17.80 Administration

And Enforcement

17.80.010 Enforcement Authority

The building official, appointed under the provisions of the building code of the city, is designated and authorized as the officer charged with the enforcement of this title; but the city council, by resolution or ordinance, may from time to time entrust such administration, in whole or in part, to any other officer of the city without amendment to this title.

17.80.020 Permits To Comply With Ordinance

Building permits shall comply with applicable ordinances as provided by Utah Code Annotated 10-9-18.

17.80.030 Building And Zoning Official Office Established Powers And Duties

There is established the office of building and zoning official. The powers and duties of the building official are provided in Utah Code Annotated 10-9-18 and also as adopted in the uniform building code.

17.80.040 Changes And Amendments

This title may be amended from time to time by following the procedures as set forth in Utah Code Annotated 10-9-4 and 10-9-5.

17.80.050 Areas Annexed To City

New areas annexed to the city shall be classified as specified in Utah Code Annotated 10-9-5.

17.80.060 Licensing

All departments, officials and public employees of the city which are vested with the duty or authority to issue permits or licenses shall conform to the provisions of this title and shall issue no permit or license for uses, buildings or purposes where the same would be in conflict with such provisions; and any such permit or license, if issued in conflict with such provisions, shall be null and void.

17.80.070 Compliance Permits

Zoning compliance permits shall: a) comply with applicable ordinances as provided by this code; b) explain the requirements of the ordinances for those areas that are exempt from the permit fees, but are regulated by ordinances; and c) certify that an applicant has read and examined all the provisions of the laws and ordinances that govern this type of work, fences, concrete placement, trees in easements, window replacement, impervious surface ratio and placement of sheds under two hundred (200) square feet.

The granting of a permit does not presume to give authority to violate or cancel the provisions of any state or local law regulating construction or the performance of construction and that the applicant makes this statement under penalty of perjury.

17.80.80 Penalties

17.80.080 Penalties.
In accordance with Utah Code Annotated §10-9a-803 and §10-3-703, the following penalties apply:
1. Criminal. Any person who violates the Title is guilty of a class C misdemeanor and a fine not to exceed $750.
2. Civil. Any person who violates this Title is subject to a civil fine not to exceed $1,000, per violation, per day that the violation continues after the City gives notice in accordance with Utah Code Annotated §10-9a-803.
