- AMENDMENTS
This ordinance, including the zoning map(s), may be amended, or repealed from time to time according to the following procedures:
130.1
Amendment of Motion of Board of Commissioners.
The County Board of Commissioners, may from time to time, amend, supplement, change, modify or repeal the boundaries or regulations herein, or subsequently amended. This may be done after a public hearing, as prescribed by Section 130.4, on the Commissioners own motion, or as a result of a recommendation of the Planning Board.
130.2
Petition for Amendment.
Petitions from the public at large to amend this ordinance shall be directed to the Wayne County Planning Board for review and recommendation at least twenty-five (25) [88] days prior to the next regularly scheduled meeting of the Planning Board. [89] The petition shall state the nature of the proposed amendment, and if applicable, a description of the property involved names and addresses of the owner of the property, and a statement why the proposed amendment is necessary to promote the public health, safety, and general welfare. Each petition for amendment shall be accompanied be [by] a fee to be established by the Board of Commissioners [90] to defray the cost of advertising and other administrative costs involved.
130.3
Planning Board Review and/or Recommendation.
The Planning Board shall have sixty-five (65) days from the first meeting it receives the petition within which to submit a request for a Board of Commissioner public hearing or recommendations on petitions for amendment. The Planning Board may conduct its own pubic hearing prior to submitting a recommendation or request for public hearing. Failure of the Planning Board to submit either a request for public hearing or recommendations within this time period shall constitute a favorable recommendation. [91] The Board's report shall be submitted in writing to the Clerk of the Board of Commissioners and to the petitioner(s).
130.4
Public Hearing by the Board of Commissioners.
A pubic hearing shall be held by the Board of County Commissioners before adoption of any proposed amendment to this ordinance. A notice of such public hearing shall be given once a week for two (2) consecutive calendar weeks in a newspaper of general circulation in Wayne County. Said notice shall be published the first time not less than ten (10) days nor more than twenty-five (25) days [92] prior to the date established for such public hearing.
When a zoning map amendment is proposed, a notice of the hearing shall be posted on the property at least ten days but not more than 25 days prior to the date of the hearing.
Following the public hearing the Board of Commissioners shall return the petition to the Planning Board, if no recommendation has been received. The Planning Board will then have thirty (30) days from the time it receives the petition from the Board of Commissioners to make a recommendation. Failure of the Planning Board to submit its recommendations within this time period shall constitute a favorable recommendation. [93]

Vote of the Board of Commissioners.
A simple majority of the Board of County Commissioners shall be required to amend this ordinance when recommendation by the Planning Board is favorable. A simple [94] majority vote by the Board of County Commissioners shall be required to amend this ordinance when the Planning Board recommends against such amendment.

Denial of Petition.
When a petition for amendment is denied by the Board of County Commissioners, a period of twelve (12) months must elapse before another petition for the same change previously involved may be submitted.
