RESIDENTIAL DISTRICTS


Editor's note— Ord. No. 415, § 1, adopted May 22, 2017, repealed the former art. IX, §§ 109-290—109-294, and enacted a new art. IX as set out herein. The former art. Sec 24-1 Low Density Residential (R-1) District

  1. Purpose and scope. To recognize relatively low density, single-family residential areas that have been developed primarily after 1950, together with supporting public and semi-public facilities, and to protect the low intensity living environment from encroachment by potential conflicting uses.
  2. Jurisdiction. The following shall be applicable to property designated as R-1 within the city as defined by the official zoning map.
  3. Principal use. The following uses and structures listed in this section are permitted as the principal use in the R-1 district:
    1. Single-family dwellings.
    2. State licensed residential group home serving six or fewer persons.
    3. Municipal facilities and city parks.
    4. Places of worship and assembly including cemeteries and memorial gardens.
    5. Utility services.
    6. Elementary, parochial, junior and senior high schools.
    7. Nursing homes, retirement communities, residential care facilities.
    8. Day care center with adherence to the Minnesota Department of Human Services, Minnesota Rules and Minnesota State Statutes.
    9. Golf courses, country clubs, club houses, swimming pools, tennis courts and similar private recreational business or association uses of at least one-half acre in size.
  4. Permitted accessory use. The following uses are permitted as an accessory to the principal use in the R-1 district provided they are subordinate to and associated with the permitted principal use:
    1. One private detached garage per separately owned parcel, not to exceed 900 square feet.
    2. Accessory storage shed for domestic supplies, not to exceed 900 square feet.
    3. Greenhouses not to exceed 900 square feet and not involving retail or wholesale sales.
    4. Privately owned recreational facilities such as swimming pools, sport courts and tennis courts.
    5. Home occupations in adherence with this Code.
    6. Temporary buildings located entirely on private property for uses incidental to construction work to be removed upon the completion or abandonment of the construction work.
    7. Solar collectors mounted on the ground in the rear yard or attached to the principal building facing the front, side or rear yard at a height no greater than the peak of the roof of the principal structure and in accordance with the building code.
    8. Docks as regulated in Chapter 28 Waterways.
    9. Patio and detached decks
  5. Conditional uses. The following uses require a conditional use permit:
    1. Commercial use antenna towers upon existing city-owned buildings or structures as referenced in this zoning code.
    2. Accessory dwelling units.

Sec 24-2 Old Town Residential (R-1A) District

  1. Purpose and scope. To recognize relatively low density, single-family residential areas that have been developed primarily before 1975, together with supporting public and semi-public facilities, and to protect the low intensity living environment from encroachment by potential conflicting uses.
  2. Jurisdiction. The following shall be applicable to property designated as R-1A within the city as defined by the official zoning map.
  3. Principal use. The following uses and structures listed in this section are permitted as the principal use in the R-1A district:
    1. Single-family dwellings.
    2. Twin homes.
    3. Duplexes.
    4. State licensed residential group home serving six or fewer persons.
    5. Municipal facilities and city parks.
    6. Places of worship and assembly including cemeteries and memorial gardens.
    7. Utility services.
  4. Garages and accessory structures. The following standards shall apply to all garages and accessory structures for single-family homes and duplexes in all zoning districts, and shall be in addition to the standards in the shoreland management overlay district of this section.
    1. No garage, whether attached or detached, nor any accessory structure shall be taller than the principal structure on the same parcel.
    2. An accessory building shall not be located in any required front yard setback.
    3. The total footprint of all garage space, whether attached or detached, and of all accessory structure space shall be no larger than the footprint of the principal structure, and shall total a maximum footprint of 900 square feet.
    4. Metal covered storage and pole buildings are prohibited.
    5. Properties shall be permitted no more than one attached garage and one detached accessory structure or shall be permitted no more than two accessory structures per parcel.
    6. All accessory structures of any size shall be constructed of durable, finished materials and shall be compatible in color to the principal structure. All accessory structures 200 square feet or greater in area shall be compatible with the principal structure in terms of design, roof style, roof pitch, and color.
    7. If an accessory building is attached to the main building, it shall be made structurally a part of the main building and shall comply in all respects with the requirements of this chapter applicable to the main building. An accessory building, unless attached to and made a part of the main building, shall not be closer than five feet to the principal building.
    8. Garage doors shall be no greater than 10 feet in height measured from the grade to the top of the opening.
    9. No land shall be subdivided so as to have an accessory structure without a primary structure, or to have a larger building or structure than permitted by this section. When a property is developed or redeveloped and an existing accessory structure made nonconforming, the structure must be brought into conformance or removed from the property.
    10. No accessory building shall at any time be used as a habitable building nor can an accessory structure in a residential district be used at any time for a commercial or industrial use, except for accessory dwelling units.
    11. Intermodal container or shipping containers are prohibited from being placed on a property for more than 72 hours.
  5. Conditional uses. The following uses require a conditional use permit:
    1. Accessory dwelling units. The following standards shall apply to all accessory dwelling units:
      1. Attached accessory dwelling units shall be counted as part of the principal structure to include measurement of the footprint and must comply with all applicable setbacks of the principal structure.
      2. Detached accessory dwelling units shall meet the required setbacks as required for accessory structures.
      3. Detached accessory dwelling units footprint shall count towards the maximum accessory structure footprint.
      4. Off street parking requirements shall be increased by one parking space to accommodate the accessory dwelling unit.
    2. Day care facilities. The following standards shall apply to all day care facilities:
      1. Play equipment shall only be constructed in the rear yard and shall not encroach on any easement.
      2. Parking shall be prohibited on a public right-of-way for employees.
  6. All residential units proposed for construction on existing vacant lots or lots that become vacant by reason of demolition or destruction of existing structures within the R-1A District shall be reviewed according to the following process and standards:
    1. Building design standards.
      1. Relationship to adjacent buildings. All new buildings proposed on existing vacant lots that become vacant through demolition shall relate to the design of adjacent traditional buildings in scale, size, proportions and character. This can be achieved by maintaining similar setbacks, facade divisions and proportions, porch elements, roof form and lines, rhythms and proportions of openings, building materials, details and colors. Historic architectural styles need not be replicated.
      2. A primary entrance shall face an improved abutting street or be located off of a front porch, foyer, and courtyard or similar architectural feature.
      3. For principal structures, above-grade window and door openings shall comprise at least 15 percent of the total area of exterior walls facing a public street or sidewalk. In addition, above grade window and door openings shall comprise at least ten percent of the total area of all exterior walls. Windows in garage doors shall count as openings; the area of garage doors themselves shall not count as openings. Windows shall be clear or translucent.
      4. Building materials and architectural treatments used on sides of buildings facing an abutting public street and on accessory structures should be similar to those used on principal facades.
      5. The design and siting of the building should seek to preserve existing trees on the site and immediately adjacent lots. The landscape design should consider permeable materials for paths and driveways to protect existing mature trees in sensitive areas.

Sec 24-3 Two-Family Residential (R-2) District

  1. Purpose and scope. The R-2 district is established to provide for two-family detached housing, including supporting public and semi-public facilities. To provide lots which can accommodate a house, garage and deck without variance requests. To assure that areas will not be developed too intensely and that a variety of housing styles will be encouraged, providing flexibility and preventing sameness and monotony of housing styles. Preservation of natural landforms, open space, and greenways will be encouraged for scenic enjoyment and recreational use.
  2. Jurisdiction. The following shall be applicable to property designated as R-2 within the city as defined by the official zoning map.
  3. Principal uses. The following uses and structures listed in this section are permitted as the principal use in the R-2 district:
    1. Single-family dwellings for subdivisions approved prior to June 10 , 2019.
    2. Two-family dwellings.
    3. State licensed residential group home serving six or fewer persons.
    4. Municipal facilities.
    5. Places of worship and assembly including cemeteries and memorial gardens.
    6. Utility services.
    7. Elementary, parochial, junior and senior high schools.
    8. Nursing homes, retirement communities, residential care facilities.
    9. Day care center with adherence to the Minnesota Department of Human Services, Minnesota Rules and Minnesota State Statutes.
    10. Golf courses, country clubs, club houses, swimming pools, tennis courts and similar private recreational business or association uses of at least 0.32 acres in size.
  4. Permitted accessory use. The following uses are permitted as an accessory to the principal use in the R-2 district provided they are subordinate to and associated with a permitted use:
    1. One private detached garage per separately owned parcel not to exceed 600 square feet.
    2. Accessory storage shed for domestic supplies not to exceed 600 square feet.
    3. Greenhouses not to exceed 600 square feet and not involving retail or wholesale sales.
    4. Privately owned recreational facilities such as swimming pools and tennis courts.

Sec 24-4 Multi-Family Residential (R-3) District

  1. Purpose and scope. The R-3 district is established to provide for townhomes, rowhomes, and small apartment buildings or condominium complexes where similar residential development seems likely to occur to meet guided density of four to ten units per acre.
  2. Jurisdiction. The following shall be applicable to property designated as R-3 within the city as defined by the official zoning map.
  3. Principal use. The following uses and structures listed in this section are permitted as the principal use in the R-3 district:
    1. Townhomes.
    2. Semi-detached homes.
    3. Multi-family dwellings.
    4. Municipal facilities.
    5. Utility services.
    6. Places of worship and assembly including cemeteries and memorial gardens.
  4. Permitted accessory use. The following uses are permitted as an accessory to the principal use in the R-3 district provided they are subordinate to and associated with the permitted use:
    1. Detached garages in a common building.
    2. Swimming pools, tennis courts, and similar recreational facilities provided they are developed for joint use by members of the homeowners' association or similar organizations.
    3. Storage buildings for common use of members of the homeowners' association or similar organization or for use by the maintenance staff for storage.
    4. Home occupations in adherence with this Code.
    5. Day care centers with adherence to the Minnesota Department of Human Services, Minnesota Rules and Minnesota State Statutes.
    6. Solar collectors mounted on the ground in the rear yard or attached to the principal building facing the front, side or rear yard at a height no greater than the peak of the roof of the principal structure and in accordance with the building code.
    7. Docks as regulated in Chapter 28 Waterways.
    8. Patios and detached decks

Sec 24-5 High Density Residential (R-4) District

  1. Purpose and scope. The R-4 district is established to provide for townhomes, rowhomes, and apartments or condominium where similar residential development seems likely to occur to meet guided density of ten to 24 units per acre.
  2. Jurisdiction. The following shall be applicable to property designated as R-4 within the city as defined by the official zoning map.
  3. Principal use. The following uses and structures listed in this section are permitted as the principal use in the R-4 district:
    1. Townhomes or rowhomes.
    2. Multiple family dwelling units.
    3. Municipal facilities.
    4. Utility services.
    5. Places of worship and assembly including cemeteries and memorial gardens.
  4. Permitted accessory use. The following uses are permitted as an accessory to the principal use in the R-4 district provided they are subordinate to and associated with a permitted use:
    1. Detached garages, provided they are located in a common space.
    2. Swimming pools, tennis courts, and similar recreational facilities provided they are developed for joint use by members of the homeowners' association or similar organization.
    3. Storage buildings designed for common use by members of the homeowners' association or similar organization or for maintenance staff for storage associated with normal upkeep of the property.
    4. Day care centers with adherence to the Minnesota Department of Human Services, Minnesota Rules and Minnesota State Statutes.
    5. Home occupations in adherence with this Code.
    6. Solar collectors mounted on the ground in the rear yard or attached to the principal building facing the front, side or rear yard at a height no greater than the peak of the roof of the principal structure and in accordance with the building code.

Sec 24-6 Lake Minnetonka Residential District (LMR)

  1. Purpose and scope. The purpose of the LMR Lake Minnetonka residential district is to reserve appropriately located areas for low density single-family living in order to restrict crowding in an already overcrowded shoreland area; to minimize traffic congestion in an already hazardous traffic area and to avoid the overloading of utilities by preventing the construction of buildings of excessive size and density in relation to the land around them; and to protect residential properties from noise, illumination, unsightliness, odors, dust, dirt, smoke, vibration, heat, glare and other objectionable influences.
  2. Jurisdiction. The following shall be reserved for property which comprises that area lying between T.H.7, Smithtown Road and Lake Minnetonka and designated as LMR within the city as defined by the official zoning map.
  3. Principal use. The following uses and structures listed in this section are permitted as the principal use in the LMR district provided they are subordinate and associated with a permitted use:
    1. Single-family dwellings.
    2. State licensed residential facility serving six or fewer persons.
    3. Places of worship and assembly.
    4. Municipal facilities.
    5. Utility services.
  4. Permitted accessory use. The following uses are permitted as an accessory to the principal use in the LMR district:
    1. One private detached garage per separately owned parcel.
    2. Accessory storage shed for domestic supplies.
    3. Greenhouses not to exceed 240 square feet and not involving retail or wholesale sales.
    4. Privately owned recreational facilities such as swimming pools and tennis courts.
    5. Day care center with adherence to the Minnesota Department of Human Services, Minnesota Rules and Minnesota State Statutes.
    6. Patios and detached decks
  5. Conditional uses. The following uses require a conditional use permit:
    1. Conditional uses as permitted and limited in the LMR district.
    2. Boat docks extending from a separate tract of land not occupied by a principal dwelling under the following conditions:
      1. The separate tract is part of a subdivision plat existing prior to the establishment of this zoning district.
      2. The separate tract is the common property of the owners of other lots within the subdivision or is owned by a homeowners' association of such owners.
      3. The council may allow one dock to be designated as a swimming dock for the use of all residents of the subdivision but no boat storage shall be permitted at the permitted dock.
      4. One dock is permitted per 100 feet of shoreline but each property shall not have more than one dock.
      5. In subdivisions where multiple docks were in existence prior to the establishment of this zoning district, and the homeowners' association regulations allow for a greater number of docks than those permitted by this section, the conditional use shall allow the number so specified.
    3. Home occupations in adherence with this Code.
