CHAPTER 1132

Schedule of Area, Height, Bulk and Placement

1132.01 AREA AND PLACEMENT.

   No building shall be erected, converted, enlarged, reconstructed or structurally altered, except in conformity with the area and placement regulations of the district in which the building is located.

1132.02 PERMITTED HEIGHT.

   No building shall be erected, converted, enlarged, reconstructed or structurally altered to exceed the height limit hereinafter established for the district in which the building is located, except the penthouses or roof structures for the housing of elevators, stairways, tanks, ventilating fans or similar equipment required to operate and maintain the building, and fire or parapet walls, skylights, towers, steeples, stage lofts and screens, flag poles, chimneys, smokestacks, individual domestic radio and television aerials and wireless masts, water tanks or similar structures may be erected above the height limits herein prescribed. No such structure may be erected more than fifteen feet in excess of height limits of the district in which it is located unless otherwise specified, nor shall such structure have a total area greater than 10% of the roof area of the building; nor shall such structure be used for any residential purpose or any commercial or industrial purpose other than a use incidental to the main use of the building.

1132.03 YARD ENCROACHMENTS.

   (a)   Architectural features, may extend or project into a required side yard not more than three inches for each one foot of width of such side yard nor more than three feet. Outside stairways, fire escapes, fire towers, porches, platforms, balconies, boiler flues and other similar projections shall be considered as part of the building and not allowed as part of the required space for yards or courts or occupied space, provided that this provision shall not apply to one fireplace or one chimney, not more than eight feet in length projecting more than twelve inches into the allowable side yard space, nor cornices not exceeding eighteen inches in width including the gutter, nor to platforms, terraces, steps below the first floor level, nor to unenclosed porches or ground level unenclosed projections not more than one story in height. However, the excepted projections shall not exceed more than eight feet into the required front or rear yard, shall not extend nearer than four feet from any interior side lot line or nearer than five feet from a side lot line abutting upon a street.
   (b)   The minimum yard spaces, including lot area per family and maximum lot coverage required by this Zoning Code, for each and every building existing at the time of the passage of this Zoning Code or for any building hereafter erected, shall not be encroached upon or considered as yard or open space requirements for any other building.

1132.04 RESTRICTIONS ON REAR YARD.

   No residential structure shall be erected upon any required rear yard of a lot or upon a lot with another dwelling.

1132.05 APPROVAL OF PLATS.

   No proposed plat of a new or redesigned subdivision shall hereafter be approved by the Planning Commission unless the lots within such plat equal or exceed the minimum size and width requirements set forth in the various districts of this Zoning Code, and unless such a plat fully conforming with the statutes of the State and the Subdivision Regulations of the Municipality.

1132.06 SETBACK REQUIREMENTS FOR CORNER LOTS.

   On a corner lot in all districts the main building and any accessory structure shall be required to have the same setback distance from all street right-of-way lines as required for the front yard in the district in which such structures are located.

1132.07 YARD REQUIREMENTS FOR MULTI-FAMILY OR GROUP DWELLINGS.

   Group or multi-family dwellings shall be considered as one building for the purpose of determining front, side and rear yard requirements. The entire group as a unit shall require one front, one rear and two side yards as specified for dwellings in the appropriate district.

1132.08 EXISTING RESIDENTIAL USE.

   Existing residential use in commercial or industrial districts shall adhere to all requirements for R-3 District.

1132.10 ADDITIONAL YARD REQUIREMENTS.

   (a)   In all industrial districts the required front yard setback shall not be used for off-street parking, loading or unloading, and shall remain as open space unoccupied and unobstructed from the ground upward except for landscaping plant materials or vehicles access drives. All yards abutting upon a public street shall be considered as front yards for setback purposes. In all commercial districts the same requirements shall apply except that only the first fifteen feet of required front yard setback may not be used for parking and loading purposes.
   (b)   Side and rear yard requirements for all B-1, B-2, B-3, M-1 and M-2 Districts, shall be ten feet. Business and industrial buildings or uses shall not be located nor conducted closer to any lot line of an R District than the distance specified in the following schedule:

   (c)   Landscaping or screening provisions: For nonresidential uses abutting R Districts, landscaping and/or screening approved by the Planning Commission shall be provided and maintained in good condition as a precondition to any and every nonresidential use of such abutting property. The Planning Commission shall have original jurisdiction to reduce the minimum yard requirements stated in paragraph (b) provided it finds, after considering the type of landscaping and/or screening required and the nature of the nonresidential use, that the reduction will not be detrimental to the abutting R District or the owners or occupants thereof.
 
   (d)   Loading space for non-residential uses shall be provided in the side or rear yard, except that this regulation shall not be applicable to loading space provided totally within a building or structure which has door enclosures facing other than the front property line.
