CHAPTER 12

OFF STREET PARKING AND LOADING

12-12A-1: AUTHORIZATION:

Subject to the limitations of this article, off street parking is permitted as an accessory use in all districts. Off street parking as a principal use is permitted only when expressly authorized by the regulations applicable to the district in question. Nothing in this article shall be construed to limit the right of any person to provide off street parking in excess of the requirements herein established but all such parking shall comply with the standards of this article. All parking area design shall be reviewed and approved by the zoning administrator. (2005 Zoning Code)

12-12A-2: APPLICABILITY TO EXISTING, NEW AND EXPANDED USES:

   A.   General Applicability: Except as provided otherwise in this section, the provisions of this article shall apply to, and off street parking spaces sufficient to satisfy the requirements of this article shall be provided for, all existing and new uses.
   B.   Change In Existing Use: Whenever a use existing on the effective date hereof is changed thereafter to a new use, parking facilities shall be provided as required herein for such new use; provided, however, that when any such existing use was deficient in required parking spaces on such effective date, such new use may be established with a deficiency in required parking spaces equal in number to not more than such preexisting deficiency.
   C.   Increase In Use Intensity: Whenever the intensity of use of any structure or use is increased through the addition of dwelling units, floor area, seating capacity, or other units of measurement specified herein for required parking spaces, parking spaces as required herein shall be provided for such increase in intensity of use.
   D.   Minor Additions: Notwithstanding the foregoing provisions of this section, no building or use lawfully existing on the effective date hereof, or any amendment hereto establishing parking requirements with respect to such structure or use, shall be required to provide any additional parking spaces pursuant to this section unless and until the aggregate increase in the units of measurement by which the parking requirement is calculated shall equal ten percent (10%) or more of the units of measurement required upon such effective date, in which event parking spaces as required herein shall be provided for the total aggregate increase.
   E.   Accessory Use: Nothing in this section shall be construed to prohibit the continued utilization of any parking space as an accessory use to any structure or use for parking of a vehicle that may be lawfully parked in such space solely because such space does not satisfy the locational or design requirements of this title, or any amendment hereto, if such space was validly in use as an accessory use to such structure or use on the effective date of this title or such amendment. 12-12A-3: LOCATION OF REQUIRED PARKING SPACES:

   A.   General Rule:
      1.   Except as provided in subsections B and C of this section, parking spaces required by this article shall be located on the same zoning lot as the use to which they are accessory.
      2.   Off street parking spaces may be provided on surface lots, underground, under a building, or in parking structures. Parking lots, areas, and garages shall comply with the yard requirements made applicable to them by the regulations of the district in which they are located.
   B.   Parking For Townhouses: Not more than two (2) parking spaces located in a garage, driveway, or other area reserved for the exclusive use of the residents of an individual dwelling unit shall be counted toward the parking spaces required pursuant to subsection 12-12A-12A1 of this article. Not more than two (2) spaces required by said subsection may, and at least one such space shall, be located in an area or areas available for use in common by at least three (3) such individual units. Such areas may include parking spaces located in parking areas or lots within the development in which such units are located, whether located on or off the lot on which such units are located; provided, however, that no such required space shall be located farther than three hundred feet (300'), measured along an established pedestrian circulation route, from the unit it is required to serve.
   C.   Deficiency Spaces: When proposed to eliminate a parking deficiency or when required because of a change in use or an increase in use intensity pursuant to subsection 12-12A-2B or C of this article, parking spaces may be located within any district adjacent to the district in which the principal use in question is a permitted use, or within the same zoning district as, and within one thousand feet (1,000') of, the zoning lot on which the use to be served is located; provided, however, that such remote parking spaces may be allowed only when such remote site is covenanted to remain as parking for so long as said parking spaces are required to meet the standards of this title.
   D.   Parking In Yards: Off street parking spaces, open to the sky, may be located in required interior side yards and rear yards. In all business districts, the required off street parking spaces may be located in a front yard adjoining a street, not less than ten feet (10') from a lot line or may be located in a side yard adjoining a street, not less than five feet (5') from a lot line. 12-12A-4: DESIGN AND MAINTENANCE:

   A.   Design:
      1.   Space Dimensions:
         a.   Each off street parking space, excluding its associated circulation aisle, shall have the following minimum dimensions, in feet and inches:

         b.   The stall width dimensions shall be increased to sixteen feet (16') for required handicapped parking spaces or to the width required under applicable state law, whichever is greater.
         c.   The stall dimensions shall be reduced by one-half foot (1/2') in length and one-half foot (1/2') in width for commuter parking lots and structures.
         d.   Except for parallel parking spaces, the stall dimensions may be reduced by one-half foot (1/2') in length and width in parking lots and structures accessory to office and institutional uses where the planning and zoning commission finds that the typical parking space in such lot or structure will not be occupied by more than two (2) different vehicles during the course of the business day.
      2.   Access To Street:
         a.   Least Interference: All parking lots, areas, and garages shall be so located and designed as to provide access to adjacent streets with the least interference with through traffic movements.
         b.   Driveways:
            (1)   Driveways shall have return radii of twenty feet (20') at the point of access to the street.
            (2)   Notwithstanding any other provision of this title, driveways serving single-family dwellings and driveways providing direct access from a parking lot to a street (and not serving as a circulation aisle) may traverse any required yard. The surface area of any such driveway from a parking lot to a street shall not exceed an area calculated by multiplying the width of the driveway times the depth of the required yard times a factor of 1.5.
         c.   Curb Cut Width: No curb cut across public property shall exceed thirty feet (30') without the written approval of the zoning administrator.
         d.   Access Across Separate Zoning Lot: No access to an adjacent street shall be provided through a zoning lot, other than the zoning lot on which the parking lot is located, except across a permanent, recorded access easement in form and substance satisfactory to the village attorney.
      3.   Turnaround Area: Every parking lot or garage, other than a parking lot or garage accessory to a single-family dwelling, shall be provided with a turnaround area or other means to permit cars to exit the parking lot or garage without backing onto any street or sidewalk.
      4.   Surface, Drainage And Markings:
         a.   Every off street parking lot and garage shall be surfaced with a bituminous or portland cement concrete pavement providing all weather, durable, and dustless surface. Unless otherwise approved by the village engineer, such construction shall meet the following minimum standards for structural materials derived from the "Illinois Department Of Transportation Manual", current edition:
            (1)   For parking areas designed and intended principally for passenger automobiles, a minimum coefficient rating of 2.25.
            (2)   For parking areas designed and intended for vehicles other than the above, a minimum coefficient rating of 2.40.
         b.   All parking surfaces shall be graded and drained to dispose of surface water accumulation by means of a positive stormwater drainage system connected to a public stormwater sewer system. Individual stalls shall be clearly identified by painted markings four inches (4") to six inches (6") in width.
      5.   Car Stops: Every parking lot and garage, except that accessory to a single-family dwelling, shall be provided with curbs, car wheel stops, guardrails, barrier fences, or other suitable devices designed and located to protect required screening devices, landscaping, and structures from damage by vehicles using such lot or garage. This provision shall not be construed to require car wheel stops for every parking space, but only in those cases where the zoning administrator determines that such stops are necessary or desirable to achieve the purposes of this subsection B5.
      6.   Circulation Aisles: Each parking space, except spaces accessory to a single-family dwelling, shall be accessed by a circulation aisle of a width, in feet and inches, as specified below:

      7.   Tandem Spaces: No parking spaces shall be designed in tandem so that ingress to or egress from one space is blocked by a second space, except for spaces accessory to single-family or multiple-family dwelling units.
      8.   Back Up Area: Each parking space, except spaces accessory to a single-family dwelling, shall be provided with a sufficient back up area to permit egress in one maneuver, consisting of one backward and one forward movement, and shall be designed so that no vehicle is required to back up onto any street.
      9.   Lighting: Fixed lighting shall be provided for all parking lots and garages accommodating more than ten (10) vehicles. Such lighting shall be so arranged as to prevent direct glare of beams onto any public or private property or streets by the use of luminare cutoffs. All lighting shall be reduced to security levels at all times of nonuse.
      10.   Tree Planting Areas And Islands: Trees located within planting islands in paved areas shall have a minimum landscaped area of at least thirty six (36) square feet of surface area and a depth sufficient to allow the bottom of the tree ball to be planted with a washed gravel layer at the bottom of the tree planting area to allow proper drainage. If the soil is impervious, then a drainage pipe shall connect the tree planting area to a drainage structure.
   B.   Maintenance: All tree planting areas, parking lots, garages, and areas shall be properly maintained at all times so as to be free of potholes, broken curbs, and other damaged or neglected features. (2005 Zoning Code)

12-12A-5: COMPUTATION OF REQUIRED SPACES:

   A.   Fractional Spaces: When determination of the number of required parking spaces results in the requirement of a fractional space, any fraction shall require one additional parking space.
   B.   Capacity Calculations: When parking spaces are required on the basis of capacity, capacity shall be determined based on the occupancy standards established by the village building code.
   C.   Bench Seating: In houses of worship and other places of assembly in which patrons or spectators occupy benches, pews, or other similar seating facilities, each eighteen inches (18") of such seating facility shall be counted as one seat for the purpose of determining the requirement for off street parking facilities under this title.
   D.   Population Calculations: When parking spaces are required on the basis of the number of customers, students, or similar measure, the maximum number for which the structure is designed shall govern, except that when the structure has no design capacity, the maximum number present at any one time shall govern. When parking spaces are required on the basis of the number of employees, the number of employees working during the largest shift shall govern. (2005 Zoning Code)

12-12A-6: USE OF LOTS OR GARAGES RESTRICTED:

No off street parking lot or garage shall be used for any purpose other than the temporary storage of motor vehicles related to the premises. The storage of merchandise and the sale or commercial repair of vehicles are prohibited. (2005 Zoning Code)

12-12A-7: ACCESSORY PARKING IN SINGLE-FAMILY RESIDENTIAL DISTRICTS:

Except when approved as part of a special use permit application, parking lots shall not be permitted as an accessory use in any single-family residential district. (2005 Zoning Code)

12-12A-8: PARKING REGULATIONS IN RESIDENTIAL DISTRICTS:

   A.   Commercial Vehicle Parking: Parking of commercial vehicles in residential districts is not permitted, except under the conditions stated below in this section. A commercial vehicle is any vehicle operated for the transportation of persons or property in the furtherance of any commercial or industrial enterprise, for hire or not for hire, but not including a commuter van used in a ridesharing arrangement. A commercial vehicle shall include a vehicle with signs, advertisements or business identification on the vehicle.
      1.   No more than two (2) commercial vehicles, as permitted herein, shall be parked on a single-family residentially zoned lot unless said vehicle can be placed completely within an enclosed garage.
      2.   No more than one commercial vehicle per residential unit shall be permitted in a multiple-family residential development unless said vehicles can be placed completely within an enclosed garage.
      3.   No commercial vehicle, having a gross weight in pounds, including vehicle and maximum load, in excess of eight thousand one (8,001) pounds and bearing a class designation other than B under the provisions of the Illinois vehicle code shall be parked or stored on any residential premises in a residential district, except when making a delivery or rendering a service at such premises or as permitted in subsection A4 of this section.
      4.   a. No commercial vehicle having a gross weight when fully loaded of twelve thousand (12,000) pounds or less, including those within such weight bearing a classification of D under the provisions of the Illinois vehicle code and displaying a current Illinois state inspection sticker, shall be parked or stored on any residential premises in a residential district unless the vehicle shall not exceed twenty four feet (24') in length or nine feet (9') in height as measured from the surface at ground level nearest the vehicle, except when making a delivery or rendering a service at such premises.
         b.   Not more than two (2) taxis or limousines, only one of which may have a stretched body, may be parked on a residentially zoned lot, except when making a delivery or rendering a service at such premises.
         c.   Not more than one tow truck of not more than twenty four feet (24') in length may be parked on a residentially zoned lot, except when rendering a service at such premises.
         d.   Snowplows shall be permitted on the front of commercial vehicles during the winter season and shall be removed and properly stored not in public view or inside a building by April 15.
      5.   The use of plywood or other materials that are not commercial grade original manufactured equipment as a bed riser, height extender, or equipment enclosure on a permitted commercial vehicle is prohibited.
      6.   No commercial trailer shall be parked or stored on any residential premises in a residential district.
      7.   All commercial vehicles permitted by this section to be parked in a residential zoning classification shall display plate classification on the front and rear of the vehicle at all times and be parked on a permanent paved surface as otherwise required by this code.
   B.   Off Site Parking: All proposals to provide required parking on a site other than the zoning lot of which the proposed use is to be established shall be a special use subject to the provisions provided herein for special uses.
   C.   Use Of Parking And Loading Facilities:
      1.   It shall be unlawful for any person to park a vehicle or place goods or materials upon any nonresidential off street parking or loading area for the purpose of displaying it for sale except where such vehicle, goods or materials are on property where their sale or storage is a lawfully permitted use.
      2.   It shall be unlawful to park any vehicle except upon an off street parking space or loading area in compliance with requirements herein.
      3.   Whenever any vehicle is parked in violation of subsection C1 or C2 of this section the person in whose name such vehicle is registered shall be prima facie responsible for such violation.
   D.   General Regulations And Standards: The following standards and regulations shall apply to the parking of vehicles in a residential district:
      1.   Distance From Lot Line And Public Sidewalk: No vehicle shall be stored within three feet (3') of any lot line or any vehicular or pedestrian right of way.
      2.   Surface: Vehicular off street parking and loading on or across grassy areas, lawns, open space or landscaped areas shall be expressly prohibited. All vehicular off street parking, loading, access driveways and access aisles shall be comprised of and constructed of dustless, all weather material of either asphalt, concrete, brick, paving block or similar impervious surfaces.
Notwithstanding any other provisions of this code, driveways serving single-family dwellings and driveways providing direct access from a parking lot to a street (and not serving as a circulation aisle), may traverse any required yard. Impervious surface area for driveways, walks and patios shall not exceed fifty percent (50%) of the required front yard of residential properties. The surface area of any driveway from a parking lot to a street shall not exceed an area calculated by multiplying the width of the driveway times the depth of the required yard times a factor of one and one-half (1.5).
      3.   Permanent Location Prohibited: No vehicle shall have its wheels removed or be affixed to the ground so as to prevent its ready removal.
      4.   Residential Use Prohibited: No vehicle shall be used for living, sleeping, or housekeeping purposes.
      5.   Utility Hookups: No vehicle shall be connected to any public utility, except for required servicing.
      6.   Unsafe Conditions: No vehicle shall be parked or stored so as to create a dangerous or unsafe condition. The ground under or surrounding the location wherein a vehicle is stored shall be free of noxious weeds, debris, and combustible material. (Ord. 14-8, 7-1-2014)

12-12A-9: STORAGE OF INOPERABLE VEHICLES:

No vehicle incapable of being driven or used for the purpose or use for which it was designed, other than a vehicle awaiting timely repair at an automotive repair shop, gasoline service station, or new or used car dealer, shall be stored in any parking lot or parking area in the village. 12-12A-10: BUFFERS AND LANDSCAPING:

   A.   Parking Lot Screening: Every parking lot shall be buffered and screened by a perimeter landscaped open space having a width of at least ten feet (10') or the width of the required yard, whichever is less.
   B.   Parking Lot Interior Landscaping:
      1.   In addition to the requirements set forth in subsection A of this section, every parking lot shall contain at least one tree of three inches (3") or greater in diameter for each thirty (30) parking spaces constructed after the effective date hereof. Such trees may be provided by the preservation of existing trees or the planting of new trees. Each tree shall be surrounded by a landscaped area of at least thirty six (36) square feet. No existing or new tree located more than five feet (5') outside the perimeter of the paved parking area shall be counted in meeting the requirements of this subsection. All islands in excess of fifty (50) square feet created by curbs or other traffic flow regulators shall be landscaped.
      2.   Planting islands located within the interior of a parking lot shall be at least six feet (6') in width.
   C.   Parking Garage Design: Every parking garage constructed after the effective date hereof, other than garages accessory to single-family dwellings, shall comply with the following design standards:
      1.   The exterior walls of the garage shall be such as to shield all parked vehicles from view from the exterior of the garage; and
      2.   The exterior surface of the garage shall be constructed of the same materials as, or materials architecturally and aesthetically compatible with, the principal building to which it is accessory. (2005 Zoning Code)

12-12A-11: CONTROL OF OFF SITE PARKING FACILITIES:

   A.   Lot Ownership Requirements: In cases where parking facilities are permitted on a lot other than the lot on which the structure or use served is located, the owner of record of such lot shall be the same as the owner of record of the lot occupied by the structure or use in which the parking facilities are accessory. A covenant running with the land must be recorded in the office of the recorder of deeds of Cook County, on the lot upon which the accessory off street parking is located which prohibits any other use on that lot, and a copy of the recorded covenant certified by the recorder of deeds of Cook County must be deposited with the zoning administrator. The covenant shall not be released until such time as either one of the following conditions occurs:
      1.   The structure on the lot containing the principal use is removed and the principal use terminated; or
      2.   Another lot of the required size within the required distance is properly developed and used for the required accessory off street parking in place of and in lieu of the initial lot used for accessory off street parking with the same requirements, covenants, and conditions attaching to such substitute accessory use lot as approved by the same authority as required for approval of such initial lot.
   B.   Parking Plan or Lease Agreement: As an alternate, the required off site parking spaces may be provided either through:
      1.   A parking plan approved by the Zoning, Administrator, which the Zoning Administrator may approve, condition, modify and revoke from time to time; or
      2.   A five (5) year lease, with an option to renew for another five (5) years if the business is still in operation, which lease shall be reviewed by the Planning and Zoning Commission and must be approved by the corporate authorities.
   C.   Maximum Distance Between Principal Use And Off Site Parking: In no event shall off site parking be more than three hundred (300) linear feet, as measured along: 1) the common street frontage; or 2) as measured from the nearest property line on each lot between the principal use served and the off site parking lot property. 12-12A-12: REQUIRED PARKING SPACES:

   B.   Unspecified Uses: When the ultimate use of a structure is not known, the maximum number of spaces that might be required for any use to which the structure might reasonably be devoted shall be provided.

12-12A-13: PARKING SPACES AT AUTOMOTIVE REPAIR SHOPS:

   Notwithstanding any minimum number of required parking spaces set forth in this Title, an automotive repair shop is limited to no more than one parking space per employee and two (2) parking spaces per service bay. Parking spaces at automotive repair shops are not subject to the benefits of the legal nonconformity provisions of Chapter 12-14, and such spaces legally in existence as of , 2024. and not conforming with an regulations and requirements of the village's Zoning Code, must be brought into compliance with the Zoning Code not later than , 202 .

12-12B-1: AUTHORIZATION:

Subject to the limitations of this article, off street loading is permitted as an accessory use in all districts other than the single-family residential district. Nothing herein shall be construed to limit the right of any person to provide off street loading in excess of the requirements herein established, but all such loading shall comply with the standards of this article. 12-12B-2: APPLICABILITY TO EXISTING, NEW AND EXPANDED USES:

   A.   General Applicability: Except as provided otherwise in this section, the provisions of this article shall apply to, and off street loading spaces sufficient to satisfy the requirements of this article shall be provided for, all existing and new uses, in accordance with the provisions of this title.
   B.   Change In Existing Use: Whenever a use existing on the effective date hereof is changed thereafter to a new use, loading facilities shall be provided as required herein for such new use.
   C.   Increase In Use Intensity: Whenever the intensity of use of any structure or use is increased through the addition of dwelling units, floor area, seating capacity, or other units of measurement specified herein for required loading spaces, loading spaces as required herein shall be provided.
   D.   Exception: Notwithstanding the foregoing provisions of this section, no building or use lawfully existing on the effective date hereof, or any amendment hereto, establishing loading requirements with respect to such structure or use, shall be required to provide any additional loading spaces unless and until the aggregate increase in units of measurement shall equal the full number of units for which one additional loading space would be required pursuant to section 12-12B-4 of this article, in which event loading spaces as required herein shall be provided for the total aggregate increase. 12-12B-3: LOCATION, DESIGN AND MAINTENANCE:

Every loading space shall be designed, constructed, and maintained in accordance with the standards and requirements herein set forth:
   A.   Location:
      1.   Loading spaces shall be located on the same zoning lot as the use they serve.
      2.   All loading spaces shall comply with the yard requirements applicable to principal uses in the district in which they are located, except that open loading spaces may be located in a required rear yard.
      3.   No loading space shall be located within fifty feet (50') of the nearest point of intersection of any two (2) public or private streets.
      4.   No loading space shall be located closer to any public right of way than the facade of the building facing such right of way. No loading space shall open onto any building facade facing a public right of way. All loading spaces shall be located and arranged to provide logical and convenient access thereto from the use they serve.
   B.   Access To Street: Loading spaces shall be designed and arranged to provide access to a street or alley in a manner that will create the least possible interference with through traffic movements. No curb cut across public property shall exceed thirty feet (30') in width without the written approval of the zoning administrator.
   C.   Maneuvering Space: Every loading space shall be provided with sufficient maneuvering space on the zoning lot where it is located to allow vehicles to access and exit the space without having to make any backing movement on or into any public or private street.
   D.   Surface, Drainage And Markings:
      1.   Every loading space shall be surfaced with an asphaltic or portland cement pavement providing an all weather, durable, and dustless surface.
      2.   Unless otherwise approved by the village engineer, such construction shall have a coefficient rating of 2.5 for structural materials as derived from the "Illinois Department Of Transportation Design Manual", current edition.
      3.   All loading space surfaces shall be graded and drained to dispose of surface water accumulation by means of a positive stormwater drainage system connected to a public sewer system.
      4.   Individual stalls shall be clearly identified by markings four inches (4") to six inches (6") in width.
   E.   Lighting: Fixed lighting shall be so arranged as to prevent direct glare of beams onto any public or private property or streets by the use of luminaire cutoffs. All lighting shall be reduced to security levels at all times of nonuse.
   F.   Dimensions And Size Of Spaces:
      1.   Dimensions: Each loading space, excluding required maneuvering areas, shall have the following minimum dimensions, in feet:

10W x 25L x 14H
 
      2.   Size: Unless waived by the zoning administrator, the first space required for any building having in excess of ten thousand (10,000) square feet shall be sized to accommodate a tractor trailer and, unless otherwise required by the zoning administrator, all other spaces may be standard size. The decision of the zoning administrator shall be based upon the anticipated needs of each particular building. (2005 Zoning Code)

12-12B-4: REQUIRED LOADING SPACES:

   A.   General Requirement: Loading spaces or receiving areas shall be provided in sufficient number, of sufficient size, and so located that no loading and unloading operations infringe upon any street or sidewalk.
   B.   Minimum Requirements: For the following uses, the following minimum number of loading spaces shall be provided:

1 for first 10,000 to 140,000 square feet of gross floor area, plus 1 for each additional 100,000 square feet of gross floor area up to total of 500,000 square feet, plus 1 for each additional 500,000 square feet of gross floor area or any fraction thereof
Other uses
 
1 for the first 150,000 square feet of gross floor area or fraction thereof, plus 1 for each additional 200,000 square feet of floor area or fraction thereof
