ARTICLE IV

- R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT

Section 1. - Purpose.

The R-1 district is designed for those areas where the land is presently being used and appears to be desirable for single-family use only. Also, for areas where single-family use is to be encouraged for present or future development.

Section 2. - Use regulations.

In the R-1 district, no building or land shall be used and no building shall be erected or structurally altered (unless otherwise provided in the Municipal Code) except for one (1) or more of the following uses:

A.

One-family dwellings, including modular homes, but not including manufactured or mobile homes, trailers, mobile home parks, or trailer parks.

B.

Churches, convents, rectories, or similar religious institutions.

C.

One-family manufactured homes - double wide, but only if the manufactured home (1) is fabricated and shipped directly from the factory to the site for assembly (no pre-owned or demonstration homes); (2) complies with the minimum requirements of the definition of manufactured home - double wide, contained in Article II herein, (3) complies with Chapter 11 of the Beardstown City Code, and (4) the Commission and Council grant a special use permit allowing this use under this Zoning Ordinance.

D.

Public, parochial, elementary schools and high schools.

E.

Museums, libraries, parks, playgrounds, or public recreation areas not operated or used for commercial purposes, and such public buildings as are necessary for health and safety, including hospitals, provided they meet the requirements stated in Article XI, section 1.

F.

Funeral homes and mortuaries.

G.

Golf courses (except miniature golf courses) and cemeteries.

H.

Agriculture, including farming, truck gardening, orchard, nursery or greenhouse; provided no sales office is maintained in a building separate and apart from a residence or accessory building customarily incident to such use of a residence or that no poultry, swine, or other livestock shall be housed or confined in such a manner as to be objectionable to the surrounding residents or affect the general welfare of the City of Beardstown and are confined within less than two hundred (200) feet of any single-family dwelling and located on a lot containing not less than one (1) acre.

I.

Accessory buildings, including one (1) private garage, in the rear yard or constructed as a part of the main building, but not including the conduct of a business.

J.

Customary home occupations or office when confined to the main building provided no display of products made or sold shall be visible from the street and should not occupy more than twenty (20) per cent of the net floor of the dwelling.

K.

Public utilities and governmental buildings, including substations, regulator stations, pumping stations, radio and television transmitter or tower, transmission lines, water filtrations plant and storage reservoir, or other similar public service uses.

L.

Signs as permitted in Article XI.

Section 3. - Height regulations.

No height regulations required.

Section 4. - Area regulations.

A.

Front yards: Except as otherwise provided in this ordinance, there shall be a front yard having a depth of not less than twenty-five (25) per cent of the average depth of the lot or thirteen (13) feet, whichever is smaller. However, when lots comprising forty (40) per cent or more of the frontage between two (2) intersecting streets are developed with buildings having a front yard less than normally required and with a variation in depth of not more than ten (10) feet, no building hereinafter erected or structurally altered shall be required to have a front yard greater than the average front yard line so established.

B.

Side yards:

1.

Except as otherwise provided in this ordinance, on interior lots there shall be a side yard having a width of not less than ten (10) per cent of the average width of the lot or five (5) feet, whichever is smaller.

2.

On corner lots the side yard requirement shall be the same as for interior lots, except in cases where the lot backs up to an abutting side yard then the side yard requirement shall be the same as the front yard requirement; and when the lot backs up to an abutting rear yard, the side yard requirement shall be ten (10) feet.

C.

Rear yards: There shall be a rear yard having a depth of not less than thirty (30) per cent of the average depth of the lot or twenty (20) feet, whichever is smaller.

D.

Lot area, single-family dwelling: Every lot for a single-family dwelling shall have an area not less than five thousand seven hundred fifty (5,750) square feet, except that if a lot of record prior to the adoption of this ordinance has less area and has been duly platted and recorded in the office of the Recorder of Deeds for Cass County, Illinois, such lot may be used for a single-family dwelling.

E.

Lot area, other uses: Any use allowed other than a single-family dwelling shall have a minimum lot area of five thousand seven hundred fifty (5,750) square feet.

F.

Lot coverage: The combined building area of the main building and the accessory building shall not cover more than forty (40) per cent of the total area.

G.

Lot width: All lots platted in the R-1 district shall have an average width of not less than fifty-five (55) feet measured along the building line.

H.

Destruction of lots of record: Notwithstanding anything to the contrary contained herein, the owner of a lot of record with an average width of less than fifty-five (55) feet measured along the building line, who has experienced the partial or total destruction of a dwelling located thereon shall be allowed to rebuild to the extent necessary upon existing foundations, where he cannot conform to lot area, lot coverage, side yard, rear yard, front yard, or lot width requirements.

I.

Dwelling standards: Every dwelling hereinafter erected shall have a total ground area of not less than eight hundred forty (840) square feet measured from the outside of the exterior walls, including utility rooms, but excluding cellars, basements, open porches, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes.
