This chapter shall be know and may be cited as the "Town of Walton, New York, Zoning Ordinance" and shall include this text, Schedule 1 and the Zoning Map.[1]
Pursuant to the authority conferred by Article 16, § 261, of the Town Law of the State of New York, the Town Board of the Town of Walton hereby adopts and enacts as follows.
§ 200-3 Purpose.
The purpose of this chapter, its regulations and its zoning districts as outlined on the Zoning Map is to:
Protect the character and the social and economic stability of all parts of the Town, and to encourage the orderly and beneficial development of all parts of the Town;
Provide a guide for public policy and action in the efficient provision of public facilities and services, and for private enterprise in building development, investment and other economic activity relating to uses of land and buildings;
Prevent the pollution of air, streams and ponds; to assure the adequacy of drainage facilities; to safeguard the water table; and to encourage the wise use and sound management of the Town's natural resources in order to preserve the integrity, stability and beauty of the community and the value of the land;
Encourage and make suitable provisions for the accommodation of solar energy systems and equipment and access to sunlight necessary therefor.
§ 200-4 Conflict with other provisions.
Whenever the requirements of this chapter are at variance with the requirements of any other lawfully adopted rules, regulations, or ordinances, the most restrictive, or that imposing higher standards, shall govern.
§ 200-5 Interpretation.
In their interpretation and application, the provisions of this chapter shall be held to be minimum requirements adopted for the promotion of the public health, morals, safety, or the general welfare.
