ARTICLE IX

R1-B Sea Villas Residential District

§ 425-52 Permitted uses. [1]

Uses permitted in the R1-B District shall be those permitted in the R-1 Residential District except as otherwise provided. Subject to the provisions of § 425-54 hereafter, all of the use regulations governing land, buildings and structures in the R-1 Residential District as set forth in this chapter shall apply to and govern land, buildings and structures in the R-1B Residential District, the same as if such regulations were fully repeated and set out in this article.

§ 425-53 Dimensional regulations. [1]

Subject to the provisions of § 425-54 hereafter, all of the dimensional regulations governing land, buildings and structures in the R-1 Residential District, as set forth in this chapter of the Code of the Town of Bethany Beach, shall apply to and govern land, buildings and structures in the R-1B Residential District, the same as if fully repeated and set out in this article, except that the provisions of § 425-54 shall supersede and control in the R-1B Sea Villas Residential District.

§ 425-54 Reconstruction, repair, renovation or remodeling of existing buildings and structures.

Anything in this chapter of the Code of the Town of Bethany Beach to the contrary notwithstanding, any property in the R-1B Zoning District, the eastern property line of which does not abut a street (hereinafter "subject lot") shall be permitted to construct, reconstruct, replace, or extend an open deck or open cantilevered balcony:
A. 
Into and over the required seven-foot side yard setback on the eastern side of each subject lot; and
B. 
Into the seven-foot easement (created by deed restriction in favor of each subject lot) located along the westerly seven feet of the lot immediately abutting the subject lot's eastern property line. For purposes of this § 425-54, "open deck" or "open cantilevered balconies" shall mean a deck or cantilevered balcony which is unenclosed by any roof or walls (excepting the eastern wall of the building to which the deck or balcony is attached); but shall not prohibit the placement of posts, railings, spindles, and the like, not exceeding 42 inches in height, of a substantially open design and appearance, as necessary to meet building and safety codes.
