08.- DEFINITIONS
The following words, terms and phrases, when used in this title, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Apartment means any building or portion thereof which is designed and built as a house or residence for three or more families living independently of each other.

Boardinghouse is a dwelling other than a hotel, where lodging and/or meals for three or more persons is provided for compensation.

Building means any structure having a roof supported by columns or by walls and designed for the shelter or housing of any person, animal or chattel and having a fixed location upon the ground.

Building, accessory, means a subordinate building, including shelters or pools, the use of which is incidental to that of the main building on the same lot and/or building site.

Building, main, means a building in which is conducted the principal use of the lot and/or building site on which it is situated.

Building site means a lot or parcel of land, in single or joint ownership, and occupied or to be occupied by a main building and accessory buildings, or by a dwelling group and its accessory buildings, together with such open spaces as are required by the terms of this title and having its principal frontage on a street, road or highway.

Cottage food operation means an enterprise at a private home where low-risk food products are prepared or packaged for public consumption, as defined in the Health and Safety Code § 113758.

District means a portion of the city within which certain uses of land and buildings are permitted or prohibited and within which certain yards and other spaces are required and certain limits are established for buildings, all as set forth and specified in this title.

Dwelling means a building or portion thereof designed and used exclusively for residential occupancy, including one-family, two-family, apartments, multiple-family dwellings, but not including hotels, motels or boardinghouses.

Dwelling, multiple, means a building or portion thereof, used and designed as a residence for three or more families living independently of each other and doing their own cooking in the building, including apartment houses, apartment hotels and flats, but not motels, boardinghouses and hotels.

Electronic cigarette means an electronic and/or battery-operated device, intended to emulate smoking that can be used to deliver or used to provide an inhaled dose of vapors including nicotine and/or other substances. The term includes any such device manufactured, distributed, marketed, or sold as an electronic cigarette, an electronic cigar, an electronic cigarillo, an electronic pipe, an electronic hookah, or any other product name or descriptor. The term "electronic cigarette" does not include any medical inhaler prescribed by a licensed doctor.

Emergency shelter, as provided in Health and Safety Code § 50801, means housing with minimal supportive services for homeless persons that is limited to occupancy of six months or less by a homeless person. The term "emergency shelter" specifically does not include:
A.
Residential care facilities for the elderly as defined in Health and Safety Code § 1569.2;
B.
Residential care facilities as defined in Health and Safety Code § 1568.01;
C.
Community care facility as defined in Health and Safety Code § 1502;
D.
Residential hotels as defined in Health and Safety Code § 50519;
E.
Residential living unit as defined in Health and Safety Code § 1771;
F.
Group homes as defined in Welfare and Institutions Code § 11400, or other similar facilities.

Supportive housing means permanent rental housing linked to a range of support services designed to enable residents to maintain stable housing and lead fuller lives and typically linked to on-site or off-site services that support residents in maintaining the housing, improving their health and maximizing their ability to live independently and, when possible, to work within the community.

Transitional housing means a type of supportive housing used to facilitate the movement of homeless individuals and families to permanent housing.

Dwelling, single-family, means a building designed for or used to house not more than one family, including all necessary employees of such family.

Accessory dwelling unit, as defined in Government Code § 65852.2, means an attached or a detached residential dwelling unit that provides complete independent living facilities for one or more persons and is located on a lot with a proposed or existing primary residence. The term "accessory dwelling unit" includes permanent provisions for living, sleeping, eating, cooking, and sanitation on the same parcel as the single-family or multifamily dwelling is or will be situated. An accessory dwelling unit also includes an efficiency unit and a manufactured home as defined in Health and Safety Code § 18007.

Garage or carport means accessible and usable covered space of not less than nine feet by 20 feet for each storage of an automobile.

Guesthouse means detached living quarters of a permanent type of construction and without kitchen or cooking facilities and where no compensation in any form is received or paid.

Health club or gymnasium means a privately operated enterprise which, principally, offers physical exercise facilities to the public for gainful compensation.

Junkyard means more than 100 square feet of the area of any lot used for the storage of junk, including scrap metals, salvage or other scrap materials, or for the dismantling or wrecking of automobiles or other vehicles or machinery, whether for sale or storage.

Key lot means any lot where the side lot line abuts the rear lot line of one or more other lots and not separated by an alley.

Lot depth means the average horizontal distance between the front and rear lot lines, measured in the main direction of the side lot lines.

Lot, front, means the shortest dimension of a lot fronting on a street.

Lot line means a line separating the front from a street; the side from a street adjoining property; the rear or side from an alley or street or adjoining property.

Lot, rear, means the lot boundary opposite, or approximately opposite, the lot front; in the case of a triangular or gore-shaped lot, a line ten feet in length, within the lot, parallel to and at the maximum distance from the front line of the lot.

Lot, side, means any lot boundary not a front or rear lot line.

Lot width means the horizontal distance between the side lot line measured at right angles to the lot depth, at the required front setback line.

Motel or hotel means any building containing six or more guest rooms intended or designed to be used, or which are used, rented or hired out to be occupied, or which are occupied for sleeping purposes by guests.

Nonconforming use means a use that does not conform to the regulations for the district in which it is situated.

Person includes any individual, city, county, or city and county, partnership, corporation, cooperative, association, trust or any other legal entity, including the state and federal government.

Setback line means a line established by this title to govern the placement of buildings or structures with respect to lot lines, streets or alleys.

Side and front of corner lots means the narrowest frontage of a corner lot facing the street is the "front" and the longest frontage facing the intersecting street is the "side," irrespective of the direction in which the structure faces.

Smoking lounge means any facility or location whose business operation, whether as a primary use or an ancillary use, is characterized by the sale, offering, and/or preparation of smoking of tobacco, cigars, hookah, electronic cigarettes, or similar products, including, but not limited to, establishments known variously as hookah parlors, vaping lounges, or cigar bars.

Smoking/vaping retailer means a smoke shop, electronic cigarette retailer, vapor cigarette retailer, or any other retail business that sells tobacco, electronic cigarettes, and related products primarily for off-site consumption. Smoking/vaping retailers shall not include food or beverage service, outdoor seating, or an indoor seating area greater than 100 square feet in area.

Street means a public thoroughfare which affords principal means of access to abutting property, including avenue, place, way, drive, land, boulevard, highway, road and any other thoroughfare, except an alley as defined in this chapter.

Street line means the boundary between a street right-of-way and property.

Structural alterations means any change in the supporting members of a structure, such as bearing walls, columns, beams or girders.

Structure means anything constructed or erected, the use of which requires location on or in the ground, or attachment to something having location on the ground, including swimming pools, excluding driveways, patios or parking spaces.

Use means the purpose for which land or a building is designed, arranged, or intended, or for which either land or building is or may be occupied or maintained.

Use, accessory, means a use incidental or subordinate to and devoted exclusively to the main use of a lot or a building located on the same lot.

Use permit or land use permit means a permit issued by the building department of the city for the use of land within the requirements of the district in which it is located.

Variance means a written application on a form prescribed and furnished by the city building department to be submitted to the planning commission, or to the city council in the event a quorum of the planning commission is not available, for approval or disapproval and for relief from the strict application of the requirements of the district in which the property, the subject of such application, is located as provided in chapter 17.80.

Yard means an open space other than a court on the same lot with a building which open space is unoccupied and unobstructed from the ground upward.

Yard, front, means a yard extending across the front of the lot between the side lot lines and measured from the front line of the lot to the nearest line of the building; provided, however, that if any official plan line has been established for the street upon which the lot faces, the front yard measurement shall be taken from such official plan line to the nearest line of the building.

Yard, rear, means a yard extending across the full width of the lot and measured between the rear line of the lot and the nearest line of the main building.

Yard means an open space other than a court on the same lot with a building which open space is unoccupied and unobstructed from the ground upward.

Yard, front, means a yard extending across the front of the lot between the side lot lines and measured from the front line of the lot to the nearest line of the building; provided, however, that if any official plan line has been established for the street upon which the lot faces, the front yard measurement shall be taken from such official plan line to the nearest line of the building.

Yard, rear, means a yard extending across the full width of the lot and measured between the rear line of the lot and the nearest line of the main building.

Yard, side, means a yard between the side line of the lot and the nearest line of the building and extending from the front line of the lot to the rear yard.
