CHAPTER 12

SPECIAL PURPOSE ZONING DISTRICTS AND REGULATIONS

10-12-1: MUNICIPAL AND GOVERNMENTAL LAND DISTRICT:

   A.   Permitted Uses:
Office buildings owned and/or operated by the village, state, county, federal government, any other local government or statutory special taxing district, provided the lot area is seven thousand five hundred (7,500) square feet or less.
   B.   Conditional Uses:
Libraries.
Municipal utility and service uses including fire stations, police stations, train stations, waterworks, reservoir, pumping stations and filtration plants.
Municipally owned or government owned community, cultural, historical or recreational buildings and facilities.
Municipally owned or government owned telecommunication towers, antennas and personal wireless services facilities, but prohibiting telecommunication towers greater than forty five feet (45') in height, except for monopoles owned by a state, federal or local government body that are used primarily for governmental or public safety communications, provided that the monopole has a maximum height of one hundred feet (100') and conforms to the regulations set forth in chapter 4, part V of this ordinance.
Municipally owned parking lots, commuter or otherwise.
Museums.
Office buildings owned and operated by the village, state, county, federal government, any other local government or statutory special taxing district, provided the lot area exceeds seven thousand five hundred (7,500) square feet.
Post offices.
Public parks and playgrounds.
Utility and service uses or facilities owned and operated by the village, state, county, federal government, any other local government or statutory special taxing district.
   C.   Minimum Lot Area: None.
   D.   Minimum Lot Width: None.
   E.   Minimum Yard Requirements:
      1.   Front yard: Ten feet (10').
      2.   Corner side yard: Fifteen feet (15').
      3.   Interior side yard: None.
      4.   Rear yard: Five percent (5%) of the lot depth or five feet (5'), whichever is less.
   F.   Transitional Yard Requirements: Along the lot line of a lot in the MGL district that abuts a lot in a residential district, a landscaped, transitional yard will be provided as outlined below and in subsection G of this section:
      1.   Front yard: None required.
      2.   Corner side yard: None required.
      3.   Interior side yard: Five feet (5').
      4.   Rear yard: Five percent (5%) of the lot depth or five feet (5'), whichever is less.
   G.   Landscape Requirements For Transitional Yard: Where the lot line of a lot in the MGL district abuts a lot in a residential district, landscaping in the required transitional yard will be provided by the property owner in accordance with the provisions of section 10-4-9, "Landscape Requirements", of this ordinance, including the submission of a landscape plan for plan commission and village board approval. In locations where the lot line of a lot in the MGL district abuts a lot in a residential district and there is no parking lot improvement in the adjacent side yard or rear yard area, the landscaping in the required transitional yard will be provided by the property owner in accordance with the provisions of subsection 10-4-9G4b(1)(A)(i) of this ordinance.
   H.   Minimum Open Space: None.
   I.   Maximum Building Height:
      1.   Permitted Uses: Thirty five feet (35') or two and one-half (21/2) stories, whichever is less.
      2.   Conditional Uses: Forty five feet (45') or three and one-half (31/2) stories, whichever is less.
      3.   Exceptions: All existing and proposed village owned water towers, including the water tower located on the village green at 916 Hillgrove Avenue, shall not be subject to the maximum building height regulations set forth in this ordinance.
   J.   Maximum Building Coverage: None.
   K.   Exceptions: All buildings and structures located, in whole or in part, in any right of way or public way shall not be subject to the minimum yard requirements and the transitional yard and related landscaping requirements set forth in this chapter. (Ord. 09-2552, 10-12-2009)
