EXCEPTIONS, AMENDMENTS AND COORDINATION
16.11 Whenever the strict compliance with these regulations would result in extraordinary hardship or injustice to the subdivider because of unusual topography, unusual size or shape of the property, or unusual conditions in surrounding property of development, the planning commission may modify, vary, or waive such regulations in order that the subdivider may subdivide his property in a reasonable manner provided that such modification, variation, or waiver shall not nullify the intent or purpose of the subdivision regulations and that the public welfare and interest of the City of Brewton shall be protected. Any such variance, together with reasons therefor shall be entered upon the minutes of the planning commission.
16.12 The requirements of these regulations may also be modified, varied or waived whenever a plat is for a planned community, but any such variation, modification or waiver shall ensure that adequate public spaces, circulation, recreation, light and air will be provided and the needs of the entire community when fully developed will be fully met.
In granting modifications, variations or waivers, the planning commission may impose such other reasonable conditions as will, in its judgement, justify such modifications, variations or waivers and still substantially maintain the objectives of these regulations.
Each modification, variation or waiver of the regulations sought by a subdivider shall be applied for individually and individually acted upon by the planning commission.
16.21 Any sections or provisions of this ordinance pertinent to subdivision requirements may be amended, supplemented or changed in accordance with the same procedure specified in section 12.5 for zoning amendments.
16.31 In cases where review and approval of subdivision developments totally or partially within the five-mile planning jurisdiction of incorporated municipalities is required, the City of Brewton Planning Commission shall coordinate its review and approval responsibilities with those of the Escambia County Commission in order to eliminate duplication of effort and additional expense to the subdivider.
16.32 Whenever the City of Brewton regulations differ from Escambia County regulations, the more restrictive requirement shall apply in accordance with existing enabling legislation for municipal and county planning commissions.
