ARTICLE 1309

Waterfront Commercial Industrial District

1309.01 WATERFRONT COMMERCIAL INDUSTRIAL DISTRICT.

   (a)    Purpose. The purpose of Waterfront Commercial Industrial District (WCI) is to:
      (1)   Allow a variety of enhanced uses along the corridor of Westover adjacent to the Monongalia River.
      (2)    Provide appropriate rules and standards to protect for development.
   (b)   Permitted Principal and Conditional Uses.
      (1)   Uses Permitted in the Commercial Zone are permitted.
      (2)   Uses Permitted in the Industrial Zone are permitted EXCEPT for HEAVY MANUFACTURING and HEAVY INDUSTRY.
      (3)   Uses that are listed as Conditional in one zone and not listed as Permitted in the other zone are Conditional.
         A.   A Conditional use in the Commercial Zone remains conditional if it is not a permitted use in the Industrial Zone.
         B.   A Conditional use in the Industrial Zone remains conditional if it is not a permitted use in the Commercial Zone.
      (4)   An Accessory use remains an Accessory use if it is not a permitted use or conditional use.
   (c)    Lot Provisions, Setbacks, Height, Materials, etc. are based on the type of land use.
      (1)   Commercial uses must follow the provisions of the Commercial District.
      (2)   Industrial uses must follow the provisions of the Industrial District.
