.

D.

Minimum Side Yard: Twenty (20) feet, unless the side of the lot abuts land zoned residential in which case there shall be a side yard of at least fifty (50) feet.

E.

Minimum Rear Yard: Twenty (20) feet, unless the rear of the lot abuts land zoned residential in which case there shall be a rear yard of at least fifty (50) feet.

F.

Maximum Building Coverage: Fifty (50) percent.

G.

Maximum Building Height: Sixty (60) feet.
