CHAPTER 17

82 - ADMINISTRATION AND ENFORCEMENT

17.82.010 - Purpose.

The purpose of this chapter is to establish a functional and meaningful system of administration and enforcement.

17.82.020 - Zoning administration.

The planning director or his representative shall have the authority to conditionally approve, or disapprove the following types of applications:

A.

Site plan review permit which is in accordance with the provisions contained in Section 17.70.020;

B.

Zoning permit which is in accordance with the provisions contained in Section 17.82.030;

C.

A family day care home permit which is in accordance with the provisions contained in Section 17.82.050;

D.

A home occupation application which is in accordance with the provisions contained in Section 17.66.040;

E.

An application to move a building which is in accordance with the provisions contained in Section 17.66.100;

F.

An application for a temporary land use which is in accordance with the provisions contained in Section 17.66.070;

G.

In addition, the planning director shall determine whether or not certain land uses are, in fact, similar in nature and character to one another;

H.

The planning director shall report monthly to the planning commission on all approvals or disapprovals of administrative permits.

17.82.030 - Zoning permit required.

Unless a conditional use permit, variance, or site plan review permit has been approved in accordance with the provisions of this chapter, no owner of property in the city of Willits shall move a building, conduct a temporary land use or use or permit the use of any legally nonconforming structure, building, or land or part thereof until a zoning permit application has been issued by the planning department.

17.82.040 - Zoning permit application.

The zoning permit application shall be accompanied by a plot plan showing the lot lines and dimensions of improvements with dimensions and any other data necessary to show that yard requirements and all other provisions of this chapter will be fulfilled.

17.82.050 - Family day care home permit.

A family day care home permit shall be obtained for a home which regularly provides care, protection, and supervision of seven to twelve children in the provider's own home, for periods of less than twenty-four hours per day, while the parents or guardians are away.

17.82.060 - Planning director decision.

The decision of the planning director shall be final unless appealed to the commission. The planning director shall cause a copy of the plot plan, with his decision and any conditions shown thereon or attached thereto, to be mailed to the applicant within ten days of the adoption thereof.

17.82.070 - Appeal to the planning commission.

A.

Procedure. The applicant may appeal the decision of the planning director to the commission by setting forth in writing the reasons for such appeal. Such appeal shall be filed with the secretary of the planning commission within ten days after the date of mailing as shown by the postmark on the papers mentioned in Section 17.82.060. The appeal shall be placed on the agenda of the commission's next regular meeting after the appeal is filed; provided, however, that if the appeal is filed within ten days of the next regular meeting of the commission, the appeal shall be placed on the agenda of the commission's second regular meeting following the decision of the planning director. The commission may affirm, reverse, or modify a decision of the planning director.

B.

Decision. The decision of the commission shall be final unless appealed to the council in accordance with the procedure specified in Section 17.82.080. The commission shall cause a copy of the plot plan, with its decision and any conditions attached thereto, to be mailed to the applicant within ten days of the adoption thereof.

17.82.080 - Appeal to the city council.

A.

Procedure. The applicant may appeal the decision of the planning commission to the council by setting forth in writing the reasons for such appeal. Such appeal shall be filed with the city clerk within ten days after the date of mailing as shown by the postmark on the papers mentioned in Section 17.82.060. The appeal shall be placed on the agenda of the council's next regular meeting after the appeal is filed; provided, however, that if the appeal is filed within ten days of the next regular meeting of the council, the appeal shall be placed on the agenda of the council's second regular meeting following the decision of the planning commission. The council may affirm, reverse, or modify a decision of the commission.

B.

Decision. The decision of the council shall be final. The council shall cause a copy of the plot plan, with its decision and any conditions attached thereto, to be mailed to the applicant within ten days of the adoption thereof.

17.82.090 - Documents issued in conflict with title provisions.

All departments, officers and public employees vested with the duty or authority to issue permits, certificates or licenses shall issue no permit, certificate or license for uses, buildings or purposes within the city in conflict with the provisions of these regulations, and any such permit, certificate or license issued in conflict with the provisions of these regulations shall be null and void.

17.82.100 - Violation declared nuisance.

Any building or structure set up, erected, constructed, altered, enlarged, converted, moved, or maintained contrary to the provisions of this chapter, or, any use of any land, building, or premises established, conducted, operated, or maintained contrary to the provisions of this chapter, shall be and the same is declared to be unlawful and a public nuisance.

17.82.110 - Remedies cumulative.

The remedies provided for herein shall be cumulative and not exclusive.

17.82.120 - Enforcement and interpretation.

The planning director and the planning commission, with assistance of the city attorney, shall be responsible for the administration, interpretation, enforcement and correction of violations of the provisions of the ordinance codified in this title, subject to the provisions of Section 17.82.090.

17.82.130 - Violation—Penalty.

Any person, whether principal, agent, employee or otherwise, violating or causing or permitting the violation of any of the provisions of these regulations shall be guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than five hundred dollars or by imprisonment for not more than six months, or by both such fine and imprisonment.
