17.48 Accessory

17.48.010 Family Swimming Pools

A family swimming pool shall be permitted in the rear of a dwelling as an accessory use provided the following requirements are met

  1. A swimming pool may cover the area within a rear yard and not located within an easement unless the construction of that pool would require the need to vary from existing ordinance. A variance for the pool to be allowed to be constructed on the easement would need to be obtained. 
  2. The pool or spa may not be closer than five (5) feet to the property line measured at water’s edge.
  3. Minimum setback requirements from property lines are as follows:
    1. Front Yard: No pool allowed within a front yard.
    2. Rear Yard: Five feet (5’) Min.
    3. Side Yard: Five feet (5’) Min. within the fence line of the property.
    4. Easement: Setbacks shall comply with all easement regulations
  4. An outside family swimming pool shall be completely enclosed by a substantial fence not less than five feet (5') in height, and any lights used to illuminate the pool or its accessories shall be so arranged as to reflect the light away from the adjoining premises.

17.48.020 Television Satellite Antennas

  1. "Television satellite antenna (TSA)" or "dish antenna" means a combination of an antenna or dish antenna whose purpose is to receive communication or other signals from orbiting satellites and a low noise amplifier (LNA) which is situated at the focal point of the receiving component and whose purpose is to carry the signals into the interior of the building.
  2. Building permits are required for TSAs and shall comply with the following regulations:
    1. Location:
      1. All TSAs shall have setbacks of at least five feet (5'), if freestanding. The setback shall be measured from the property lines to the nearest point of the antenna. The distance for rotating dish antennas shall be measured from the nearest point of the antenna in its closest rotational configuration.
      2. In any commercial or manufacturing zone, such antenna may be located on the roof or in the rear or side yard facing the street on a corner lot, by approval of the appeal authority when a usable satellite signal cannot be obtained in an otherwise approved location.
      3. TSAs shall only be located in the rear of any lot in any residential zone. If a usable satellite signal cannot be obtained from such rear yard, the antenna may be located on the roof or side yard (except side yards facing the street on a corner lot) by approval of the appeal authority.
    2. Antenna Size: No TSA shall exceed twelve feet (12') in diameter in a residential zone.
    3. Antenna Height: No antenna shall exceed the height limitation in its respective zone.
    4. Construction Standards:
      1. All antennas shall be erected in a secure and wind resistant manner.
      2. Every antenna must be adequately grounded for protection against a direct strike of lightning.
      3. All antennas in a residential zone shall be located and designed to reduce visual impact from surrounding properties at street level and from public streets.
      4. The surface of the dish shall be painted or treated so as not to reflect glare from sunlight.
      5. All electrical and antenna wiring shall be placed underground or otherwise obscured from view.
    5. Temporary Television Satellite Antennas: Temporary TSAs may be located on property for a total of thirty (30) days subject to the provisions of this title.

17.48.030 Internal Accessory Dwelling Unit Regulations

  1. 17.48.030. Internal Accessory Dwelling Units.

    1. Eligibility. In accordance with Utah Code 10-9a-530.1a, an internal Accessory Dwelling Unit (ADU) is eligible for a permit if such ADU is:
    a. Located in the primary dwelling;
    b. Placed within the footprint of the primary dwelling as described in state law at the time the ADU created;
    c. Not used for vacation rental or short-term rental; and,
    d. Used only for residential long-term rental of thirty (30) consecutive days or longer and be advertised as such.
    2. Local Requirements. In accordance with Utah Code 10-9a-530-4, the City:
    a. Does not require the installation of a separate utility meter for an ADU.
    b. Each ADU shall be designed in a manner that does not change the appearance of the primary dwelling as a single-family dwelling.
    c. The owner of the primary dwelling creating an ADU shall:
    i. Include one additional on-site parking space on an improved surface of concrete or asphalt, regardless of whether the primary dwelling is existing or new construction; and
    ii. Replace all parking spaces contained within a garage or carport converted to an ADU.
    3. Limitations. The following limitations apply to the creation or occupancy of any ADU:
    a. Only one (1) ADU per primary dwelling is permitted consistent with this section.
    b. No ADU shall be created or occupied within a mobile home as defined under Utah Code 57-16-3.
    c. No ADU shall be created or occupied without the owner of the primary dwelling obtaining all permits and licenses for the ADU from the City and any other affected entity.
    i. The unit shall be required to be inspected as part of the building permit process by the building official.
    ii. All new construction shall comply to adopted building code requirements.
    d. No ADU will be approved where the primary dwelling is served by a failing septic tank.
    e. No ADU shall be created or occupied where the primary dwelling lot is six thousand (6,000) square feet or less in size.
    f. No external accessory dwelling unit are allowed.
    g. No ADU shall be created or occupied unless the primary dwelling is also used as the owner’s primary dwelling.
    4. Licensing. The owner of any ADU shall obtain a business license in accordance with Title 3 and Chapter 3.15 of the municipal code.
