MISCELLANEOUS PROVISIONS

Sec. 90-526.- Compliance of public employees, officials, etc., with permit issuance requirements; effect of permits issued in conflict with chapter.

Any departments, officials and public employees of this town who or which are vested with the duty or authority to issue permits or licenses shall conform to the provisions of this chapter. They shall issue permits for uses, buildings or purposes only when they are in harmony with the provisions of this chapter. Any such permit, if issued in conflict with the provisions of this chapter, shall be null and void.

Sec. 90-527. - Exemption of public utilities corporations.

This chapter shall not apply to any existing or proposed buildings, or extension thereof, used or to be used by a public utility corporation, if, upon petition of the corporation, the state corporation commission shall, after a public hearing, decide that the present or proposed situation of the building in question is reasonably necessary for the convenience or welfare of the public.

Sec. 90-528. - Penalty.

Any person, whether as principal, agent, employee or otherwise, violating, causing or permitting the violation of any of the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, may be fined not less than $10.00 nor more than $1,000.00. Such person shall be deemed to be guilty of a separate offense for each day during which any portion of any violation of this chapter is committed, continued or permitted by such person and shall be punishable as herein provided.
