ARTICLE XII

STADIUM, CONVENTION AND RECREATION DISTRICTS

Sec. 232-561. - [Conditional uses.]

In convention stadium districts any use shall be considered a conditional use and the following regulations shall apply:

(1)

Use regulations. Buildings may be erected or used and a lot may be used or occupied for a commercial stadium, a convention center, or both and no other:

a.

[Stadium use only.] When the district is to be used for Stadium purposes only, the following use regulations shall apply:

1.

Stadium for events including but not limited to baseball, football, horse racing, basketball, soccer, prize fighting, and wrestling.

(i) As incidental uses to any of the aforementioned uses a building or lot may be used for:

(1) Restaurant

(2) Retail store or establishment

(3) Office

(4) Personal service shops

(5) Keeping and stabling of horses

(6) Pari-mutuel betting

2.

Accessory uses on the same lot with and customarily incidental to any of the above permitted uses and signs when erected and maintained in accordance with the provisions of article XIV of this chapter.

b.

[Convention center use only.] When the district is to be used for convention center purposes only, the following use regulations shall apply:

1.

A convention center which shall include hotel and facilities of not less than 300 units together with a large meeting hall, recreation facilities, banquet facilities for a minimum of 500 persons.

2.

Accessory Uses on the same lot with and customarily incidental to a convention center shall be permitted provided that such accessory use does not occupy more than ten percent of the area of the main use, and does not include open air storage of any materials and signs when erected and maintained in accordance with the provisions of article XIV of this chapter.

(2)

[Area, yard and height regulations.]

a.

[Stadium use only.] When the district is to be used for Stadium purposes only, the following area, yard and height regulations shall apply:

1.

Area. A tract of ground of not less than 100 acres shall be provided.

2.

Yards. No construction other than driveways shall occur within 200 feet of any property line or ultimate right-of-way line.

3.

Height. No building shall exceed 100 feet in height.

b.

[Convention center use only.] When the district is to be used for convention center purposes only, area, yard and height regulations shall apply:

1.

Area. A tract of ground of not less than 50 acres shall be provided.

2.

Yards. No construction other than driveways shall occur within 100 feet of any property line or ultimate right-of-way line.

3.

Height. No building shall exceed 100 feet in height.

4.

Spacing requirements of structures. A buildings may be connected. However, when they are not, the distance between buildings shall be 75 feet.

c.

[Stadium and convention center use.] If the district is to be used for both stadium and convention center, subsections 232-561(2)a.1., 2., 3. and subsection 232-561(2)b.4. shall be used for area, yard and height requirements.

(3)

Site Access. Access to site shall be limited to minor arterial, major arterial and expressways only.

Sec. 232-562. - Special application review committee.

(a)

Conditional use application. Prior to any conditional use application in this district, the applicant is strongly urged to submit a preliminary conceptual plan to the Bensalem Township Building and Planning Department. At the next scheduled Bensalem Township Council meeting, the director of codes enforcement shall notify Council of the receipt of the preliminary conceptual plan. Upon notification, Council shall appoint a special ad hoc application review committee which shall consist of at least the following five members:

(1)

Member of Council.

(2)

Member of Mayors staff.

(3)

Member of Bensalem Township Planning Commission.

(4)

Township Engineer.

(5)

Individual selected by Council.

(b)

Duties of application review committee. The committee shall review the preliminary conceptual plan for conformance with national stadium or convention center standards, layout and design; impact upon abutting properties, neighborhoods and the Township as a whole. The review shall consider such issues as economic analysis, traffic impact, parking, sewer and water availability, environmental impacts, landscaping and buffer areas and general land use.

(c)

Special committee review time limitations. The committee shall conclude their review and submit their recommendations to the applicant, Council, and building and planning department within 90 days of empanelment.

(d)

[Submitting application to council.] Upon completion of the above special committee review process, the applicant may submit the conditional use application to the Bensalem Township Council.

(e)

[Compliance.] Should the Bensalem Township Council approve the conditional use request, the applicant shall submit plans in compliance with the Bensalem Township Subdivision and Land Development Ordinance No. 268, as amended, and all other applicable sections of the zoning code. In addition to the above, the minimum information or reports required with the land development application shall be:

(1)

Traffic impact study.

(2)

Environmental impact study to include be not limited to:

a.

Noise;

b.

Air quality;

c.

Water quality; [and/or]

(3)

Recreation.

Sec. 232-563. - Construction staging.

The Bensalem Township Council may make provisions for the construction of said facilities to be made in stages providing a full plan of development is approved and each stage complies in all respects with the provisions of the Zoning Ordinance and the Subdivision and Land Development Ordinance.

Sec. 232-564. - Parking.

Parking shall be computed on-site uses pursuant to article XIII, section 232-586.

Sec. 232-571. - Statement of purpose.

REC recreational districts are designed to provide open space areas for recreational activities while preserving natural resources and environmental features to the fullest extent possible pursuant to article I, section 232-2.

Sec. 232-572. - Use regulations.

(a)

REC lots may be used for any of the following uses, either separately or in combination, and no others:

(1)

Golf course.

(2)

Swim club.

(3)

Marina.

(4)

Athletic field.

(5)

Park.

(b)

Accessory buildings. Buildings customarily incidental to the uses listed above are permitted pursuant to meeting the area regulations listed in section 232-572 below.

Sec. 232-573. - Area regulations.

(a)

Lot area. An REC lot of not less than one acre shall be provided for the uses permitted in this district.

(b)

Lot frontage and width. Each lot shall have a minimum street frontage and width of not less than 150 feet at the BSBL.

(c)

Building area. Nor more than 20 percent of each lot may be occupied by buildings.

(d)

Impervious surfaces or cover. Not more than 35 percent of each lot may be impervious surface including the building area.

(e)

Yards. Where a building is erected to serve an REC use, front, side and rear yard shall be provided as follows:

(1)

Front, side and rear yards shall each be not less than 50 feet in depth except that the yard shall be not less than 75 feet when the yard is adjacent to a residential district.

(f)

Height regulations. No building in the REC district shall exceed 35 feet in height.

(g)

Parking. Parking shall be provided pursuant to article XIII, section 232-586.
