EXCEPTIONS AND MODIFICATIONS

Sec. 38-418.- Existing lots.

Where the owner of a lot at the time of the adoption of the ordinance from which this division is derived, or his successors in title thereto, does not own sufficient contiguous land to enable him to conform to the required dimensions in this division, such lot may be used as a building site, provided that yards are established in accordance with the provisions of this division as applied to the district where the lot is located.

Sec. 38-419. - Front yard setback for dwellings.

Front yard setback requirements of this division shall not apply to any dwelling on any lot where the average setback within the same block and zoning district and fronting on the same street is less than the minimum setback required. In such cases, the front yard setback shall be determined by location of the dwelling.

Sec. 38-420. - Height limits.

The height limits of this division shall not apply to church spires, belfries, cupolas, domes, monuments, water towers, observation towers (transmission towers, chimneys, smokestacks, conveyors, derricks, masts, radio and television towers and aerials) barns and similar structures not intended for human occupancy.
