Section 801.- Purpose and intent.

The C-1, Neighborhood Commercial District is intended to provide areas for limited small-scale commercial uses of a convenience nature serving nearby neighborhoods as opposed to a regional market. The district is not intended to accommodate automotive or other types of more intensive commercial activities that are of such magnitude or type that would result in the generation of excessive traffic, noise, odors, pollution, safety hazards, other nuisances, or other adverse impacts which would detract from the desirability of properties in the area of residential use. In general, the neighborhood commercial district includes offices and retail and service establishments but exclude those highway-oriented uses which involve the use of chemicals or outside sales, storage or display. All structures within the C-1 District shall meet the design standards as stated in Article XVIII of Appendix A pertaining to the Zoning Regulations of the Code of Banks County, Georgia. Hours of operation for businesses within the C-1 District shall be no greater than 5:00 a.m. to 11:00 p.m. No building or structure allowed as a permitted use in Section 802, Article VIII, Appendix A of the Code of Banks County, Georgia, shall exceed 2,500 square feet with outdoor storage yards not to exceed 5,000 square feet.

Section 802. - Permitted uses.

1.

Accessory uses and structures normally incidental to principal permitted uses and structures.

2.

Antique shops.

3.

Art and school supply stores.

4.

Bake shops and bakeries, but not including wholesale.

5.

Banks and financial institutions, including drive-in, drive-through and automatic teller facilities as accessory uses.

6.

Barber shops and beauty shops.

7.

Book or stationery stores.

8.

Churches, temples, synagogues and places of worship, and their customary accessory uses and structures, including cemeteries.

9.

Wedding and event venues—No more than 100-person occupancy.

10.

Clothes pressing, repair, sale and rental, but not including department stores.

11.

Dressmaking, millinery, sewing and tailor shops.

12.

Drug stores.

13.

Electronic equipment sales.

14.

Food catering establishments.

15.

Florist shops.

16.

Gift shops.

17.

Ice cream and yogurt shops.

18.

Interior decorating shops.

19.

Jewelry stores.

20.

Libraries, museums and art galleries.

21.

Locksmith shops.

22.

Photocopying, printing and reproduction services.

23.

Public buildings, uses and utilities.

24.

Radio and television repair shops.

25.

Appliance repair shops.

Toy stores.

Travel agencies.

Watch and clock sales and repair shops.

Feed and feed equipment store.

Nurseries and greenhouses for the growth and sale of plants, trees and shrubs.

Offices, business, medical, professional, insurance and real estate.

Restaurants, which may include outdoor seating areas, but not including drive-ins or drive-through facilities.

Day care centers provided that the owner has proof of registration and licensing as required by the Georgia Department of Human Resources. Playground areas must be surrounded by a four foot safety fence.

Section 803. - Conditional uses.

1.

Automated car washes, as accessory to convenience stores with retail gasoline sales.

2.

Cemeteries.

3.

Civic organizations/clubs, lodges, fraternal institutions and other places of public assembly for membership groups, nonprofit or for profit, that exceed 2,500 square feet of gross floor area.

4.

Convenience food and retail stores with or without retail gasoline sales, not exceeding 10,000 square feet of total floor area, which must be surrounded by an opaque fence buffer along the side and rear property lines.

5.

Paint stores.

6.

Record, tape, and video rental and sales stores.

7.

Recycling collection centers, but not including processing or disposal of recyclable materials.

8.

Single-family dwelling.

9.

Schools, public or private.

10.

Dwellings, multifamily, subject to regulations established in Multifamily Housing Developments of the Banks County Code. For consideration as a conditional use permit, there must be a minimum of ten acres that will be dedicated for multi-family dwellings. (See also Article XVII, Appendix A of the Zoning Regulations of Banks County of the Code of Banks County, Georgia.)

11.

Cultural facilities, including art galleries, museums, theaters (not including movie theaters), libraries, and other uses similar in character to those listed.

12.

Uses permitted in Section 802 that exceed 2,500 square feet, but in no case shall exceed 10,000 square feet. Outdoor storage yards shall not exceed 20,000 square feet and shall be surrounded by an opaque vegetative buffer or opaque fence buffer.

13.

Mini-warehouses and mini-storage facilities, where no individual storage stall or compartment exceeds 400 square feet of total floor area.

14.

Repair of household appliances.
