A. Title: This title shall be known as the ZONING ORDINANCE OF THE CITY OF WINCHESTER, IDAHO. It shall consist of the following text in this title and a "zoning map" which readily identifies the location of districts and subdistricts.
B. Authority: This title is adopted pursuant to authority granted by Idaho Code title 67, chapter 65 and article XII, section 2 of the Idaho Constitution, as amended and codified. (Ord. 275, 4-2-2015)
8-1-2: GENERAL PURPOSES:
It is the intent of the City Council to provide uniform, equitable and reasonable standards to govern the usage of land and structures. In order to promote the health, safety and general welfare, the City seeks:
A. To ensure that adequate public facilities and services are provided to persons at a reasonable cost.
B. To protect against fire, nuisances, and other hazards.
C. To conserve and stabilize property values.
D. To avoid air and water pollution.
E. To ensure that the development of land is commensurate with the physical characteristics of the land.
F. To stabilize expectations regarding future development. (Ord. 275, 4-2-2015)
In their interpretation and application, the provisions of this title are held to be minimum requirements. Whenever requirements of this title conflict with the requirements of any other lawfully adopted rules, regulations, ordinances, or resolutions, that imposing the higher standards shall govern. 8-1-4: SEVERABILITY:
Should any section of this title be declared by the courts to be unconstitutional or invalid, such decision shall not affect the validity of this title as a whole or any other part. (Ord. 275, 4-2-2015)
