ARTICLE III

ZONING DISTRICTS ESTABLISHED; ZONING MAP

Sec. 48-96.- Districts designated.

For the purposes of this chapter, the city is hereby divided into districts, as follows:

(1)

Residence districts.

R-1 One-family detached dwellings.
R-2 One-family detached dwellings and one-family semi-detached dwellings.
R-2-A One-family detached and semi-detached dwellings with conversions.
R-3 One-family row houses.
R-4 Row houses with conversions.
R-5 Apartment houses, subdivided into:
R-5-A  Low density.
R-5-A-1  Low-medium density apartment houses.
R-5-B  Medium density.
R-5-C  High density.

Commercial districts.

C-1 Neighborhood shopping.
C-1-A Neighborhood commercial.
C-2 Secondary business centers.
C-3 Central retail.
C-4 Central office.
C-5 Heavy commercial.
C-6 Special commercial.

 

(3)

Manufacturing and industrial districts.

M-1 Light manufacturing.
M-2 General industrial.

 

(4)

Waterfront districts.

W-1 Waterfront manufacturing.
W-2 Waterfront manufacturing/commercial.
W-3 Waterfront low intensity manufacturing/commercial recreation.
W-4 Waterfront residential/commercial.

 

(5)

Special purpose districts.

O Open space.

Sec. 48-97. - Zoning map generally.

(a)

The various zoning districts are as shown, defined and bounded on the Building Zone Map of Wilmington, Delaware, dated November, 2005, hereinafter referred to in this chapter as the zoning map, and on file in the office of the zoning administrator in the department of licenses and inspections.

(b)

Such maps and all explanatory matter thereon are hereby declared to be a part of this chapter.

Sec. 48-98. - District boundary lines.

(a)

The district boundary lines shall be as shown on the zoning map, the scale of the map and the dimensions entered thereon to serve as guides. Dimensioned district boundaries are intended to coincide generally with lot lines, but where such dimensioned line shall vary up to ten feet from the location of any lot line or the acute angle between a dimensioned line and a lot line is less than 30 degrees, the district boundary line shall be interpreted as following such lot line.

(b)

In other cases, the district boundary lines are intended to follow existing lot lines, street lines, the centerlines of railroad right-of-way, stream and nontidal watercourses, established bulkhead lines along tidal waters, and the shorelines along tidal waters without established bulkhead lines.

(c)

In case the shore line of any waterway is extended by solid fill, the filled area shall be deemed to be within the same zoning district as the adjoining upland was prior to such filling.

(d)

In case of doubt or disagreement concerning the exact locations of boundary lines, the determination shall lie with the zoning board of adjustment as hereinafter provided under article II, division 3 of this chapter.
