DISTRICTS AND BOUNDARIES

§ 155.025 ZONING MAP.

   The city is hereby divided into zoning districts as shown on the zoning map. The zoning map together with all explanatory matter thereon, is hereby adopted by reference and declared to be a part of this title. ('69 Code, § 7-7)
   (A)   Signature and seal. The zoning map shall be identified by the signature of the Chairman of the Planning Commission attested by the City Clerk and bearing the seal of the city under the following words: "This is to certify that this is the Official Zoning Map of the City of Worthington, Minnesota." ('69 Code, § 7-7.01)
   (B)   Changes in map. If, in accordance with the provisions of this title, changes are made in district boundaries or other matter portrayed on the zoning map, such changes shall be made on the zoning map promptly after the amendment has been approved by the City Council. The Administrator shall make such changes. ('69 Code, § 7-7.02)
   (C)   Unauthorized change. Any unauthorized change of whatever kind by any person or persons shall be considered a violation of this title and punishable as provided under the provisions of this title. ('69 Code, § 7-7.03)
   (D)   Final authority. Regardless of the existence of purported copies of the zoning map, which may from time to time be made or published, the official zoning map shall be the final authority of the current zoning status and shall be located in the office of the Administrator. ('69 Code, § 7-7.04)

§ 155.026 BOUNDARY INTERPRETATION.

   Where uncertainty exists with respect to the boundaries of any districts as shown on the zoning map, the following rules shall apply: ('69 Code, § 7-8)
   (A)   Centerlines as boundaries. Where district boundaries are indicated as approximately following the center lines of streets or highways, street lines or highway right-of-way lines, such center lines, street lines, or highway right-of-way lines shall be construed to be such boundaries.    (B)   Lot lines as boundaries. Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be said boundaries. ('69 Code, § 7-8.02)
   (C)   Boundaries parallel with center lines or right-of-way lines. Where district boundaries are so indicated that they are approximately parallel to or extensions of the center lines or street lines of streets, or the center lines or right-of-way lines of highways, such district boundaries shall be construed as being
parallel thereto or extensions thereof, and at such distance therefrom as indicated on the zoning map. If no distance is given, such dimension shall be determined by the use of the scale shown on said zoning map. ('69 Code, § 7-8.03)
   (D)   Water body or railroad line. Where the boundary of a district follows a water line or railroad line, said boundary shall be deemed to be located midway between the shores of the water body or the main tracks of said railroad line. ('69 Code, § 7-8.04)
   (E)   Boundary dividing lot. Where a district boundary divides a lot which was in single ownership at the time of enactment of this title, the use authorized thereon and the other district requirements applying to the most restricted portion of such lot under this title shall be construed as extending to the entire lot. This provision shall not pertain to flood hazard overlay districts. ('69 Code, § 7-8.05)
   (F)   Effect of vacation on boundary. Whenever any street, alley or other public way is vacated by official action, the zoning district adjoining such public way shall be extended automatically and include all land attached by reversion and it shall be subject to all regulations of the extended district or districts. ('69 Code, § 7-8.06)
   (G)   "E" District. All properties not specifically included within a district are hereby declared to be in the "E" District. Whenever land is annexed or consolidated with the city, it shall automatically fall within an "E" District unless otherwise provided by ordinance adopted at the time of annexation or consolidation. ('69 Code, § 7-8.07)
   (H)   Administrator to interpret. Where physical or cultural features existing on the ground are at variance with those shown on the zoning map, or in other circumstances not covered above, the Administrator shall interpret the district boundaries. ('69 Code, § 7-8.08)
   (I)   Board to interpret. Where there appears to be a conflict between the mapped flood hazard overlay district and actual field conditions, the Board of Zoning Appeals shall make the necessary interpretation. The person contesting the location of the district boundary shall be given a reasonable opportunity to present his case to the Board and submit his own technical evidence if he so desires.
