The rules and regulations herein set forth are hereby adopted in accordance with Title 11, Subtitle 2, Chapter 52, Articles 1 through 4 of the Code of Alabama, 1975 and 1986 Cumulative Supplement.

2.11 Zoning. Zoning authority is specifically contained in Title 11, Subtitle 2, Chapter 52, Articles 1 and 4 of the Code of Alabama, 1975 and 1986 Cumulative Supplement.

2.12. Subdivision. Subdivision authority is specifically contained in Title 11, Subtitle 2, Chapter 52, Articles 1, 2 and 3 of the Code of Alabama, 1975 and 1986 Cumulative Supplement.

2.21 Zoning. This ordinance shall be in force and effect for zoning purposes within the corporate limits of the City of Brewton as presently or hereinafter established.

2.22 Subdivisions. This ordinance shall be in force and effect for the subdivision of all land which is situated inside the corporate limits of the City of Brewton as presently or hereinafter established, as well as of all land lying within the planning jurisdiction of the City of Brewton as presently or hereinafter established.

Whenever the requirements of this ordinance are at variance with the requirements of any other lawfully adopted statutes, rules, regulations or ordinances, the more restrictive, or that imposing the higher standards, shall govern.

Each phrase, sentence, paragraph, section or other provision of this ordinance is severable from all other such phrases, sentences, paragraphs, sections and provisions. Should any phrase, sentence, paragraph, section or provision of this ordinance be declared by the courts to be unconstitutional or invalid, such declaration shall not affect any other portion or provision of this ordinance.

This is a comprehensive enactment of a zoning ordinance and subdivision regulations for the City of Brewton and all prior zoning ordinances and subdivision regulations are hereby superseded and repealed.

These regulations shall not create liability on the part of the City of Brewton, the Brewton Planning Commission, the Brewton Board of Adjustment or any officer or employee thereof for any damages that may result from reliance on this ordinance or any administrative decision lawfully made thereunder.

This ordinance shall take effect and be in force from and after the date of its adoption by the Brewton City Council.
