CHAPTER 1154

Review Procedures for Single-Family Dwellings

1154.01 INTENT.

   The intent of this Chapter is to provide adequate review of any new construction or modifications proposed to single-family dwellings, and certain accessory structures thereto, as specified in Section 1154.03. These regulations are further established to ensure compliance with the purposes and objectives of this Zoning Code and the design criteria set forth in Section 1117.08, as well as the following purposes:
(a)   To protect and improve property values.
(b)   To preserve and enhance the visual and aesthetic character of the Village.
(c)   To increase public awareness of the historic value of existing properties and the significance of good design.
(d)   To provide standards for property owners, architects and contractors to aid in the preparation of appropriate plans.
(e)   To assure accepted and recognized architectural principles are applied for the purpose of achieving safe, harmonious and integrated development throughout the community.

1154.02 AUTHORITY.

   The following administrative authorities shall be responsible for the review of any proposed construction or improvement to a single-family dwelling, including certain accessory structures, as specified in Schedule 1154.03.
(a)   The Planning Commission and the Architectural and Design Review Board are hereby charged with the responsibility of reviewing applications for the construction of single-family dwellings or proposed additions to the original footprint or ground floor area of existing single-family dwellings and certain accessory structures.
(b)   The Architectural and Design Review Board is further charged with the responsibility of reviewing applications for proposed modifications to building envelopes of existing single-family dwellings, such as adding bay windows, dormers, new chimneys or modifying the roof pitch, and the addition of certain accessory structures.
(c)   The Commissioner of Buildings is hereby charged with the responsibility of reviewing applications for proposed minor modifications that do not change the building envelope or ground floor area of the dwelling and certain accessory structures.
   An application for any of the items identified in Schedule 1154.03 shall be reviewed and approved by the appropriate administrative authority pursuant to the procedures set forth in this Chapter. For any alteration proposed that is not listed in Schedule 1154.03, the Commissioner of Buildings shall determine the appropriate review authority based on the similarity of the proposed alteration to the improvements listed in Schedule 1154.03, or whether the application is exempt from further review.

1154.03 SCHEDULE OF HOUSE IMPROVEMENTS AND ACCESSORY STRUCTURES SUBJECT TO REVIEW.

1154.04 DWELLINGS OR ADDITIONS TO EXISTING SINGLE-FAMILY DWELLINGS.

All applications for new single-family dwellings, the addition of certain accessory structures, or proposed additions to the original footprint or ground floor area of an existing single-family dwelling, as specified in Schedule 1154.03, shall comply with the following submission requirements and procedures for review:
(a)   Submission Requirements. Twelve (12) copies of the completed application shall be submitted to the Commissioner of Buildings, which shall include the following items:
(1)   A site plan prepared by a qualified professional and drawn to an appropriate scale indicating any existing buildings on the site, the location of the proposed dwelling, including its dimensions and setbacks, parking and drives, existing topography, existing and proposed landscaping, and the relationship of the proposed dwelling or addition to buildings, driveways, accessory uses and landscaping on adjacent lots;
(2)   Architectural drawings, including elevations, which adequately illustrate the proposed construction or additions. Elevations shall include the front, rear and two side elevations, together with additional views or cross sections, if necessary, to indicate completely the exterior appearance of the structure. All elevations shall be drawn to the same scale, which shall be not less than one-quarter of an inch to the foot. Each elevation shall show the accurate location of windows, doors, shutters, chimneys, porches and other architectural features, as applicable, all materials and finishes, and an accurate finish grade line;
(3)   Samples of colors and building materials to be used, renderings and other illustrative material, to convey exterior design elements; and
(4)   Color photographs of the site and adjacent buildings within 200 feet of the site.
(b)   Review for Completeness. The Commissioner of Buildings shall review the application for completeness pursuant to the submission requirements set forth in this Section. Such application shall not be processed until the necessary items are submitted. When the application is deemed complete by the Commissioner of Buildings, the Commissioner of Buildings shall forward the application to the Village Engineer to determine compliance with the subdivision regulations and other engineering and service requirements of the Village.
(1)    If the application is found to be in compliance with all applicable standards, the Commissioner of Buildings shall refer the application to the Planning Commission and Architectural and Design Review Board for their review.
(2)   If the application is found not to be in compliance with all applicable standards, the application shall be denied by the Commissioner of Buildings and returned to the applicant with the reasons for such denial.
(c)   Joint Review by Planning Commission and Architectural and Design Review Board.
(1)   All applications meeting the requirements set forth in Subsections 1154.04(a) and (b) shall be reviewed at a joint meeting of the Planning Commission and Architectural and Design Review Board. Such meeting shall be regularly scheduled, as determined by the members of each group, and shall be open to the public.
(2)   The Planning Commission shall review the application for compliance with the purpose and objectives of this Zoning Code.
(3)   The Architectural and Design Review Board shall review the application for compliance with the design criteria set forth in Section 1117.08.
(d)   Action by Planning Commission and Architectural and Design Review Board.
(1)   Following their review pursuant to Subsection 1154.04(c), the Planning Commission and Architectural and Design Review Board shall approve the application, approve the application subject to conditions or deny the application.
(2)   Approval of the application shall require a separate majority vote from both the Planning Commission and the Architectural and Design Review Board.
(3)   If approved, such approval shall immediately be stamped upon the applications for permits submitted to the Planning Commission and Architectural and Design Review Board and promptly return such applications to the Commissioner of Buildings. No building permit concerning matters within the jurisdiction of this Section 1154.04 shall be issued by the Commissioner of Buildings unless the applications have been approved in writing by both the Planning Commission and Architectural and Design Review Board.
(4)   If the Planning Commission and Architectural and Design Review Board do not act on the application within thirty (30) days from the date the application is deemed complete, or an extended time period as may be agreed upon, at the election of the applicant, it may be deemed a denial.
(5)   Approval of the proposed construction or addition shall remain valid for a period of twelve (12) months following the date of its approval. If, at the end of that time, construction has not begun, then such approval shall be considered as having lapsed and shall be of no effect unless the application is resubmitted and reapproved in compliance with this Chapter.

1154.05 PROCEDURES FOR REVIEW OF ALTERATIONS TO THE ENVELOPE OF EXISTING SINGLE-FAMILY DWELLINGS.

All applications for proposed modifications to the building envelope of existing single-family dwellings and the addition of certain accessory structures, as specified in Schedule 1154.03, shall comply with the following submission requirements and procedures for review:
   (a)   Submission Requirements. Five (5) copies of the following items shall be
submitted to the Commissioner of Buildings, unless specific items are determined by the Commissioner of Buildings to be inapplicable or unrelated to the proposed modification:
(1)   Architectural drawings, including elevations, which adequately illustrate the proposed alterations. Elevations shall include the front, rear and two side elevations, together with additional views or cross sections, if necessary, to indicate completely the exterior appearance of the structure. All elevations shall be drawn to the same scale, which shall be not less than one-quarter of an inch to the foot. Each elevation shall show the accurate location of windows, doors, shutters, chimneys, porches and other architectural features, as applicable, all materials and finishes, an accurate finish grade line, existing topography and major vegetation features;
(2)   A site plan illustrating the relationship of the dwelling and the proposed modification to the site conditions on the subject property and the immediately adjacent parcels; and
(3)   Samples of colors and building materials to be used, renderings and other illustrative material, to convey exterior design elements.
(b)   Review for Completeness. The Commissioner of Buildings shall review the application for completeness pursuant to the submission requirements set forth in this Section and for compliance with all applicable standards of this zoning code. Such application shall not be processed until the necessary items are submitted.
      (1)   If the application is deemed complete and in compliance with all applicable zoning standards by the Commissioner of Buildings, the Commissioner of Buildings shall forward the application to the Architectural and Design Review Board.
      (2)   If the application is found not to be in compliance with all applicable zoning standards, the application shall be denied by the Commissioner of Buildings and returned to the applicant with the reasons for such denial.

(c)   Board Review.
(1)   After receiving an application from the Commissioner of Buildings, the Architectural and Design Review Board shall consider the application at a scheduled meeting. This meeting may be a joint meeting with the Planning Commission as required pursuant to Section 1154.04, but not subject to joint review, or at a separately scheduled meeting that shall be open to the public.
(2)    The Architectural and Design Review Board shall review the application for compliance with the design criteria set forth in Section 1117.08 and all other applicable standards, regulations and criteria contained in this Code.
(3)   Upon receipt of an application required by this Section, the Chairman of the Board may determine that an application does not require a full Board review. In such case, the Chairman shall designate one member of the Board to review the application within thirty (30) days.
(d)   Action by the Board. Following its review pursuant to Subsection 1154.05(c), the Architectural and Design Review Board or a designated member, if applicable, shall approve the application, approve the application subject to conditions or deny the application.
(1)   If approved, such approval shall immediately be stamped upon the applications for permits submitted to the Board and promptly return such applications to the Commissioner of Buildings. No building permit concerning matters within the jurisdiction of this Section 1154.05 shall be issued by the Commissioner unless the applications have been approved in writing by the Board or a designated member, as applicable.
(2)   If the Architectural and Design Review Board does not act on the application within thirty (30) days from the date the application is deemed complete, or an extended time period as may be mutually agreed upon, at the election of the applicant, it may be deemed a denial.
(3)   Approval of the proposed construction or alteration shall remain valid for a period of twelve (12) months following the date of its approval. If, at the end of that time, construction has not begun, then such approval shall be considered as having lapsed and shall be of no effect unless the application is resubmitted and reapproved in compliance with this Section.
(4)   Actions taken by the Architectural and Design Review Board on such applications shall be considered final and shall not be appealable to the Board of Zoning Appeals.
(e)   Report to Planning Commission. All actions taken by the Architectural and Design Board pursuant to this Section shall be reported to the Planning Commission, in writing, once per month.

1154.06 MINOR ALTERATIONS REVIEWED BY BUILDING COMMISSIONER.

   When a minor design alteration to an existing single-family dwelling is proposed that does not change the building envelope or ground floor area of the dwelling, the Commissioner of Buildings may make the determination that the application complies with this Chapter. Minor alterations, including certain accessory structures that may be approved by the Building Commissioner are specified in Schedule 1154.03. In considering such determination, the following procedures shall apply:
(a)   The applicant shall submit a written description and drawing of the proposed minor alteration, including materials and installation methods.
(b)   The Commissioner of Buildings shall review the proposal to determine if it will not result in any material adverse impact to the site or surrounding properties. At any time during the review of the proposal, the Commissioner may refer to the Architectural and Design Review Board for consultation.
(c)   If the Commissioner of Buildings determines that the proposed minor alteration is in compliance with the criteria set forth in this Section and any applicable regulations of this Zoning Code, the Commissioner shall approve the application.
(d)   If the Commissioner of Buildings determines that the proposed minor alteration is not in compliance with the criteria set forth in this Section or any applicable regulations of this Zoning Code, the Commissioner shall deny the application.
   (e)   In the event the Building Commissioner denies the application based on the design review criteria set forth in Section 1117.08 or Section 1155.08, the applicant may appeal such denial to the Architectural and Design Review Board, which shall consider such appeal according to the procedures set forth in Section 1154.05.

1154.07 PROCEDURES FOR DESIGN REVIEW OF SINGLE-FAMILY DWELLINGS WITHIN A PLANNED RESIDENTIAL DEVELOPMENT.

The Architectural and Design Review Board shall advise the Planning Commission in reviewing the final architectural design of a single-family dwelling within a planned residential development, pursuant to the procedures set forth in Section 1164.14.

1154.08 PROCEDURES FOR REVIEW OF FENCE APPLICATIONS.

   The Architectural and Design Review Board shall review fence applications in compliance with the procedures set forth in Chapter 1171.
