Section 1401.- Membership.

The Banks County Planning Commission ("BCPC") shall consist of five members who shall be residents of Banks County, Georgia, appointed by the board of commissioners of the county. The terms of the members shall be for four years or until their successors are appointed. Any vacancy in the membership shall be filled for the unexpired term by the board of commissioners, who shall also have the authority to remove any member for cause, on written charges, after a public hearing. Each member of the BCPC in office shall continue in office for the remainder of his/her term. In all actions or decisions of the BCPC, at least three members must concur.

Section 1402. - Compensation.

The chairman of the BCPC shall be paid $35.00 per month for his/her service as a member of the BCPC. All of the additional members of the BCPC shall be paid $25.00 per month for his/her service as a member of the BCPC. In addition, each member shall be entitled to reimbursement for their mileage for travel while performing services for the BCPC. (Mileage reimbursement rate shall be as approved by the Banks County Commissioners).

Section 1403. - Organization and rules.

A.

The BCPC shall elect its chairman from among its members. The term of the chairman shall be one year with eligibility for reelection.

B.

The BCPC shall appoint a secretary, who may be an officer or employee of the county.

C.

The BCPC shall prepare and maintain minutes of its meetings.

D.

The BCPC shall make its own rules of procedure.

E.

All meetings of the BCPC shall be held no less than five working days prior to the meetings of the Board of Commissioners of Banks County.

F.

All meetings of the BCPC shall be open to the public and all records of the BCPC shall be a public record.

Section 1404. - Powers and duties.

From and after the time when the BCPC shall have organized and selected its officers and shall have adopted its rules of procedure, then the BCPC shall have all the powers, duties and responsibilities specifically provided planning commissions under Georgia law and as specifically provided the BCPC under the resolutions, ordinances and regulations of Banks County, Georgia.
