§ 155.250 GENERAL REGULATIONS FOR SHIPPING CONTAINER STORAGE UNITS.

   (A)   Shipping containers may be used for permanent or temporary storage purposes only, however special use permit (permanent) or temporary use permit (temporary) must be requested by owner and first granted by the city.
   (B)   Accessory buildings may not be used as dwelling units or for sleeping purposes.
   (C)   As indicated in § 10-10-1 of this ordinance, a zoning permit is required for the installation of a shipping container.
   (D)   Shipping containers shall be single unit height with no stacking allowed.
   (E)   Shipping containers shall not store materials that could be injurious or harmful to people, property or the city.
   (F)   Insurance for shipping container storage units shall be obtained by property owner.

§ 155.251 PERMANENT USE.

   (A)   Shipping containers may be used for permanent use, only within general commercial, manufacturing or industrial districts.
   (B)   Special use permit shall be requested for by owner and approved by city for permanent uses.
   (C)   Limit of 2 storage units per lot.
   (D)   Must be located on paved or aggregate surface location. Not intended for yard or non- accessible locations.

§ 155.252 TEMPORARY USE.

   (A)   Shipping containers may be used for temporary use, on any of the commercial, residential, or industrial districts.
   (B)   Temporary use permit shall be requested for by owner and approved by Zoning Administrator for temporary uses.
   (C)   Limit of 1 temporary storage unit per lot.
   (D)   Must be located on paved or aggregate surface location. Not intended for yard or non- accessible locations. Can only be placed on city right-of-way, streets or parking spots with prior approval from Zoning Administrator. Temporary shipping container location must not interfere with traffic, parking, pedestrian or ADA access.
   (E)   Permit applicant must specify use of temporary storage unit in request.
   (F)   Temporary use shall be limited to and permitted for up to 30 days.
   (G)   Temporary use permit must be displayed on a visible side of the shipping container, through the duration of the temporary use.

§ 155.999 PENALTY.

   (A)   Any person, firm or corporation who violates, disobeys, omits, neglects, or refuses to comply with, or who resists the enforcement of any of the provisions of the Zoning Code shall, upon conviction, be fined not less than $100 nor more than $750 for each offense. Each day that a violation shall exist shall constitute a separate offense.
   (B)   In case any building or structure is erected, constructed, reconstructed, altered, repaired, converted, or maintained, or any building, structure or land is used in violation of the Zoning Code, the Building Inspector, in addition to other remedies, may institute any proper action or proceedings in the name of the city to prevent the unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance, or use, to restrain, correct or abate the violation, to prevent the occupancy of the building, structure or land, or to prevent any illegal act, conduct, business or use in or about the premises.
