300 Zoning Districts and Zoning Map
§ 19-301 Zoning districts.

For the purpose of this chapter, the Township of Blairstown is divided into the following seven zoning districts:

§ 19-302 Optional development alternatives.

In addition to the permitted uses within each of the six designated zoning districts, two types of planned developments are permitted as optional development alternatives in accordance with the requirements of this chapter and applicable provisions of the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.) on certain lands as follows:

The boundaries of the zoning districts and the areas designated for the optional development alternatives are established on the Zoning Map of the Township of Blairstown, dated September 2006, which accompanies and is part of this chapter.[1]

§ 19-304 Critical Areas Map.
A.

B.
The Critical Areas Map generally indicates those portions of the Township of Blairstown environmentally encumbered for development by "one-hundred-year floodplains," freshwater wetlands, and/or slopes 15% or greater.
C.
While the information indicated on the Critical Areas Map is appropriate for general planning purposes, it is not intended to take the place of specific on-site engineering investigation and data presented to the Township at the time applications are submitted for approval of a subdivision, site plan, construction permit, and/or any other application which considers the categories of critical areas depicted on the map.
D.
The scale of the Critical Areas Map on the 8 1/2 x 11 sheets is approximately 1 = 5,715. At this scale, one square inch equals approximately 750 acres. The users of the map, therefore, should be aware of the inherent limitations of portraying graphic material at this scale; while the information is shown as accurately as possible, slight distortions in the drafting and reproduction process will necessarily be magnified several times due to the scale of the map.

As noted on the Critical Areas Map, the sources for the mapped information are as follows, and are not from on-site investigation:

The basis for delineation of the one-hundred-year floodplains flood hazard areas are the Flood Insurance Rate Maps prepared by the Federal Emergency Management Agency, all dated September 1983;
(2)
The basis for delineation of the wetlands is the National Wetlands Inventory, Flatbrookville and Blairstown Quadrangles, prepared by the United States Fish and Wildlife Service, April 18, 1972. Additionally, photo maps prepared by the New Jersey State Department of Environmental Protection from March 1986 infrared photographs are available and should be viewed; and
(3)
The basis for delineation of the steep slope areas 15% or greater are the United States Geological Survey Maps.
F.
Regarding the one-hundred-year floodplains and freshwater wetlands areas, it is recognized that more floodplain and wetland areas exist in Blairstown Township than those indicated on the Critical Areas Map. Any additional mapping prepared by the New Jersey Department of Environmental Protection of floodplain and wetland areas in Blairstown Township shall take precedence.
§ 19-305 Topographic Elevations Map.
A.
The Topographic Elevations Map, dated September 1995, accompanies and is part of this chapter.[1]

B.
The Topographic Elevations Map generally indicates the topographic elevations above sea level of the lands within the Township of Blairstown.
C.
As noted on the Topographic Elevations Map, the sources for the mapped information are United States Geological Survey Maps (i.e., Bushkill, Portland, Flatbrookville and Blairstown Quadrangles) and are not from on-site investigation.
D.
The Topographic Elevations Map is to be used for information purposes in conjunction with the provisions in § 19-601E of this chapter governing cellular antennas for telephone, radio, paging and/or television communication" as conditional uses under N.J.S.A. 40:55D-67 of the Municipal Land Use Law.
§ 19-306 Geology and Groundwater Resources Map.
A.
The Geology and Groundwater Resources Map, dated April 1980, accompanies and is part of this chapter.[1]

B.
The Geology and Groundwater Resources Map generally shows the location of the various geological formations which underlay Blairstown Township.
C.
As noted on the Geology and Groundwater Resources Map, the source for the mapped information is Bulletin 73 prepared for the New Jersey Bureau of Geology and Topography, dated January 1974 and entitled "Geology and Groundwater Resources of Sussex and Warren Counties."
D.
The Geology and Groundwater Resources Map is to be used for information purposes in conjunction with the special review provisions for areas underlain by carbonate rock contained in § 19-806 of this chapter as required to be included within an environmental impact statement in accordance with § 19-804C(2)(b)[3] of this chapter.
§ 19-307 Interpretation of zoning district boundaries.
A.
Zoning district boundary lines are intended to follow street center lines, the center line of railroad rights-of-way, the center line of streams and lot lines as they exist on lots of record at the time of enactment of this chapter unless otherwise indicated by dimensions on the Zoning Map.
B.
Any dimensions shown on the Zoning Map are in feet and are measured horizontally and, when measured from a street, are measured from the street right-of-way line even if the center line of that street is used for the location of the zoning district line.
C.
The exact location of any disputed zoning district boundary line shall be determined by the Land Use Board.

D.
The zoning standards, controls and designations apply to every structure, lot and use within each zoning district, and the zoning district boundary lines extend vertically in both directions from ground level.
§ 19-308 Airport hazard area.
As required by the Municipal Land Use Law at N.J.S.A. 40:55D-38b(8), the boundary of the Airport Hazard Area for the airport in Blairstown Township has been delineated pursuant to the Airport Safety and Zoning Act of 1983, P.L. 1983, c. 260 (N.J.S.A. 6:1-80 et seq.) and is shown on the Zoning Map of the Township. The use and physical development of the lands located within the delineated Airport Hazard Area shall be in accordance with the provisions of this chapter specified within § 19-605, Airport hazard area, and § 19-601C, Airports.
