Anything in this chapter of the Code of the Town of Bethany Beach to the contrary notwithstanding, any property in the R-1B Zoning District, the eastern property line of which does not abut a street (hereinafter "subject lot") shall be permitted to construct, reconstruct, replace, or extend an open deck or open cantilevered balcony:
A. Into and over the required seven-foot side yard setback on the eastern side of each subject lot; and
B. Into the seven-foot easement (created by deed restriction in favor of each subject lot) located along the westerly seven feet of the lot immediately abutting the subject lot's eastern property line. For purposes of this §
425-54, "open deck" or "open cantilevered balconies" shall mean a deck or cantilevered balcony which is unenclosed by any roof or walls (excepting the eastern wall of the building to which the deck or balcony is attached); but shall not prohibit the placement of posts, railings, spindles, and the like, not exceeding 42 inches in height, of a substantially open design and appearance, as necessary to meet building and safety codes.
