Miscellaneous Provisions
§ 150-95 Interpretation.
In the interpretation and application of the provisions of this chapter, such provisions shall be minimum standards, adopted for promoting the health, safety and general welfare of the municipality.
§ 150-96 Conflict with Other Laws.
Whenever the requirements of this chapter are in conflict with the requirements of any other lawfully adopted rules, regulations or ordinances, the more restrictive or those imposing the higher standards shall govern.
§ 150-97 Violations and Penalties.
A.
(1)
For violation of any provision of the Land Use and Development Ordinance of the Township of Woodbridge, unless a specific penalty is otherwise provided in connection with the provision violated, the maximum penalty upon conviction of the violation shall be by one or more of the following: imprisonment in the County Jail or in any place provided by the municipality for the detention of prisoners, for any term not exceeding 90 days; or by a fine not exceeding $2,000 or by a period of community service not exceeding 90 days. A separate offense shall be deemed to be committed on each day during or on which the violation occurs of continues.

Whenever a fine is to be imposed in an amount greater than $1,250 for violations of housing or zoning codes the owner shall be provided a 30 day period during which the owner shall be afforded the opportunity to cure or abate the condition and shall be afforded the opportunity for a hearing before the Court for an independent determination concerning the violation. Subsequent to the expiration of the 30 day period, a fine greater than $1,250 may be imposed if the Court has determined that the abatement has not been substantially completed. [N.J.S.A. 40:69A-29]
B.
Any initial notice period that may be required by law before which a summons may be issued for a violation of any ordinance contained in this chapter shall not apply to repeat violators. Said repeat violators shall be subject to immediate action by the appropriate Township official and may immediately be issued a summons for a violation of this chapter. For the purposes of this chapter, "repeat violator(s)" shall mean a person or persons who have previously been served with a notice of violation within the last two years for a substantially similar violation of this chapter.
C.
Cannabis Penalties.

(1)
In addition to any penalties that may be imposed by the State of New Jersey, and unless otherwise specified herein, any person or entity who has been convicted of any provision of the Land Use and Development Ordinance of the Township of Woodbridge shall be subject to a civil penalty not to exceed $2,000 per violation. A separate offense shall be deemed to have been committed on each day during or on which the violation occurs or continues.
§ 150-98 Severability.
If any section, subsection, paragraph, clause, phrase or provision of this chapter or the location of any zone boundary shown on the Zoning Map that forms a part hereof shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this chapter as a whole or any part of the provisions hereof other than the part so adjudged to be invalid or unconstitutional.
§ 150-99 When Effective.
This chapter shall take effect upon enactment and publication in the manner provided by law.
§ 150-100 Effect on Prior Provisions.
Any application for development declared complete by any approving authority of the Township of Woodbridge prior to the adoption of this chapter, shall be governed and administered in accordance with the zoning regulations in force on said date.
§ 150-101 Repealer.
A.
Ordinance No. 11-18 provided: An ordinance entitled "An Ordinance to Limit and Restrict to Specific Districts or Zones and to Regulate Therein, Buildings and Structures According to Their Construction and the Nature and Extent of Their Use, and the Nature and Extent of the Uses of Land, in the Township of Woodbridge, in the County of Middlesex, and providing for the Administration and Enforcement of the Provisions Herein Contained and Fixing Penalties for the Violations Thereof," also known as "The Township of Woodbridge Zoning Ordinance of 1979," adopted May 29, 1979, as amended from time to time, is hereby repealed.
B.
Adopting Ordinance No. 12-44 provided for the repeal of the existing Land Use Ordinance and which may be found at the forward of this Land Use and Development Chapter.
§ 150-102 Fee for Copies of Land Use and Development Regulations.
Pursuant to N.J.S.A. 47:1A-2, a fee of $110 is hereby established for the obtaining of a copy of the Township of Woodbridge Land Use and Development Regulations and $25 for Code supplements. Multiple copies shall be charged multiple fees, depending upon the number of copies obtained. Such fee shall be paid to the custodian of said document. This fee has been established to defray the reproduction costs the Township incurs in the copying of said Code for dissemination to the public. Any other municipal, County, State or Federal agency shall be exempt from the payment of the aforementioned fee. The fixing of such fee shall in no way be construed as obligating the custodian to provide such records when otherwise limited by law.
