It shall be the duty of the code enforcement officer to enforce this chapter. It shall also be the duty of all officers and employees of the Vivian Board of Aldermen to assist the code enforcement officer by reporting to him new construction, alterations, relocations, repairs, or land uses, or upon seeing alleged violations. Appeal from the decision of the code enforcement officer may be made to the board of zoning adjustment as provided in Article VIII of this chapter.

No building or structure shall be erected, altered, repaired, or relocated until a permit therefore has been issued by the code enforcement officer. The application for and issuance of such permits shall be in accordance with the requirements of the building code, except that no permit shall be issued until application for a certificate of zoning compliance has been made and approved.

No change in the use or occupancy of land or of an existing building shall be made, nor shall any new building nor an accessory building be used or changed in use until a certificate of zoning compliance shall have been issued by the code enforcement officer stating that the proposed use of the building or land complies with the provisions of this chapter. The issuance of such a certificate shall be in accordance with the following procedure:
(1)
Applications for a certificate of zoning compliance by property owner shall be made coincident with the application for a building permit. After determining that the proposed erection, alteration, repair, relocation, or change in use is in compliance with the provisions of this chapter, each such application shall be approved by the code enforcement officer and shall be countersigned by the chairman of the planning and zoning commission.
(2)
All applications for a certificate of zoning compliance shall be accompanied by three (3) copies of a layout or plot plan drawn to scale, showing the actual dimensions of the lot to be built upon, the size, height, and location of the building or buildings to be erected, converted, enlarged, reconstructed, structurally altered, or relocated, the size and location of any buildings on the lot, and such other information as may be necessary to provide for the enforcement of these regulations. All required parking areas and access driveways must be shown and the individual car stalls clearly indicated. A careful record of such applications and plats shall be kept in the office of the code enforcement officer.
(3)
When making application for a certificate of zoning compliance, the following investigation and compliance fees shall be paid:
a.
Accessory buildings, home occupations, and signs .....$25.00
b.
Dwellings, semi-public buildings, and business, commercial or industrial uses not involving erection, alteration, repair, or relocation .....$25.00
c.
Business, commercial, or industrial uses involving erection, alteration, repair, or relocation .....$25.00
d.
Manufactured home variance .....$90.00
(4)
A final certificate of zoning compliance shall be issued by the code enforcement officer within ten (10) days after the completed work shall have been inspected and approved as complying with the provisions of this chapter.
(5)
The code enforcement officer shall maintain a record of all certificates and copies shall be furnished, upon payment of one dollar ($1.00) each, to any person having a proprietary or tenancy interest in the building or land affected.
(6)
Any request for a zoning change, amendment, and/or variance or other change that requires that property owners be notified of such change, amendment, and/or variance within three hundred (300) feet, then it shall be the applicant's obligation to obtain certified copy of all property owners, including their names and addresses, within three hundred (300) feet. This certified copy must be obtained either from the North Louisiana Council of Government (NLCOG) located at 625 Texas St., Suite 200, Shreveport, Louisiana 71101. This expense shall be paid for and obtained by the applicant.
