ARTICLE XII

PUBLIC/QUASI PUBLIC P DISTRICT

Sec. 60-451.- District and intent.

The public/quasi public category includes one zone district: P. It is the intent of this district to provide for public and semipublic buildings and facilities and accessory structures as may be necessary to serve the city.

Sec. 60-452. - Permitted principal uses and structures.

The following shall be permitted principal uses and structures in the P district:

(1)

Public buildings.

(2)

Churches.

(3)

Fraternal organizations.

(4)

Utilities, including electric and gas.

(5)

Schools.

(6)

Parks and playgrounds, recreational facilities.

(7)

Cemeteries.

(8)

Wellfields, sewer and water treatment facilities.

(9)

Specifically approved land uses on city-owned property at the Williston Airport and airport industrial park subject to consistency with the airport master plan and approval by the city council. Approved land uses and conditions and safeguards for such use shall be specified by terms of a lease agreement where applicable.

Sec. 60-453. - Permitted accessory uses and structures.

Sec. 60-454. - Prohibited uses and structures.

The following shall be prohibited uses and structures in the P district:

(1)

Residential, commercial, agricultural and industrial uses unless otherwise provided for in this article.

(2)

Any other uses or structures not specifically, provisionally or by reasonable implication permitted herein. Any use which is potentially dangerous, noxious or offensive to neighboring uses in the district or to those who pass on public ways by reason of smoke, odor, noise, glare, fumes, gas, vibration, threat of fire or explosion, emission of particulate matter, interference with radio or television reception, radiation or likely for other reasons to be incompatible with the character of the district. Performance standards apply (see article II of this chapter).

Sec. 60-455. - Special exceptions.

The following are special exceptions in the P district:

Sec. 60-456. - Minimum lot requirements.

Minimum lot requirements for area and width in the P district shall be as follows for all permitted uses and structures (unless otherwise specified): None, except as needed to meet the other requirements as set out in this chapter.

Sec. 60-457. - Minimum yard requirements.

Minimum yard requirements for the depth of the front and rear yard, and the width of the side yard in the P district shall be as follows for all permitted uses and structures (unless otherwise specified):

Front: None.

(2)

Side: None.

(3)

Rear: None.

Sec. 60-458. - Maximum height of structures.

The maximum height of structures in the P district shall be 35 feet. See article II of this chapter for exceptions from height limitations.

Sec. 60-459. - Maximum floor area ratio.

The maximum floor area ratio for all permitted uses and structures in the P district (unless otherwise specified) shall be 80 percent.

Sec. 60-460. - Maximum lot coverage by all impervious surfaces.

The maximum lot coverage by all impervious surfaces for all permitted uses and structures in the P district (unless otherwise specified) shall be 80 percent.

Sec. 60-461. - Minimum landscaped buffering requirements.

The minimum landscaped buffering requirements in the P district for all permitted uses (unless otherwise specified) shall be as follows: Where a use listed under this section is erected or expanded on land abutting a residential district, then the proposed use shall provide a landscaped buffer which shall be not less than ten feet in width along the affected rear and/or side yards as the case may be. Sec. 60-462. - Minimum off-street parking requirements.

The minimum off-street parking requirements in the P district shall be as follows:

(1)

Public buildings and facilities (unless otherwise specified): one space for each 300 square feet of floor area.

(2)

Churches and houses of worship: one space for each four permanent seats in the main room.

(3)

Clubs and lodges including fraternal organizations: one space for each 300 square feet of floor area.

(4)

Elementary schools: two spaces for each classroom, plus one space for each staff.

(5)

Middle school: two spaces for each classroom or office room, plus one space for each staff member.

(6)

Senior high school: four spaces for each classroom or office room, plus two space for each three seats in any auditorium or gymnasium.

(7)

Adult and child care centers, preschools: one space for each 300 square feet of floor area devoted to adult or child care activities and one space for each employee.

(8)

For other special exceptions as specified herein: to be determined by findings in the particular case.
