CHAPTER 4

ZONING DISTRICTS AND MAP

8-4-1: DISTRICTS ESTABLISHED:

The entire city is hereby divided into zoning districts, within which zoning districts all property use shall hereafter conform to the requirements specified herein, and which zoning districts are hereby classified as follows:
Residential Districts:
R-1, R-2, RMF single-family, two-family and multiple-family
    residential district
RMH mobile home parks and recreational vehicle parks; mobile
    home and manufactured home subdivisions district
Nonresidential Districts:
P public, quasi-public district
C-1 convenience commercial district
C-2, C-3 general commercial district
RC restricted commercial district
M-1 light industrial district
M-2 general industrial district
Special Districts:
AG general agriculture district
FP flood plain overlay district
Special Development Districts:
   P-C planned community district
   R-PD residential planned development district
   P-D planned development district
Airport Area Districts:
See chapter 16 of this title.

8-4-2: REQUIRED CONFORMITY TO DISTRICT REGULATIONS:

The regulations set forth in this title for each zoning district shall be minimum regulations and shall apply uniformly to each class or kind of structure or land, except as hereinafter provided:
   A.   No building, structure or land shall hereafter be used or occupied, and no building or structure or part thereof shall hereafter be erected, constructed, moved or structurally altered unless in conformity with all regulations hereinafter specified for the district in which it is located.
   B.   No building or other structure shall hereafter be erected or altered:
      1.   To accommodate or house a greater number of families than as permitted herein;
      2.   To occupy a greater percentage of lot area; or
      3.   To have narrower or smaller rear yards, front yards, side yards or other open spaces than hereinafter required or in any other manner contrary to the provisions of this title.
   C.   No part of a required yard or other open space or off- street parking or loading space provided in connection with any building or use shall be included as part of a yard, open space or off-street parking or loading space similarly required for any other building.
   D.   No yard or lot existing on the effective date hereof shall be reduced in dimension or area below the minimum requirements set forth herein. (Ord. 91-9, 6-4-1991)

8-4-3: OFFICIAL ZONING DISTRICT MAP:

   A.   Map Established: The areas and boundaries of zoning districts are hereby established as shown on the official West Wendover zoning map which, together with all explanatory matter thereon, is hereby adopted by reference and declared to be a part of this title. (Ord. 91-9, 6-4-1991)
   B.   Identification: The official West Wendover zoning map shall be entitled "West Wendover Zoning Map" and identified by the signature of the mayor, attested by the city clerk, bear the notations that it was adopted on the date this title was passed and bears the seal of the city. Regardless of the existence of purported copies of the official West Wendover zoning map which may, from time to time, be made or published, the official West Wendover zoning map, which shall be located in the office of the city manager, shall be the final authority as to the current zoning status of land areas, buildings, and other structures in the city.    C.   Changes 1 , Replacement:
      1.   Changes: If, in accordance with the provisions of this title, changes are made in district boundaries or in other matters portrayed on the West Wendover zoning map, such changes shall be made on said map promptly after the amendment has been approved by the city council together with an entry signed by the city clerk certifying to the accuracy and date. No amendment to this title which involves matter portrayed on the West Wendover zoning map shall become effective until after such change and entry have been made on said map. No changes of any nature shall be made in the West Wendover zoning map or matter shown thereon except in conformity with the provisions of this title. Any unauthorized change of whatever kind by any person or persons shall be considered a violation of this title and punishable as hereinafter provided.
      2.   Replacement: In the event that the West Wendover zoning map becomes damaged, destroyed, lost or difficult to interpret due to the nature or number of changes and additions, the city council may, by resolution, adopt a new West Wendover zoning map which shall supersede the former map. The new West Wendover zoning map may correct drafting or other errors or omissions in the former map, but no such correction shall have the effect of amending the original zoning ordinance or any subsequent amendment thereto. The new West Wendover zoning map shall be identified by the signature of the mayor, attested by the city clerk, and bear the seal of the city under the words:
This is to certify that this West Wendover Zoning Map adopted the (date) supersedes and replaces the West Wendover Zoning Map adopted (date of adoption of map being replaced) as part of the Zoning Ordinance of the City of West Wendover, Nevada.

8-4-4: DISTRICT BOUNDARIES:

Where, due to scale, lack of detail or illegibility of the West Wendover zoning map, there is an uncertainty, contradiction or conflict as to the intended location of any district boundary shown thereon, the exact location of such boundary shall be determined by the city council who, in reaching its determination, shall apply the following standards:
   A.   Zoning district boundary lines are intended to follow lot lines or be parallel or perpendicular thereto and center lines of streets, alleys and rights of way, unless otherwise fixed by dimensions shown on the West Wendover zoning map.
   B.   In subdivided property or where a zoning district boundary divides a lot, the exact location of such boundary shall be indicated by dimensions shown on the West Wendover zoning map.
   C.   If, after application of the foregoing rules, uncertainty still exists as to the exact location of a zoning district boundary, the city council shall determine and fix the location of such boundary in accordance with the purpose and intent of this title. (Ord. 91-9, 6-4-1991)

8-4-5: CLASSIFICATION OF ANNEXED AREAS:

All territory which is annexed to the city after the effective date hereof shall be zoned, upon annexation, AG general agriculture unless the city council shall otherwise designate the zoning district after holding duly advertised public hearings in accordance with section 8-11-6 of this title. 8-4-6: CLASSIFICATION OF VACATED STREETS:

Whenever a public street or alley is vacated by official action of the city council, the zoning districts adjoining each side of such street or alley shall automatically be extended to the center line thereof, and all land area thus vacated shall then and henceforth be subject to all regulations of the extended districts.
