ZONE DISTRICTS AND MAPS

Sec. 10-28.- Zone districts.

a.

In determining the boundaries of districts, and establishing the provisions applicable to each district, due and careful consideration has been given to existing conditions, the character of buildings erected in each district, the most desirable use for which the land in each district may be adapted and the territory within the jurisdiction of the commission.

b.

Territory which may hereafter be annexed to the city may be rezoned at the time of annexation.

c.

The territory within the jurisdiction of the commission is classified into eleven (11) districts as follows:

Sec. 10-29. - Zone map.

a.

The zone map, which accompanies and is declared to be a part of this ordinance, shows the boundaries of the area covered by the districts. Notations, references, indications and other matters shown on the zone map are as much a part of this ordinance as if they were fully described herein.

b.

The zone map incorporated by reference in General Ordinance No. 1, 1995, as amended, passed by the Common Council of the City of Wabash, Wabash County, Indiana, on the 24th day of April, 1995 at article 2, section 2.1 Wabash City Code, section 10-29a, is amended to change the zoning from general business to light industry for all of that portion of the property owned by the County of Wabash, Indiana and commonly known as the former Wabash County farm lying west of the Conrail railroad tracks, east of Indiana Highway 13, south of United States Highway 24 and north of the southern boundary of said property, all as shown by the attached map which is incorporated by reference herein, made a part hereof and marked as exhibit "A". Said exhibit A is on file in the office of the clerk-treasurer, and available for public inspection during regular business hours.

c.

The zone map incorporated by reference in General Ordinance No. 1, 1995, as amended, passed by the Common Council of the City of Wabash, Wabash County, Indiana, on the 24th day of April, 1995 at article 2, section 2.1 (Wabash City Code, section 10-29) is amended to provide zone classifications for annexed portions of the City of Wabash and the increased jurisdictional territory of the Wabash City Plan Commission, all as shown by the attached map which is incorporated by reference herein, made a part hereof and marked as exhibit "A". Said exhibit A is on file in the office of the clerk-treasurer, and available for public inspection during regular business hours.

d.

The zone map incorporated by reference in General Ordinance No. 1, 1995, as amended, passed by the Common Council of the City of Wabash, Wabash County, Indiana, on the 24th day of April, 1995 at article 2, section 2.1 (Wabash City Code, section 10-29) is hereby amended to provide that the following described area shall be changed from zoning as heavy industrial to suburban (S-1):

Part of the Fractional Southwest Quarter of Township 28 N. Range 7 E. Section 31 more commonly known as 343 East U.S. 24 and shown as plat number -026 in the plat book for Lagro Township in the office of the Auditor of Wabash County, Indiana and as further shown in yellow on the map attached hereto.

The zone map incorporated by reference in General Ordinance No. 1, 1995, as amended, passed by the Common Council of the City of Wabash, Wabash County, Indiana, on the 24th day of April, 1995 at article 2, section 2.1 (Wabash City Code, section 10-29) is hereby amended to provide that a certain area along the south side of U.S. Highway 24 East proceeding west from Wabash County Road 100 East approximately 3,500 shall be changed from zoning as heavy industrial (H.I.) to suburban (S-1) residential all more particularly described as shown by the attached map, which is incorporated by reference herein, made a part hereof, and marked as exhibit A:

The zone map incorporated by reference in General Ordinance No. 1, 1995, as amended, passed by the Common Council of the City of Wabash, Wabash County, Indiana, on the 24th day of April, 1995 at article 2, section 2.1 (Wabash City Code, section 10-29) is hereby amended to change the zoning from residence 2 to general business for lots 4, 5 and 6 in Mader's Addition, commonly known as 250, 260 and 270 Stitt Street, all as shown by the attached map which is incorporated by reference herein, made a part hereof and marked exhibit A.

g.

The zone map incorporated by reference in General Ordinance No. 1, 1995, as amended, passed by the Common Council of the City of Wabash, Wabash County, Indiana, on the 24th day of April, 1995 at article 2, section 2.1 (Wabash City Code, section 10-29) is hereby amended to provide zoning for that part of the jurisdictional area outside the corporate limits of the City of Wabash that was recently added as a result of the passage of resolution number 3, 1999 of the Wabash City Plan Commission on the 7th day of July, 1999 and to make changes to several other areas within the jurisdiction of the Wabash City Plan Commission as shown by the areas highlighted in yellow on the attached map.

The zone map incorporated by reference in General Ordinance No. 1, 1995, as amended, passed by the Common Council of the City of Wabash, Wabash County, Indiana, on the 24th day of April, 1995 at article 2, section 2.1 (Wabash City Code, section 10-29) is hereby amended to rezone the following described real estate located in Wabash County, Indiana, to-wit:

A part of Lot No. One (1) in David Coble and Simpson B. Jones' Subdivision of Lot Number One (1) of the Original Plat of the Town of South Wabash, (now a part of the City of Wabash, in said county and state), bounded and described as follows:

Beginning on the west line of Vernon Street, at a point located ninety-one (91) feet south of the south line of Columbus Street, thence running south on said west line of Vernon Street, twenty (20) feet; thence west on a line parallel with the south line of Columbus Street, seventy (70) feet; thence north parallel with the west line of Vernon Street; twenty (20) feet; thence east parallel with the south line of Columbus Street, and the north line of said Lot No. One (1) to the west line of Vernon Street (being the place of beginning) and the point of beginning in Wabash County, Indiana.

i.

The zone map incorporated by reference in General Ordinance No. 1, 1995, as amended, passed by the Common Council of the City of Wabash, Wabash County, Indiana, on the 24th day of April, 1995 at article 2, section 2.1 (Wabash City Code, section 10-29) is hereby amended to change the zoning from light industry to agricultural for the real estate described on Exhibit A attached hereto and made a part hereof.

EXHIBIT A

Being a part of the Northeast Quarter of Section Thirty-six (36), Township Twenty-eight (28) North, Range Six (6) East in Noble Township, Wabash County, State of Indiana, and further described as follows:

Commencing at a section corner monument found at the northwest corner of the aforesaid Northeast Quarter, thence North 90°00'00" East (assumed bearing) on the north line of said quarter section a distance of one thousand three hundred nineteen and no hundredths (1319.00) feet to a spike set and being the place of beginning: Thence continuing North 90°00'00" East on said north line and centerline of County Road 100 North a distance of three hundred seventeen and fifty-seven hundredths (317.57) feet to a spike set; thence South 00°02'34" West on an existing fence line a distance of seven hundred ninety-three and no hundredths (793.00) feet to an angle iron post; thence South 89°26'49" East a distance of five hundred twenty-two and no hundredths (522.0) feet to an iron rod set; thence South 00°56'48" West a distance of three hundred thirty-three and thirty-eight hundredths (333.38) feet to an iron rod found on the westerly line of State Road Number Thirteen (13); thence South 41°44'20" West on said westerly line a distance of one thousand two hundred fifty-five and three hundredths (1255.03) feet to a bolt set over the remains of an iron post found in concrete; thence North 00°03'27" East a distance of two thousand sixty-seven and eight-six hundredths (2067.86) feet or the place of beginning: Containing twenty-one and twenty-three hundredths (21.23) acres more or less and being subject to existing highway drainage and public utility easements.

The Common Council of the City of Wabash, Indiana pursuant to Indiana Code § 36-7-4-608 amends the zoning map incorporated by reference in General Ordinance No. 1, 1995, as amended, passed by the Common Council of the City of Wabash, Wabash County, Indiana on the 24 th day of April, 1995, at Article 2, Section 2.1 (Wabash City Code, Section 10-29) as follows:

A.

To reclassify from a residential 2 district to a general business district the property described as follows, and shown outlined on the map attached hereto, incorporated herein, and marked as Exhibit "A":

TRACT 1. Part of Out Lot Number One (1) in Tyer's Addition to Wabash, bounded and described as follows, viz:

Commencing at a point in the West line of said Out Lot (and the east line of Cass Street) which is distant ninety (90) feet Southeasterly from the north west corner of said Out Lot; thence running east on a line parallel with the north line of said Out Lot (and the south line of Stitt Street) to a point distant one hundred twenty (120) feet west of the east line of said Out Lot; thence south on said line to a point which is distant thirty-six (36) feet and six-tenths of a foot north and one hundred twenty (120) feet west of the south east corner of said Out Lot, forty-five (45) feet north westerly along said west line, (and the east line of Cass Street) to the place of beginning, in Wabash County, Indiana.

TRACT 2. Part of Outlot Number One (1) in Tyer's Addition to the City of Wabash, bounded and described as follows, to wit:

Beginning at the north west corner of said out lot; thence easterly along the north line of said out lot and the south line of an alley one hundred and seventy-five (175) feet; thence in a southerly direction thirty (30) feet; thence south eighty-one (81) degrees, forty-three (43) minutes west seventy-six and five tenths (76.5) feet; thence south seventy-three (73) degrees, forty-three (43) minutes west sixty-seven and seventy-five hundredths (68.75) feet to the west line of said out lot; thence north thirty-eight and one-half (37½) degrees west along said west line sixty-five (65) feet eight (8) inches to the place of beginning.

Part of Out Lot Number Ten (10) in the Northern Addition (as recorded on pages 104-107 of Plat Book #2 in the Office of the Recorder of Wabash County, Indiana) to the City of Wabash, bounded and described as follows:

Beginning at a point on the north line which is one hundred seventy-five (175) feet east of the northwest corner of said Out Lot and situated on the South line of a public alley; thence east along the south line of said alley thirty (30) feet; thence Southerly along the west line of an alley thirty (30) feet; thence westerly thirty (30) feet to the southwest corner of a parcel now or formerly owned by Bessie V. Downs; thence northerly along the west line of said parcel thirty (30) feet to the place of beginning.

TRACT 5. Lot Number One (1) in Tyer's Addition (recorded on pages 32 and 33 in the Plat Book #3, in the office of the Recorder of Wabash County, Indiana) to the City of Wabash, Indiana.

Subject to highways, right-of-ways, easements and restrictions of record.

TRACT 6. Part of Out Lot Number One (1), in Tyer's Addition to the Town (now City of Wabash) bounded and described as follows, viz:

Beginning at the north east corner of said out lot; thence running south on the east line of said out lot one hundred seventy-seven (177) feet to the south line of said out lot; thence west along the south line thereof sixty (60) feet; thence north parallel with the east line thereof, one hundred seventy-seven (177) feet to the north line of said out lot; thence east along said north line sixty (60) feet to the place of beginning.

TRACT 7. Part of Outlot No. One in Tyer's Addition to the City of Wabash, Wabash County, Indiana as recorded on pages 32 and 33, Plat Book 3, in the Recorder's Office, more particularly described as follows, to-wit:

Commencing at a point in the north line of said Outlot Number One (1), sixty (60) feet west of the northeast corner thereof, and running thence south parallel with the east line thereof one hundred seventy-seven (177) feet to the south line thereof; thence west along said south line a distance of sixty (60) feet; thence north parallel with the said east line of said Outlot a distance of one hundred seventy-seven (177) feet to the north line thereof; thence east along said north line of said Outlot a distance of sixty (60) feet to the place of beginning, in Wabash County, Indiana.

The Common Council of the City of Wabash, Indiana pursuant to Indiana Code § 36-7-4-608 amends the zone map incorporated by reference in General Ordinance No. 1, 1995, as amended, passed by the Common Council of the City of Wabash, Wabash County, Indiana on the 24 th day of April, 1995, at Article 2, Section 2.1 (Wabash City Code, Section 10-29) as follows:

A.

To reclassify from a light industrial district to a historic downtown district, the property described as follows, and shown outlined on the map attached hereto, incorporated herein, and marked as Exhibit "A":

All of that area lying between the following streets: Beginning at the intersection of Carroll Street and Factory Street, then running south on Carroll Street to Erickson Street; thereafter running east on Erickson Street to Cass Street; thereafter running north on Cass Street to Factory Street; and thereafter running west on Factory Street to point of beginning (i.e. Carroll Street).

B.

To reclassify from a light industrial district to a general business district the property described as follows, and shown outlined on the map attached hereto, incorporated herein and marked as Exhibit "B":

All of that area between the following streets: Beginning at the intersection of Erickson Street and Carroll Street, then running south on Carroll Street to Fulton Street, then running east on Fulton Street to Miami Street, then running north on Miami Street to Water Street, then running west on Water Street to Cass Street, and then South on Cass Street to Erickson Street and then west on Erickson Street to the point of beginning, to-wit: Carroll Street.

C.

To reclassify from a heavy industrial district to a general business district, the property described as follows, and shown outlined on the map attached hereto, incorporated herein, and marked as Exhibit "C":

All of the following described real estate in Wabash County, in the State of Indiana, to-wit:

A part of subdivisions numbered 1 and 2 in Ewing & Hanna's Subdivision of Charley's Section and a part of the fractional north half of Section 14, Township 27 North, Range 6 East, in Wabash, Indiana, described as follows:

Beginning at a point on the south line of Factory Street, said point being south 84 degrees 23 minutes 40 seconds west 240.34 feet (assumed bearing) from the intersection of the south line of Factory Street and the west line of Carroll Street; thence south 06 degrees 01 minutes 58 seconds east 75.00 feet and parallel with said Carroll Street; thence south 35 degrees 08 minutes 03 seconds east 113.78 feet; thence south 45 degrees 56 minutes 20 seconds east 132.49 feet; thence south 06 degrees 01 minutes 58 seconds east 123.02 feet to the north line of West Street; thence south 84 degrees 13 minutes 53 seconds west 210.00 feet along said north line; thence north 06 degrees 01 minutes 58 seconds west 398.62 feet to the south line of Factory Street; thence north 84 degrees 23 minutes 40 seconds east 69.67 feet to the point of beginning, containing 1.324 acres, more or less, subject to an easement granted to Container Corp. across the northwest corner of the above described parcel for maintenance, operation and use of an existing railroad track, said easement being ten (10) feet each side of and parallel with the center line of an existing railroad track.
