ARTICLE XII

Fences

Sec. 16-240.- Permit required.

All fences within the Town of Basalt, regardless of location, material type, or height above finished grade, shall require a building permit prior to installation. Permit application will require a current, approved property survey or improvement location certificate prepared by a surveyor licensed in the State of Colorado showing all pertinent property lines, streets, alleys, easements, encroachments and improvements. The Building Official may waive or refine the application contents based on the specific circumstances of the property.

Sec. 16-241. - Barbed wire fences along public streets prohibited.

(a)

No person shall, in this Town, construct or maintain or cause to be constructed or maintained any barbed wire fence upon or along any public street or upon or along any boundary line of any such street or in any manner next to any such street for the purpose of enclosing any private grounds or premises or public ground or for any other purpose whatever. No person shall repair any such fence constructed before the effective date of the ordinance codified in this Chapter.

(b)

In case such fence shall have been constructed before, and be in existence at, the time of the passage of the ordinance codified in this Chapter, the owner thereof shall not be liable therefor until notice is given or served as hereinafter stated and until his or her failure to comply therewith as hereinafter stated. Such notice may be oral or written and may be given or served by the Chief of Police or any other police officer of the Town. Said notice shall notify the person served, or the person to whom the notice shall be given, to remove such fence and thereby abate the nuisance. Such notice, when written, shall be signed by the Chief of Police or any other police officer of the Town. Such notice shall direct that the fence be removed within five (5) days, but this provision shall not be deemed to apply in the case of a person constructing or causing to be constructed any such fence after the taking effect of this Chapter.

Sec. 16-242. - Removal of fences required upon notice.

Any person who shall have possession or control of private or public grounds upon or within which any such fence shall exist, and who may have constructed or caused to be constructed such fence, shall, upon notice given or served as hereinbefore required, remove any such fence and thereby abate the nuisance, and be subject to a penalty for violation upon the failure so to do.

Sec. 16-243. - Removal by Town.

When any such fence shall be found within the Town existing contrary to the provisions of this Chapter, the Chief of Police or any other police officer of the Town shall cause any such fence to be removed and thereby abate the nuisance, and any such officer shall have authority to engage the necessary assistance and incur the necessary expense therefor.
